" Appeal Number 1999-120-Terry Flaherty d/b/a Cape Auto g Variance to Section 4-3 Sign Regulations Summary: Granted with Conditions Applicant: Terry Flaherty d/b/a/Cape Auto(Midas) Property Address: 64 lyanough Road, Hyannis Assessor's Map/Parcel: Map 343, Parcel 013 Area: 0.56 acre Zoning: HB Highway Business Zoning District Groundwater Overlay: WP Well Protection District Background• The property consists of a 0.56 acre lot commonly addressed as 64 lyanough.Road,Hyannis.-.-It is improved,with'a 5,965 sq. ft. automobile service station(Midas).-The situ is located in an HBHighway "Business Zoning District and is serviced by public water and A private septic system...-,.' According to assessor's records,the structure was built in 19,76. At that time.the property was zoned Business which-permitted the present use. In November of.1983 the;property`Was rezoned to an HB District(ATM 11/7/83,Art. B-1(d)). Uses permitted in the B Zoning District were allowed in the HB District only by Special Permit from the Zoning Board of Appeals, shall commercial uses became nonconforming. A zoning amendment passed May 7, 1988, made offices and banks the onlyPrincipal Permitted Uses in HB Districts. The applicant is proposing to remove the existing wall signs and replace them with 3 new wall mounted signs. Currently, there are a total of 6 wall signs and one free-standing sign on the premises. The Town's sign regulations only permit a maximum of 2 signs per business in HB Districts and no more than 100 square feet(total) in area. Section 4-3.24(2)of the Sign Regulations requires conformance to the new standards on a building or a lot where one or more illegal or nonconforming signs exist for any proposed new sign. The current sign regulations were adopted in 1985(ATM 11/2/85,Art.A-1), so the existing signs are nonconforming. The applicant is seeking a Variance to Section 4-3 Sign Regulations, to permit the replacement of the. existing wall signs with 3 new wall mounted signs. No changes are proposed for the existing free- standing sign so a total of 4 signs are being proposed with a total area that exceeds the allowable square footage. Procedural Summary: This appeal was filed of the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 6, 1999. A 60 day extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened October 13, 1999, at which time the Board granted the requested Variance with conditions. " I ♦ J Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-120-Flaherty d/b/a Cape Auto Variance to Section 4-3 Sign Regulations Hearing Summary: Board Members hearing this appeal were Ron Jansson, Gail Nightingale, Richard Boy, Tom DeRiemer, and Chairman Emmett Glynn. Terry Flaherty, owner/operator, represented himself before the Board. Mr. Flaherty submitted a letter to show standing before the Board. Mr. Flaherty reported that Midas has asked all their franchisees to upgrade the image of their buildings including new signage. The signage presently on the building is quite old and this new proposal will enhance the site. Mr. Flaherty corrected his calculations. Presently, the signage(not including the free standing sign )totals 152.75 square feet. His original proposal had the wrong numbers. The proposed signage will total 80.57 square feet. The free standing sign is 83 square feet-the structure remain the same-just the face will change to the new logo sign and blend with the other new signs. Midas is providing the franchisees with the trademark signs. Mr. Flaherty told the Board he has spent a considerable amount of money upgrading the inside of the building. He is now upgrading and improving the outside including painting and landscaping, and the new signs which will enhance the outside. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of October 13, 1999, the Board unanimously voted on theIbIlowing findings of fact as•. related to Appeal No: 1999-120: 1 The-.applicant is Terry Flaherty d/b/a/Cape Auto;Systems;Inca(Midas). The property is located at 64 . a lyanough Road, Hyannis, MA, as shown on Assessor's Map 343, Parcel 013. The property consists of.a;056.acre.lot and is improved with a 5,965 square foot automobile service station. '•` 2.< °The, of:the:property is Midas Realty Corporation: The�applicant is the owner of this business. . , <" and is leasing the property from Midas Realty Corp. The applicant has submitted the'proper +'` documentation to show.standing before the Board: 3.` The site is located:in an HB Highway Business Zoning District and is serviced by public water and a private septic system. 4. The applicant is proposing to remove the existing wall signs and replace them with 3 new wall mounted signs. Currently, there area total of 6 wall signs.and one free-standing sign on the premises. 5. The Town's sign regulations only permit a maximum of 2 signs per business in HB Highway Business Districts and no more than 100 square feet(total) in area. 6. The applicant is seeking a Variance to Section 4-3 Sign Regulations, to permit the replacement of the existing wall signs with 3 new wall mounted signs. This is a vast improvement over what is currently on the site. 7. The free standing sign will remain as is(approximately) 83 square feet with just the face changing. 8. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in Appeal No. 1999-120, subject to the following terms and conditions: 1: The total square footage of all the signs on the property shall not exceed 165 square feet. 2. No more than 3 wall mounted signs and one free-standing sign shall be permitted on this site, as shown on the submitted plans. 3. The wall signs will not be illuminated. The free standing sign is currently illuminated and may remain illuminated. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Appeals of this decision, if any, shall be made pursuant to MGL Chapter 40A, Section 17,within twenty (20)days after the date of the filing of this decision. A copy of which must be filed in the office of the Town Clerk.
