A letter from the property owner of the former King's Dept. Store off route 132, 'Hyannis., authorizing the use was submitted to the Board- and this would be the site of the Pizza.Time operation. . The building is in a Business zoned district and it is only the recreational use of the site and not the restaurant use that concerns theBoard. The principal use of the premises would not be coin-operated amusement devices and application is made under Sec. P. (9) of the zoning by-laws for a building or place for recreation or amusement in a Business District. They have attempted to meet with as many ,of the town officials as possible to acquaint people with their operation and it was suggested by Mr. McLaughlin that the Board members visit their site in Manchester, New Hampshire to observe. first-hand how the Pizza Time centers operate. There have been attempts -to get together with Peter'Ryner, director of the Planning Board on the facade of, the. building so that .it would be compatible with what the town wants for the outside appearance of the building. Mr. Saltsman spoke of the operation and, presented a slide show. Pizza Time caters to the thirteen year old and younger group and have computer .controlled puppets and costumed characters. There would. be kiddie rides and video amusements along with . the .serving of pizza and other light foods. They do not .cater to teenagers and children must be accompanied by parents or friends who are adults. The company has over 200 operations in the United States and their principal character is Chuck E. Cheese who has made many apparances at fund raising groups and charitable institutions. Letters of recommendation from Police Chiefs and municipal officials were real aloud by Mr. Saltsman. : Chuck E. Cheese ,entered the hearing room and expressed disappoint- ment that the town agencies had not visited their Manchester, N.H. operation. The projected payroll for the Hyannis operation would be $300,000 to $400,000 _per year. and a substantial number of people would be employed on both a part-time and full-time basis. The video devices which ,are token operated would occupy about 24% of the floor space and approximately 25% of income is derived from video .and other games. They plan to have 75 .amusement devices in-the Hyannis store. Tokens to operate the machines are given when the food is purchased. Mr. McLaughlin said this center would be an asset to the town and wouid .provide a safe and controlled center for children. Mrs. Mary Ann Strayer spoke in objection to the video games and said that she did not object- to the other entertainment uses proposed at the center. Ray McEadren said that the center would upgrade the property and.not .cause detriment to the town. Joseph Madronia felt that the people opposed should go to Manchester to .view the Pizza Time operation and felt they would not find it . detrimental. Mr: McLaughlin said that everyone shared Mrs. Strayer's concerns and there is a need for the type of entertainment .proposed by the petitioner for young children. The matter was taken under advisement and the hearing closed. Mr. Luke Lally voted to approve the .petitioner's application for a special permit with the restrictions that there would be no alcholic beverages served on the premises at any time and that notmore than 25 video games would be installed. Mr. Frank P. Congdon voted to. approve a special permit with the restriction that.not more than 25% of the floor area be used for entertainment purposes. Mr. Richard Boy voted to allow a special permit for live children's entertainment only with the restriction that electronically, mechanically and/or manually operated amusement devices on the premises for purpose of operation by patrons is prohibited. Mr. Boy found that the. serving of pizza and other light foods to children with live Disney-like characters for entertainment purposes with puppet shows, etc. would be an asset to the town and that there is an existing video game center nearby which fulfills the need for video game entertainment The town does not have live children's entertainment and Mr. Boy found that restrictin the permit would encourage a more desireable atmosphere for children under thirteen by exposing them to the artistry and craft required to produce live entertainment. It is the opinion of 'the Board that the more restrictive conditions imposed by Board member Richard Boy prevail and the special permit is allowed in accordance with all of the restrictions imposed. WHEREFOR, The Plaintiff respectfully demands: A. That this Court issue a declaratory judgment inter- preting the restrictions imposed by the Board of Appeals upon this petition so as to allow the Plaintiff to the use which was petitioned for by the Plaintiff before the Board of Appeals. B. Alternatively, that the matter- be remanded to the Board of Appeals for further proceedings consistent with the opinion of the Court. C. That the Plaintiff be awarded its costs and reasonable attorneys fees associated with the prosecution of this action. D. For such other relief as the Court may deem meet and just. COUNT IV 21 . Paragraphs 1 through 14 of Count I are incorporated herein by reference. 