was found to be approvable subject to the following;

landscaping of area within the road layout of Route 132; Sheet C-3 Proposed Bottle Storage
Expansion - Grading Plan dated September 22, 2010 prepared by Vanasse Hangen Brustlin,
Inc. (VHB), Watertown, MA:
• Special Permits will.need to be granted by the Zoning Board of Appeals for the expansion of a
non-conforming structure=and use:
• After construction, a certified plan confirming exterior total square footage of the entire building
must be filed to ensure that the requisite 7,500 s.f. sprinkler threshold has not been exceeded.
• Additional square footage is to be used for storage and recycling only. Retail floor space may
not be increased.
• Applicant must obtain all other"applicable permits, licenses'and approvals required.
Upon completion of all work, a registered engineer or land surveyor shall submit a letter of certification,
made upon knowledge and belief in accordance with professional standards that all work has.been
done in substantial compliance with the,approved site plan.(Zoning Section.240-104 (G). This
document shall be submitted prior to the issuance of the final-certificate of occupancy.

Dear Mr. and Mrs. Owen:
We recently received an inquiry concerning locating an automobile washing
and automobile cleaning establishment in your building complex which was
approved only for offices and dry goods stores.
You are again officially notified that Condition 2 of the .variance granted you
by the Board of Health in it's approval with conditions letter dated July 17,
1986, specifically states that "there can.be no deviations from the proposed
use as noted on the plan." The proposed use noted on the plan specifically states
office buildings and dry goods stores.
A facility such as a car washing establishment also contradicts the letter from
Robert Verkade of Tibbetts Engineering Corporation to the Board dated June
25, 1986, that states the building if approved would contain one story office
buildings and dry goods stores.
You. are directed not to allow the occupancy of this building until all proposed
businesses are approved by the Board.
The Board acted in good faith in granting you .a variance and approving your
building permit and onsite sewage disposal system for your proposed office. :
buildings and dry goods stores in this critical zone of contribution to a public
water supply well and is distressed over your apparent intent to deviate from
your original proposal.

Dear Mr. Verkade:
You are granted a variance from the Board of Health Regulation requiring all commercial
buildings to connect to public sewer if they are within 3000 feet. The location of the
property granted the variance is 1166 Iyanough Road, Barnstable, (Assessor's Map No. 274,
Parcel 9).
The following conditions must be met or the variance is invalid:
(1) The designing engineer must be on site and supervise construction of the septic system
and certify in writing to the Board of Health that his design has been strictly adhered
to prior to the issuance of a Certificate of Compliance.
(2) There can be no deviations f rom the proposed use as noted on the plan.
(3) Gasoline and oil separators must be installed in all catch basins and a written
maintenance contract with a licensed hazardous waste firm furnished the Board prior
to issuance of a Certificate of Compliance and Occupancy.
(4) You must connect to Town sewer when the Board determines its availability.
This variance expires August 1, 1987.
This variance is granted because the Department of Public Works will not allow a sewer
connection to this property.
In addition, this 2.97 acre property would generate 950 gallons of sewage daily using Title 5
flow estimates - 30 gallons under the 980 gallons allowed using the 330 gallon, per acre,
Board of Health regulation.
