This area is not to be occupied for any extended amount of time. All labor in this designated space is restricted to storage activity. • Dedicated office area shall consist of 1,038 sf. Two dumpsters are reflected on the revised plan. The Building Commissioner praised the plan. Landscaping and curb stops were discussed. The applicant agreed to stripe the paved area abut sought relief on installing the curb stops. The Commissioner cited plowing as factor. The Commissioner agreed to eliminate the requirement of interior bumpers but expressed concern over the lack of curb stops along the perimeter. Proving these would eliminate the helter-skelter parking, he declared. i Conclusion: Approved with the following conditions: Curb stops shall be provided along the perimeter and noted on the revised, stamped plan./ SPR 013-01 Cape and Islands Glass, 73 Iyannough Road, Hyannis(R1.73-006) Dan Ojala appeared before the panel seeking approval to construct a 113 square foot addition to the Cape &Islands Glass facility on Iyannough Rd. The second floor of the proposed addition shall be dedicated to storage. The purpose of this proposal is to provide additional workspace. Mr. Ojala informed the panel that this is a pre-existing, non-conforming building located in the HB zone. The building is very small however it does meet the 100' front yard setback. In addition, it was noted that the lot is almost entirely paved. Mr. Ojala reviewed the proposed improvements including a small island on 28, drainage & sub-surface leeching, and roof liters (to be tied in). There is no amendment to the sewage flow as the space is for storage. The applicant acknowledged that some zoning relief would be necessary. Planning reviewed the potential ZBA issues including lot coverage, and encroachment concerns resulting from the proposed additional square footage. Mr. Ojala declared that this proposal is not increasing the non-conformity but actually increasing the conformity. Parking provisions were discussed. It was noted that this is "...more or less a common parking area". Mr. Bill informed the applicant that the ZBA may want to see a lease agreement (allowing off site parking). Mr. Ojala responded that he was unsure if a formal agreement exists. Signage was discussed. It was declared that the off-premises sign(M) is pre-existing. It is shared with D'Olympio's and retains a"grandfathered" status. Engineering inquired about interfacing with Mass Highway regarding the curb cuts. Mr. Ojala responded that they are prepared to do so but they do not believe that it is 2 SPR Notes of 02/22/01 .l necessary. When it was pointed out that the plan reflects a closed curb cut, Mr. Ojala acknowledged this and subsequently agreed to correct the issue on a revised plan. It was determined that granite curbing shall be provided for the island. Health inquired about existing aboveground or belowground storage tanks. The applicant admitted that there is an oil tank. Mr. McKean noted that it was not depicted on the plan. It was determined that this is a new tank(as of last year). Mr. McKean advised the applicant that Health had no concerns over the dumpster but that the Fire Department may have concerns regarding the location. "The largest issue", he stated, "is the size of the lot in a WP zone. It's limited to 330 gallon per acre per day. This limits you to 90 gallons daily. You show four employees."After some discussion, Mr. McKean advised the applicant "You are limiting yourself to four employees. You can't exceed four and your flow will be limited accordingly". Mr. Ojala responded that there was no intention to increase the number of employees. There are two workers out front and four glass workers for a grand total of 6 employees. Mr. McKean also reminded the applicant that this is only a condition until such time that the town sewer becomes available. Connection is mandated upon availability. The Building Commissioner reiterated that approval of this application is subject to the limitation of no more than 6 employees. At this time, the Commissioner determined that this is an allowed use by special permit. The applicant was advised that this proposal shall be referred to the ZBA. Discussion ensued regarding parking and the unusual situation involving others driving through this lot to access another. The applicant was required to submit a revised plan that would correspond with the designated uses. The Commissioner asked if an easement had granted. "Can your customers use the parking lot?"he asked. The owner responded, "I'm not sure". "You have no customer parking"the Commissioner declared. Reconfiguration of the parking area was addressed. It was suggested that the curb be pulled back in order to maintain a 12' aisle. A swap of green space and pavement was noted. Ultimately it was determined that the revised plan should reflect the elimination of the island(between the buildings). Conclusion: Continued to 3/29/01 for review of a revised plan. The lot is owried and used by Cape&Islands Glass,an auto glass repair and glass customizing, sales and installation business. The existing building is a one-story concrete and cinderblock service and shop building of 1,176 sq.ft., built in 1950. The business office occupies 312 sq.ft. and the retail,service and shop