22 . Count IV is a count for declaratory relief pursuant to Massachusetts General Laws Chapter 231A. 23 . Massachusetts General Laws Chapter 40A Section 9 requires the unanimous vote of a three member Board of Appeals in order for a petition to be granted. The Barnstable Board of Appeals at all relevant times was designated and constituted as a three member board. 24 . When the Board of Appeals arrived at its final decision in this matter, only two members of the Board which had heard the presentation of evidence some two weeks previous were present at the time when the Board purported to take MYCOCK. KILROY. Its "vote" upon the Plaintiff's petition then pending GREEN & before it. The.. third absent member of the Board, member MCLAUGHLIN. P.C. Richard L. Boy, was not precept in person. Rather, Mr . ATTORNEYS AT LAW Boy had submitted previous to the day of the purported "vote" 171.M.A1N STREET a written document which purported to set forth his vote LOST OFFICE BOX 960 and his reasons therefor. . The two members of the Board of Appeals who were present orally cast their vote and the document submitted by Mr. Boy was read. into the record of the Board by the chair- man or secretary of the Board and was treated by the Board as a vote of the absent member, Richard L. Boy. At the time of this purported "vote" , there was no debate or discussion among the members as to the merits of the peti- tion, the various considerations imposed by both the General Laws and the local bylaw upon the consideration of the petition, nor was there a discussion concerning the content of the "vote" of the absent member, Richard L. Boy. Rather, each member present simply read into the record his own vote, Mr. Boy' s "vote" was read into the record, and the hearing was closed. 26 . Because only two members of the Board of Appeals were present for the purported "vote of the Board on the day selected by the Board to "vote" upon plaintiff ' s petition, there was no quorum present, the purported "vote" of the Board was therefor invalid, and no "vote" in fact took place at that time. WHEREFOR, the Plaintiff respectfully demands that this Court issue a declaratory judgment declaring: A. That the Board of Appeals ' deliberation and voting did not occur under public observation as required by Massachusetts General Laws Chapter 39 Section 23B and its decision is therefor invalid. B. That the vote taken by. the Board of Appeals was invalid as there was not a quorum present. C. That the relief sought by the petition for special permit as submitted is granted, as there was no action by the Board of Appeals on said petition within 90 days as required by Massachusetts General Laws Chapter 40A Section 9 because of the failure of the Board of Appeals to effectuate a "vote" with a legally constituted quorum present and voting. The Plaintiff, Pizza Time Partners of New England, is a Massachusetts partnership having a usual place of business at 131 Coolidge Street, Hudson, Massachu- setts. 2 . The Defendants, Luke P. Lally, Richard L. Boy and Frank P. Congdon are the duly constit-ted and regular members of the Board of Appeals of the Town of Barnstable and all reside in the Town of Barnstable as follows: a) . The property which constitutes the subject of the petition to the Barnstable Board of Appeals and this action is owned by Nicholas L. Vinios, Trustee of J & P Hyannis Trust under a Declaration of Trust dated December 2 , 1967, said Declaration being registered , with the Barnstable Registr_V District of the land Court as Document No. 117779, noted on Certificate of Title No. 41710 . 4 . Nicholas L. Vinios as trustee entered into an indenture of lease dated March 23, 1983 with Capital Acquisition and Investment Incorporation, an Ohio business corpora- tion, with a business address of Suite 1010, IBM Build- MYCOCK, KILROY ing, 140 Easttown Street, Columbus, Ohio. (617)771-6070 5 . Under a separate agreement of assignment and sub-lease, and under a letter of authority :from Nicholas L. Vinios as trustee dated March 24, 1983, the Plaintiff applied to the Zoning Board of Appeals of the Town of Barnstable in its own name for a special hermit to allow it to make improvements to an existing building, the locus, located within structures known as the ITyannis Airport Plaza at the intersection of Barnstable Road and I anou h Road, Hvannis, Massachusetts. The special Y g _ permit, petitioned for pursuant to Section P (9) of the Zoning Bylaw of the Town of Barnstable, sought to allow the use of locus as a theatre, restaurant and amusement and recreation center. 6 . The petition- for the special permit was filed with the Board of Appeals on or about February 28 , 1983 . 7 . On March 24 , 1983, after required notice to abutters , the Zoning Board of Appeals of the Town of Barnstable held a public hearing at the Town Office Building, Hyannis , Massachu- setts. After the close of the hearing on March 24 , 1983 , the Board of Appeals took the Plaintiff' s petition for special permit under advisement. 