Eric Hubler concerning the elimination of the fire lanes at the aforementioned complex. Lt. Hubler informs me that this occurred without any forewarning or fire department approval. As you may be aware, the abolition of the fire lanes during the aftermath of the plane crash almost two years ago has created liability and safety concerns. Trust property housing Staples, T. J. Max, Brooks Pharmacy(etc.). Until last Spring, there was a fence separating the cul-de-sac end of my street (where I live) and the plaza property. It fell into.disrepair over many years and not much of it was left by then. ` At about this time last year,I went to 200 Main St. to inquire about the company's responsibility to maintain the fence. I was told that they are required to have a fence,but there was nothing that regulated their maintenance of it. I then spoke with a J.P. Trust representative by phone,who told me that the company was talking with surveyors and fence people about replacing the fence. The fence was taken down, and the area was cleaned up; however, the fence has not been replaced. I called the site manager to inquire about this over this Memorial Day weekend as cars are now driving from the Kings Way through to the plaza,virtually eliminating the function of the cul-de-sac. Additionally, trash papers from the plaza blow through, littering the street's residences. The site manager told me that the company had decided to put the fence replacement on hold. During our conversation I politely stated that the fence was required legally. He told me he did not think this was the case; that if a fence was erected, it would be done as a courtesy, not for legal reasons. I did not pursue that with him. What I am attempting to do is find out in fact what the town requires in this regard. I thought I knew,but now learn I need clarification. .-Thank you for your attention. Yours truly, Douglas R. I can not find any decision on file that would require this and in fact the plaza was constructed before the zoning change to HB. Originally, this was a B district and pre-dates our more formal SPR process. Art indicated that if this is a town road, Engineering may offer some assistance in this matter. It did appear to me that this is 'a town road. Before I respond to the complainant, I would like to know for sure what our obligation is, if any. You always seem to be aware of the property history and are so helpful. Can you help me with this? First of all, I would like to thank you for your time in speaking with me on September 2 and for researching your files pertaining to the TJX/Staples Plaza. After reviewing the papers and plan which you gave me, as well as the documents my clients had, and after speaking with Mr. Mark Ells, Director of the Hyannis Department of Public Works, current and former employees and independent contractors of my client, I find that there is nothing either in the plans or correspondence pertaining to work to be done to the paved area between the Staples building and the sidewalk. Nothing at all that I have seen requires plantings, landscaping, or even that it be marked and kept open as a fire lane. If I am incorrect as to the above,please refer me to specific correspondence and/or notations on the approved plan requiring any of same. Incidentally, I have also been advised that the Fire Department specifically did not require that area be kept open as a fire lane as a condition to the Staples expansion being approved. Its concern was the Fire Lane which is marked on the plan and which does exist at the center as required. Subsequently, complaints have been received regarding vehicular traffic utilizing the paved area between the Staples building and the sidewalk. The Site Plan Review decision that allowed the expansion of the Staples building to it's present size required that this area be landscaped in accordance with an approved site plan on file.The landscaping requirement was postponed during the design phase but as the improvements have been completed,the landscaping must now be addressed. As Coordinator,it is my responsibility to ensure that the site plan requirements are completed and satisfactory. With this in mind,I respectfully request that you submit a landscape plan for the . . aforementioned area. In the mean time,please take immediate measures to temporarily impede vehicular traffic from accessing this area. It appears that substantlll amounts of rain- water collect on the roof, flow through drainpipes to the ground,; deposit on the abutting lot and then flow into the building,, The laws of the -Town of Barnstable state that all drainage shall be self-contained. Therefore, I respectfully request that a method be es- tablished .to direct all run off water into an approved catch basin.