area is 864 sq.ft. The applicant has requested two special permits. The first is a Special Permit in accordance with Section 4-4.4(2) Alteration/Expansion of a Nonconforming Building or Structure Not Used as a Single or Two Family Dwelling. The permit is requested to allow the expansion of the building and to permit certain existing site features to remain that do not'conform to today's regulations;.specifically parking lot landscaping,parking dimensions and conformance with groundwater protection overlay requirements. The second is a Conditional Use Special Permit requested for the existing glass shop in the Highway Business District(Section 3-3.6(3)(A)). Although this is a non-conforming use, the use is permitted as-a' conditional use and a permit is necessary for the business now that it proposes to expand. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on February 03, 2003. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised'and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened March 05,2003 and continued to March 18, 2003, at which time the Board found to grant the appeal. Board Members deciding this appeal were, Gail Nightingale, Ron S.Jansson,Thomas A. DeRiemer,Jeremy Gilmore and Chairman Daniel M. Creedon. Attorney Michael J. Princi represented the applicant. He presented the proposal to expand the business and improve the site. Mr.Princi stated that additional parking was to occur on the neighboring site. It w was noted that the numbei of employees would be limited to 6. The board expressed concern for the on- site parking,the proposed expansion of the building on this small lot and the site entrarjce and exits. A revised plan for the addition was submitted that did not have an addition to the footprint of the building only a second floor was to be added,thus reducing the area of the Building to 1,038 sq.ft. on each floor. The applicants stated that they did not wish to be restricted to right in and out only and that they would desire to reduce one of the curb cuts when the state implemented improvements along this area of Route 28. Findings of Fact: At the hearing of March 18, 2003,the Board unanimously made the following findings of fact: 1. Appeal 2003-42 is that of Cape&Islands Glass Co., Inc. requesting a Special Permit in accordance with Section 4-4.4(2) Expansion of a Nonconforming Building and a Conditional Use Special Per"mit in accordance with Section 3-3.6(3)(A). The property is addressed as 73 Iyannough Road,Hyannis, MA,as shown on Assessor's Map 343 as Parcel 6. It is in a Highway Business Zoning District and in a Wellhead Protection Overlay District. 2. The request is for a Special Permit in accordance with Section 4-4.4(2)to expand a nonconforming building and to retain existing site features that may not conform to the present zoning requirements. The Conditional Use Special Permit is for the existing glass shop use to be permitted on the property. With regards to the building,the applicant seeks to add a second floor to the structure. 3. The proposal has been before Site Plan Review Committee and the Committee found the plan approvable on March 29, 2001 with conditions. The conditions imposed in the March 30,2001 letter appear to have been at the request of the Health Agent to assure that wastewater flows would not exceed 90 gallons per day for compliance with Title V. The conditions are: The storage space shall now consist of 1,038 sq.ft. This area is not to be occupied for any extended amount of time. All. labor in this designated space is restricted to storage activity. Dedicated office area shall consist of 1,038 sq.ft. The applicant is limited in the number of employees permitted on the premises at any one time to a maximum of four glass workers and two office workers(total of 6) until such time that this property is connected to Town sewer. 4. The proposed addition does not increase the required on-site parking by 5 or more cars and according to Section 4-2.6(6)(B) the parking lot need not be improved to the meet the requirements of Section 4- 2.6- Landscape Requirements for Parking Lots. 5. A review of the dimensional figures with regard to parking stalls and aisle width, shows that the plan would meet the requirements of Section 4-7.7 Minimum Parking Lot Design Standards if a'clockwise one-way circulation pattern around the building were applied. 6. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit. 7. After evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 8. Closing of the curb cut,shall include installation of granite curbing and the landscaping of that area within the right-of-way of Route 28 with appropriate plantings. • The site shall be so marked to delineate a one-way interior circulation pattern going clockwise around the building. ' 2. The building shall be limited to two-stories;having,a total area of 2,076 sq.ft, Storage area shall occupy 1,038 sq.ft. and the office use shall occupy the remaining 1,038 sq.ft. 3. The number of employees permitted on the premises shall be limited to four glass workers and two' r- office workers (total of 6) at any one time. This restriction shall apply only so long as the property is served by an on site private septic disposal. The Board of Health or Heath Agent may also remove this restriction. 4.