8 . On April 7 , 1983 , the Board of Appeals took action on Plaintiff' s petition and purportedly approved Plaintiff ' s application for a special permit in accordance with the terms of the facts and decision of the Board, a copy of which is attached hereto and marked Exhibit "A" . 9 . The zoning_% '. decision of the Board of Appeals was thereafter filed with the Town Clerk of the Town of Barnstable on May 19 , 1983 . 10 . The Plaintiff is aggrieved by the decision of the Board of Appeals. 11. The restrictions , if in fact imposed by the Board of ADneals, constitute an abuse of the Board' s discretion. Additionally, the restrictions, if imposed, were arbitrary, capricious and in excess of the authority of the Defendant Board. 12 . The restrictions, if imposed by the Board of Appeals, were imposed without the statutory requisite findings and are therefor illegal and unenforceable. ' 13 . At least two of the restrictions, if in fact imposed by the Board of Appeals, are utterly inconsistent with one another IYCOCK, KILROY and, if both were intended to be imposed, render the purported & GREEN decision of the Board nonsensical and unenforceable. WHEREFOR, the Plaintiff prays: 1. That the restrictions proportedly imposed by the Board of Appeals as a condition of its granting of thespecial _permit be annulled. 2. That the matter be remanded to the Board of Appeals under an order directing the Board of Appeals to issue the special permit as prayed for by the Plaintiff. 3. That the Plaintiff be awarded its costs and attorneys fees associated with the prosecution of . this action. 4 . For such other relief as the Court deems proper under the circumstances. COUNT II 15 . Paragraphs 1 through 14 of Count I are incorporated herein by reference.. 16 . Count II is a count for declaratory relief pursuant to Massachusetts General Laws Chapter 231A. 17 . The purported decision of the Board of Appeals imposing restrictions in conjunction with the granting of the special permit is, on its face, internally inconsistent, nonsensical , and cannot under any reading of the facts be interpreted with certainty, clarity, and meaning. WHEREFOR, The Plaintiff respectfully demands: 1. That this Court issue a declaratory judgment declaring that the decision of the Board of Appeals effectively granted the relief sought by the Plaintiff in its petition to the Board of Appeals and that the restrictions purportedly imposed by the Board of Appeals be declared illegal and of no effect. 2 . Alternatively, that this Court issue a declaratory judgment interpreting the restrictions imposed by the Board of Appeals upon this petition so as to allow the Plaintiff to tle use which was petitioned for by the Plaintiff before the Board of Appeals. .00K. Appeal No' 1983-18 Page _ 2 of 3 ' On April 7 19.83, The Board of Appeals found Attorney Charles McLaughlin represented the petitioner .and briefs were submitted to the Board members along -with material .outlining the Pizza Time operation. A letter from the property owner of the former King's Dept. Store off route 132, Hyannis., authorizing the use was submitted to the Board and this would. be the site of the Pizza Time operation. The building is in a Business zoned district and it is only the -recreational use of the site and not the restaurant use that concerns the Board. The principal use of the premises would not be coin-operated amusement devices and application is made under Sec. P. (9) of the zoning by-laws for a building or place for recreation or amusement in a Business District. They have attempted to meet with as. many.of the town officials as possible to acquaint people with their operation and it was suggested by Mr. McLaughlin that the Board members visit their site in Manchester, New Hampshire to observe. first-hand how the Pizza Time centers operate. There have been attempts -to get together with Peter Ryner, director of the Planning Board on the facade.. of the building so that it would be compatible with what the town wants' for the outside appearance of the building. Mr. Saltsman spoke of the operation and presented a slide show. Pizza Time caters to the thirteen year old and younger group and have computer controlled puppets and costumed characters. There would be kiddie rides and video amusements along with the serving of pizza and other light foods. They do not cater to teenagers and children must be accompanied by parents or friends who are adults. The company has over 200 operations in the United States and their principal character is Chuck E. Cheese who has made many apperances at fund raising groups and charitable institutions. Letters of recommendation from Police Chiefs and municipal officials were real aloud by Mr. Saltsman.' " Chuck E. Cheese entered the hearing room and expressed disappoint- ment that the town agencies had not visited their Manchester, N.H. operation. The projected payroll for the Hyannis operation would be $300,000 to $400,000 per year and a substantial number.of people would be employed on both a part-time and full-time basis. The video .devices which are token operated would occupy about 24% of the floor space and approximately 25% of income is derived from video and other games. They plan to have 75 