You have applied for the AAB compliant bathrooms, remodel of the third bathroom and the renovations to the structure to allow the 1 expansion of the restaurant. The only work that can be approved at this time is the addition of two AAB restrooms and the remodel of the third bathroom. The work to alter or renovate the interior to expand the .1 existing restaurant cannot be approved or performed until the site plan review requirements are satisfied. Therefore, you will need to change the description of work to reflect the work that can be permitted at this time. The future work to alter or renovate the interior will have to be permitted separately after the approvals { have been obtained. Please contact me with any concerns or questions. Rainbow Trading International Property Address: 55 Iyannough Rd.,Hyannis,MA Assessors Map/Parcel: Map 343,Parcels 005,020&008 Zoning: Highway Business/Professional Residential&Wellhead Protection Overlay Districts Background&Review: The applicant seeks to establish a Brazilian specialty retail food market inclusive of a retail butcher and retail bakery shops within a unit previously used as a restaurant/deli. The previous use of the unit was a bagel/sandwich shop and prior to that it was D'Olimpio's Restaurant&Deli. The unit is Number 5 of the five- unit commercial structure. The unit is 5,634 sq.ft.in area. The building fronts on Route 28 (Iyannough Road). However,the property also has frontage on Cedar Street and Mederior's Way. According to the application submitted and the Assessor's records,the site is composed of three lots totaling 1.34 acres. The three lots support four buildings totaling some 11,064 sq.ft. of commercial space. All of the commercial structures are located within the Highway Business Zone and only a small portion of the total site is within the Professional Residential Zoning District(PRD). That area that is within the PRD appears to'not be in use for commercial purposes. According to plans presented,the site is to be reused and remain,for the most part,as it exists today. The retail section of the market,including the retail butcher and retail bakery shops is limited to the front area measuring 60'by60'or 3,600 sq.ft.It appears the remaining 2,034 sq.ft.that was previously the kitchen,is to be reused as the bakery and/or accessory storage. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 12, 2002. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice PP P g g PP Y sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened June 12,2002,continued to July 10,2002,August 21,2002,and October 09,2002,at which time the Board found to grant the Conditional Use Special Permit with conditions. Board Members deciding this appeal were;Gail Nightingale,Thomas A. DeRiemer,Ralph Copeland,Randolph Childs and Acting Chairman,Ron S.Jansson. Attorney Patrick M.Butler represented the applicant. The hearing was opened on June 12,2002. No testimony was taken at that time and it was continued to July 10,2002. At that continuance,Mr.Butler presented-his case before the Board. Initially he presented an argument with regards to the change in use as not being an intensification. x ' r Attorney Eliza Z. Cox then addressed the issue of a Special Permit requested under Section 3-3-6 as a Conditional Use and 4-4-5 as a Non-conforming Use. Ms. Cox noted that retail grocery would be permitted in the FIB district as a conditional use and that the proposed change does not adversely effect the neighborhood. Figures related to traffic generation,required parking,and hours of operation were presented. Questions were raised as to the nature of the store as an impulse verses a destination place and the traffic generated. It was determined that more information is needed on trip generation and traffic flow in and out on the site. The Board noted that there is a lawsuit pending against the applicant initiated by Mr. Michael S. Valentine with regards to the sale of the property. Mr.Butler was asked to provide clarification of status of this suit. Public comment was requested and no one spoke in favor or in opposition to the appeal. At the August continuance,Mr.Butler informed the board that he had discussed the traffic and site improvements with the Town Engineer,Robert Burgmann. It was noted that Mass Highway would be improving Route 28 in this area and that the curb cuts would be realigned. Copies of the Superior Court Complaint of Michael S.Valentine"Bagelport" v.Vincent P.D'Olimpio,Jr. as Trustee of D'Olimpio Realty Trust,and a copy of the Agreement for Stipulation of Dismissal were submitted. Mr.Butter also provided a copy of the Lease Agreement between D'Olimpio Realty Trust and Joao Araujo d/b/a Rainbow Trading International. Mr.Michael Hall of Rizzo Associates,discussed the traffic that would be generated by the proposed retail use. The hearing was continued to October 9th 2002. At that continuance,Mr.Butler summarized the proposal and information submitted to date. Findings of Fact: At the hearing of October 09,2002,the Board unanimously made the following findings of fact: 1. In this petition,Appeal Number 2002-67,Rainbow Trading International has applied for a special permit under section 3-3.6(3) "Conditional Uses" and,alternatively,under section 4-4.5(1) "Change of a Non-Conforming Use. The applicant proposes to change the use of one unit in a multi-unit development from a restaurant to a specialty Brazilian market. 2. The property is shown on Town of Barnstable Assessor's Map 343 as Parcels 5,8 and 20,and is commonly addressed 43-551yannough Road,Hyannis.The majority of the property,and the unit affected,are located within the Highway Business (HB) zoning district.A small portion of southwesterly comer of the lot is located within the Professional Residential District (PRD),however that portion of the property is not being utilized for commercial purposes.The locus is also wholly located within the Wellhead Protection(WP) Overlay District. 