Carron, Trustee:Premises at 75 Iyannough Road(corner of Cedar Street), l Hyannis, MA20 Dear Mr. Roma: ' S �� Thank you for taking the time to return my call and take under consideration my concerns about Mr. Carron's signage at the above location. This site was the subject of Special Permits in the Town of Barnstable Zoning Board of Appeals Case No. 2004-152. I have enclosed a copy of the Decision with this letter for your convenience. I have also enclosed a copy of the Plans referred to in the Decision which, as you can see, disclose the site location for a sign in the northwesterly corner. As you can see from the enclosed copy of the Decision, the Application for Special Permit was filed with the Town Clerk on October 7,2004 and the Decision was signed by the Chairman of the Zoning Board of Appeals on November 29t",2004 and was logged into the Town Clerk's Office on November 30`h,2004. Thereafter the Town Clerk endorsed it on December 21,2004 confirming that no appeals from the Decision had been filed within the prescribed twenty(20)day appeal period. The Zoning Board ofAppeals in its Decision granted Special Permits,for among other things to allow, under then Section 4-4.4(2) "alteration or expansion of a non-conforming building or structure for development of the building and site". The Decision goes on to state that"Development of the site shall be as proposed to the Board and as shown on plans presented..." and goes on to site the plans enclosed herewith. a 1 � e John Roma, Building Inspector Building Department TOWN OF BARNSTABLE April 26, 2006 Page 2 The Decision goes on further to state that all signage shall conform to the Zoning Requirements without Variance. I have also included and excerpt from the old (i.e. pre-codification) version of the Zoning Ordinance specifically Section 4-3.7 which refers to signs in,among other districts,the HB Business District. The location I am concerned with was at that time located in the HB Business District. I do not believe that the new downtown Hyannis Village Re-zoning was advertised until sometime in 2005 (I believe the first hearing before the Town Counsel was May 19, 2005) and that the Decision in Zoning Board of Appeals Case No. 2004-152 had entered well prior to the first publication of the Notice of Proposed Zoning Changes. General Laws Chapter 40A, Section 6(copy enclosed)provides that a Zoning Ordinance or By-Law shall not apply to structures or uses lawfully in existence or lawfully begun,"or to a building or Special Permit issued before the first publication of notice .of the public hearing on such Ordinance or By-Law required by Section 5,but shall apply to any change or substantial extension of such use, to a building or Special Permit issued after the first notice of said public hearing, ...". I have also enclosed a copy of Section 240-65 of the Barnstable Code which describes the signage regulations in,among other districts,the"UB"District following codification of the Zoning Ordinance with the other regulations in the Town. The pertinent provisions remain the same,i.e.maximum height of 10' with an additional 2' allowed by the Building Inspector under certain circumstances; square footage not to exceed 10% of the area of building wall facing a public way or 100 sq. ft. whichever is lesser; only one free- standing sign is allowed per business which may not exceed half the allowable size as permitted in this section. I have enclosed a copy of a sketch rendition of the double-faced, interior lighted 6'x4' sign which my client has proposed to construct in the location indicated on the plan approved by the Zoning Board of Appeals. I would very much like to discuss the matter with you if you are of a mind that the new regulations apply, thereby reducing the size of the sign which may be constructed. I am of the opinion that the Decision,incorporating the site plans and landscape plan clearly contemplate and includes authorization for the land owner to erect signage in the locations shown on the plan and in accordance with the then applicable Zoning By-law. John Roma, Building Inspector Building Department TOWN OF BARNSTABLE April 26, 2006 Page 3 Your review of the plans (the existing and proposed) will also indicate the substantial perimeter work required to be done in order for the owner to comply with the Board's condition that the access from Route 28 be closed off and that access to the site be redesigned so it would only be from Cedar Street. This naturally involved disruption of existing features and improvements around the perimeter of the property in order to comply with the mandates of the Zoning Board of Appeals Decision. Finally, it seems clear that under General Laws Chapter 40A, Section 6, and the circumstances of this case,a Special Permit had been granted which contemplated the construction of a sign under the Zoning Ordinance as it appeared at the time of the Decision, that a Building Permit was timely issued(within 6 months)following the entry of the Decision and that construction proceeded (and is still under way) in due course and without interruption. Under those circumstances,the provisions of General Laws Chapter 40A, Section 6, entitle the owner to be regulated by the Zoning Ordinance as in effect at the time the Special Permit issued. I hope that your review of this letter and the enclosures will succeed in satisfactorily demonstrating to you that a Permit should be issued to Mr. Carron for a sign permit (other requirements of the sign permit,per se being met)to construct a sign substantially as shown on the enclosed sketch.' I look forward to discussing this matter with you at your convenience, if you have any questions or feel'that my analysis of the foregoing is not correct and that a Permit should not issue. This section shall not apply to establishments which display live nudity for their patrons, as defined in section nine A, adult bookstores, adult motion picture theaters, adult paraphernalia shops, or adult video stores subject to the provisions of section nine A: A zoning ordinance or by-law shall provide that construction or operations under a building or special permit shall conform to any subsequent amendment of the ordinance or by-law unless the use or construction is commenced within a period of not more than six months after the issuance of the permit and in cases involving construction, unless such construction is continued through to completion as continuously and expeditiously as is reasonable. A zoning ordinance or by-law may define and regulate nonconforming uses and structures abandoned or not used for. a period of two years or more. ' Any increase in area, frontage, width, yard, or depth,requirements of a zoning