amusement devices-in the Hyannis store. Tokens to operate the machines are given when -the food is .purchased. Mrs. Mary Ann Strayer spoke in objection to the video games and said that she did not object-to the other entertainment-uses proposed at the center. Ray McEadren said that the center would upgrade the property and not cause detriment to the town. Joseph Madronia felt that the people opposed should go to Manchester to view the Pizza Time operation and felt they would not find it detrimental. Mr. McLaughlin said that everyone shared Mrs. Strayer's concerns and there is a need for the -type of entertainment proposed by the petitioner for young children. The matter was taken under advisement and the hearing closed. Mr. Luke Lally voted to approve the petitioner's application for a special permit with the restrictions that there would be no alcholic beverages served on the premises at any time and that notmore than 25 video games would be installed. Mr. Frank P. Congdon voted to approve a special permit with the" restriction that not more than 25% of the floor area be used for entertainment purposes. Mr. Richard Boy voted to allow a special permit for live children's entertainment only with the restriction that electronically, mechanically and/or manually operated amusement devices on. the premises for purpose of operation by patrons is prohibited. Mr. Boy found 'that the serving of pizza and other light. foods to children with live Disney-like characters for entertainment purposes with puppet shows, etc. would be an asset to the town and that there is an existing video game center nearby which fulfills the need for video game entertainment. The town does not have live children's entertainment and Mr. Boy found that restricting the permit would .encourage a more desireable atmosphere for children under thirteen by exposing them to the artistry and craft required to produce live entertainment. It is the opinion of the Board that the more restrictive conditions imposed by Board member Richard Boy: prevail and the special permit is allowed in accordance with all of the restrictions imposed. Trust property housing Staples, T. J. Max, Brooks Pharmacx (etc.). Until last'Spring, there was a fence separating the cul-de-sac end of my street(where I live) and the plaza 1,� y property. It fell into.disrepair over many years and not much of it was left by then. e A4 I At about this time last year,I went to 200 Main St. to inquire about the company's responsibility to maintain the fence. I was told that they are required to have a fence,but there was nothing that regulated their maintenance of it. I then spoke with a J.P. Trust representative by phone,who told me that the company was talking with surveyors and fence people about replacing the fence. The fence was taken down, and the area was cleaned up; however, the fence has not been replaced. I called the site manager to inquire about this over this Memorial Day weekend as cars are now driving from the Kings Way through to the plaza,virtually eliminating the function of the cul-de-sac.Additionally, trash papers from the plaza blow through, littering the street's residences. The site manager told me that the company had decided to put the fence replacement on hold. During our conversation I politely stated that the fence was required legally.He told me he did not think this was the case; that if a fence was erected, it would be done as a courtesy, not for legal reasons. I did not pursue that with him. What I am attempting to do is find out in fact what the town requires in this regard. I can not find any decision on file that would require this and in fact the plaza was constructed before the zoning change to HB. Originally, this was a B district and 'pre-dates our more formal SPR process. Art indicated that if this is a town road, Engineering may offer some assistance in this matter. Since this is a town road and it was just paved when sewer was installed by the town at the abutter's expense, we felt it our jurisdiction to restrict the access to the plaza before the edge of the road got destroyed by vehicles driving into the plaza. I told the person who came in that the road is being regulated by the town to restrict access to the plaza and the barriers would remain until the fence gets replaced. Since the town is not responsible to install a fence, the barriers were installed. I told him that the only regulatory control the town might have is through site plan review or licensing. I told him to write a letter asking the building commissioner to request the maintenance of a fence in any future site plan review of this site and hopefully the letter will be placed in the plaza's file for future reference. As far as trash goes, Structures and Grounds can clean an area owned by the town but the last lots on that street are privately owned and we cannot clean private property. If it gets out of control, maybe the Health Department can intercede in this matter. I hope this puts into context what the problem is out there and hopefully the Building Department can gain control over the fence requirement for the plaza to satisfy the neighbors.