3. The property is owned by the D'Olimpio Realty Trust,Vincent P.D'Olimpio,Sr.,as Trustee.The applicant has submitted both a signed lease agreement for the unit as well as an affidavit signed by Mr. D'Olimpio as Trustee giving the applicant percussion to appear before the Zoning Board of Appeals. As such,the Board finds that the applicant has standing to bring this petition. 4. The locus is approximately 1.34 acres,and contains a 5 unit multi-unit commercial shopping plaza with frontage on lyannough Road and Medeiro's Way.The locus currently has two large curb cuts onto lyannough Road.The applicant proposes to lease and utilize the westerly end-unit designated as Unit 5 containing 5,634 square feet on the site plan. 5. The applicant has submitted an affidavit signed by Vincent D'Olimpio,Sr.,as Trustee describing the history of the plaza and Unit 5.Since the late 1950s,the plaza has contained an assortment of commercial uses that predate the HB zoning district. 2 ' y 6. Unit 5 has been utilized as a restaurant since at least 1978.Prior restaurants include D'Olimpio's,a 150- 160 seat restaurant,and Bagelport,a sit-down restaurant,deli,take-out of bagels and sandwiches,and bakery. 7. The applicant is proposing to convert unit 5 into a specialty Brazilian retail market,which includes a butcher shop and bakery.The applicant is not proposing to increase the footprint of the unit. 8. The Site Plan Review Committee issued its approval of the site plan on May 30,2002. 9. The proposed use is a conditional use in the Highway Business District pursuant to section 3-3.6(3) of the Zoning Ordinances. , 10. The proposed use will not substantially adversely affect the public health,safety,welfare,comfort or convenience of the community.The proposed use will not be more intense than the prior use of Unit 5. For example,there will be a 22 space reduction in the number of parking spaces required by the new use.In addition,the applicant is enclosing the existing dumpsters with a 6-foot stockade fence. 11. As required by site plan review,the applicant is also improving the storm water drainage on the site. Additionally,it is anticipated that the proposed use will result in a reduction of water usage as compared to the previous restaurant use. 12. The applicant has submitted a letter agreement signed by the property owner agreeing to close one curb cut and realign the other Route 28 curb cut.These changes are based upon Massachusetts Highway Department plans for future changes to the Route 28 corridor. The closing of the curb-cut together with the realignment of the other Route 28 curb-cut w ill result in significantly improved traffic flow in the site.In addition,it is anticipated that these changes will improve traffic and pedestrian safety. 13. The applicant has submitted substantial information on anticipated traffic generation,all of which predicts that the proposed new use will not result in a significant increase of trips to the site 14. as compared to the previous restaurant use.The ITE Trip Generation guidelines do not have a use code that corresponds directly to the proposed new use.The applicant's traffic engineer submitted figures based upon classification of the use as a "specialty retail center" and as a "supermarket." It is anticipated that,as compared to the prior restaurant as well as ITE's rates for a 150 seat restaurant,the proposed new use under either ITE designation(supermarket or specialty retail) would result in a net decrease of weekday and morning and morning and evening peak hour trips. 15. There is a pending in Superior Court an action relating to the property which was filed by the former tenant in Unit 5,Michael Valentine and his company,Bagelport,Ltd. 16. Based on all the information submitted on trip generation,when compared with the existing use,it is anticipated that the traffic generation to the site will be decreased as a result of the proposed new use. 17. After evaluation of all the evidence presented,the proposed new use fulfills the spirit and intent of the Zoning Ordinances and does not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact,a motion was duly made and seconded to grant a conditional use special permit to allow an existing 5,634 sq.ft.known as Unit 5 and addressed 55 Iyannough Rd.,Hyannis,MA.to be used as a retail food specialty market,bakery,retail bakery and a butcher shop subject to the following conditions: 1. All of the businesses are to be operated and owned by one entity and not to be separate enterprises. 2. The retail portion of the store,that is open to the public,shall not exceed 3,600 sq.ft. 3. The remaining 2,034 sq.ft.,is limited to use as a bakery and accessory to the retail use (storage/office). 4. The operation of the entire space shall comply with all Health,Building and Fire requirements. 3 5. This permit is being issued to the applicant,Rainbow Trading International for the locus addressed as 55 Iyannough Rd.,Hyannis,MA. It is to run with the applicant and not the land and it is not transferable to another location. 6. All site work shall comply with the approved site plan entitled"Site Plan of Land in Hyannis (Barnstable),MA prepared for John Araujo/Rainbow Trading#55 Iyannough Road" dated 3-25-02 last revised 5-22-02 and drawn byDown Cape Engineering,Inc. (SPR# 023-02). Except that the entrances to the site shall be redesigned and built as per the October 02,2002 Agreement and its attached Exhibit that requires the closing and realignment of curb cuts fronting on Route 28. A copy of both the agreement and exhibit are attached to this decision and made a part of. Those entrances and exits to the site shall further be designed for right in and right out only and shall be so marked. The improvements to the site including the intersections along Route 28 shall be implemented before the issuance of any occupancy permit for Rainbow Trading International at this site.