ordinance or by-law shall not apply to a lot for single and two-family residential use which at the time of recording or endorsement, whichever occurs sooner was not held in common ownership with any adjoining land, conformed to then existing requirements and had less than the proposed requirement but at least five thousand square feet of area and fifty feet of frontage. The lot is developed with a 13/a-story commercial building of 4,381 sq.ft. The structure is presently vacant and in July of 2004 it was sold by the Town of - - Barnstable to the applicant as recorded at the Registry of Deeds in Book 18885 page 179. The applicant is proposing to demolish the existing structure and completely redevelop the site with a new 1'/z-story commercial building estimated to be 3,375 sq.ft. in total area plus a 2,275 sq.ft. basement. The first floor of the building is to be used for specialty retail—Cape Cod Nutrition Corner,Inc. - the second floor is to be developed into two one-bedroom apartments. The basement is to be used for storage and utilities. The redeveloped site is to eliminate the Route 28 curb-cut and reduce the width of the curb-cut on Cedar Street. Thirteen on-site parking spaces are to be provided as well as an on-site loading area. Improved landscaping'and anew Title 5 on-site septic system will be installed. In the Special Permit application, the applicant has requested four forms of relief. The first is a 1pf ecial Permit in accordance with Section 4-4.5—Non-Conforming Uses. The second is a Special Permit for conditional use in accordance,with Section 3-3.6 (3) (A) - Conditional Uses in a Highway Business District to permit the two uses of the site (1)retail specialty sales and (2) apartments. The third is a Special Permit in accordance with Section 4-4.4(2)—Alteration or Expansion of a Non-conforming Building or Structure to allow a new building to be built not in conformity to the setback requirements nor in compliance with all of the structural site requirements for the proposed uses -parking, site coverage, and landscaping, however the new development would be more conforming than what now exists. The fourth is a Special Permit to seek a Reduction of Parking Requirements as per Section 4-2.10 to allowl3 on-site spaces when16 are required. ' Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 07,-2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice , sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 17, 2004, at which time the Board found to grant the appeal. Board Members deciding this appeal were Ralph Copeland, Sheila Geiler, Gail Nightingale, James Hatfield, and Vice Chairman-Ron S. Jansson. Attorney J. Douglas Murphy represented the applicant before the Board. James R. Carron, the Trustee, was also present. Mr. Murphy described the site noting that it had been acquired by the Town of Barnstable some five years ago and was recently sold to the applicant. The site has been deteriorating for a number of years and the applicant is proposing to completely redevelop the site. Mr. Murphy noted that the proposed new building and proposed site improvements would result in a site more conforming to zoning requirements than that which exists today. He also noted that the existing building is in a dilapidated condition and redevelopment of the site would be most beneficial to the neighborhood. Mr. Murphy discussed the nature of the Special Permits being requested. He acknowledged that a permit was requested pursuant to Section 4-4.5 —Non-Conforming Uses; however, the nature of the proposed uses—.retail and apartments can both by a Condition Use Special Permit as requested under Section 3-3.6 (3) (A). The Board agreed that the suitable form of relief would be the Conditional Use. Mr. Murphy itemized the non-conformities in the building and site. He cited the degree bf the existing non-conformities and noted the proposed conditions. In each instance the degree of non-conformity was being improved. He noted the benefits of the closed cub-cuts on Route 28 and the reduced curb-cut on Cedar Street. Elevations of the proposed building were submitted. The Board discussed the possibility of enclosing the exterior stairwells to the second floor and the applicant agreed to enclose them. ` Public comment was requested and no one spoke in favor or in opposition to the request. Findings of)Fact: At the hearing of November 17, 2004, the Board unanimously made the following findings of fact: Appeal number 152 of 2004 is thafof James R, Carron,Trustee of 75 Iyanough Realty Trust seeking a' Special Permit for the property located at 75 Iyanough Road,Hyannis,MA. The subject property is . shown on Assessor's Map 343 as parcel 007. It is in the Highway Business Zoning District and in the Wellhead Protection Overlay District. 1. The applicant has requested a total of four Special Permits. The first Special Permit being sought is in accordance with Section 4-4.5—Non-Conforming Uses and the second Special Permit being sought is in accordance with Section 3-3.6 (3)(A)—Conditional Uses in a Highway Business District. The Highway Business District provides that the uses permitted in the B Zoning District maybe allowed as a conditional use by Special Permit. The two requests are being made in the conjunctive as only one is necessary to permit the use of the property for retail on the first floor and apartments on the second floor. 2. The third relief being requested is that of a Special Permit pursuant to Section 4-4.4(2) —Alteration or Expansion of a Non-conforming Building or Structure. Although the proposal is to demolish the building and redevelop the site; the resulting new building and site will be more conforming that that which currently exists on the parcel. The fourth Special Permit seeks a Reduction of Parking Requirements in accordance with Section 4-2.10. That request is to reduce the number of on-site parking spaces from the required 16 to 13. Section 4-2.10 authorizes the.Board to grant a reduction in cases where differing uses have differing peak parking demands. In this instance,justification can be made for the reduction based upon the apartment use verses the retail use one requiring its parking during the night time and the other during the day time. 3. The locus is a 0?3-acre lot located at the intersection of Iyanough Road(Route 28) and Cedar C treet. it is developed with a ;%a-story commercial building of 4.381 sq.ft. The granting of a Special Permit for the redevelopment would not be in derogation of the Zoning Ordinance because the proposal fulfills the spirit and intent of the Zoning Ordinance. Permitting the development would not represent a substantial detriment to the public good or to the neighborhood.
