Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on November 12, 2009. A public hearing ybefore the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter.40A. The hearing was opened December 9, 2009, at which time the Board found to grant the Conditional Use Special Permit subject to conditions. Board Members deciding this appeal were,James`F 'McGillen, William H. Newton, Michael P. Hersey, Craig G. Larson, and Board Chair, Laura F: Shufelt: Attorney BrianJ. Wall represented the applicant at the public.hearing. He presented a brief history of the property and the proposal to develop.the lot and to use it as accessory to the abutting Hyannis ` Toyota Dealership. He introduced Jack Carter owner of the dealership for gave a,brief background on the growth of his business. . Mr. Carter stated that there is a need'to clean and,wash vehicles that are serviced,as well as stock vehicles that are for retail sales. That is the intent of thecar wash as this is now considered standard in the automobile business. .He noted that it would be a state of the'art facility and there has been no . ' issued raised at site plan review for its,connection to Town sewers. The proposed auto showroom is to be used for luxury vehicles. He stated that his inventory of those cars is high an'd.shoppers for those vehicles expect a separate.in door showroom. Project Engineer, Daniel A. Ojala presented the proposed site development plan, noting that the.plan conforms to all site.plan review standards and has also been reviewed by the Growth Management Department. He also noted that plan is engineered using best practices that are especially beneficial as it is in a Groundwater Protection Overlay District. He noted the car wash and showroom will be serviced by public sewers. Attorney Wall addressed the zoning requirements for the granting of the special permit concluding that the applicant has met those standards. Public comment was requested and n•o.one spoke in favor or in opposition to the request. Findings of Fact: _ At the hearing of December 9;2009, the Board unanimously made the following findings of fact:.; 1. Appeal 2009-070 is that of Hyannis Enterprises, Inc., d/b/a Hyannis Toyota seeking a petition for a Special Permit pursuant to Section 240-25.C (1) Conditional Uses in the Highway-Business District. The petitioners.eeks the permit for the development and use of the lot with a 3,500 sq.ft. auto showroom-for retail sales of automobiles and a .1,200 sq.ft. car wash. The use of the property is to be in conjunction with'and accessory to the abutting Hyannis Toyota automobile dealership. The subject property is addressed as 1056'lyannough Road, Hyannis and is in the HB, Highway Business and Business B Zoning Districts.. + 2. The application falls within the category specifically excepted by Section 240-25.C.(1)for a Conditional Use Special Permit in the Highway Business District. A site plan has been reviewed and found approvable in accordance with Site Plan Review provisions of the Ordinance and is subject only to the issuance of a special permit. It is issued to allow the lot to be development with a 3,500 sq.ft. showroom for retail sales of automobiles and a 1,200 sq.ft., car wash as well as the parking of vehicles that are for sale or to be serviced: All uses and buildings on the 1056 lyannough Road lot are to be accessory to Hyannis Toyota's retail sales and service of vehicles on the 1040 and 1020 lyannough Road lots. 2.
