Dear Commissioner Perry,
On evening of Saturday, January 4, 2003 The Hyannis Fire Department responded
to the above address for a fire in the abandoned building located on site. The fire, which
we believe was set by a person illegally living in the building; caused the injury of one
civilian, one Police Officer, and four Firefighters. Firefighters had to rescue the civilian
from the building. In addition to the hazards mentioned below, Firefighters were exposed to
explosions from propane cylinders brought in to provide heat for cooking. Route 132 was
closed for approximately 2 hours while we fought this 2nd alarm fire.
This is not the first fire or problem that we have responded to on this site. We have
been called for brush and trash fires, a large trash fire in August of 2000 extended into the
building, and to rescue a person trapped in the building.
Due to trash dumping and efforts to secure the site, access is difficult. The building,
and the site, present numerous safety hazards to emergency personnel, a short list of which
includes;
- Structural damage in many locations.
- Limited access in and limited egress out of the building for Firefighters.
- Openings in the floor, and walls creating a fall hazard.
- Health hazards from people living in the building without proper facilities.
- Large quantities of debris, jagged metal, glass etc.
- An open well pit on site.
- An abandoned camper is on site along With an abandoned 42' trailer filled
with tires and mattresses.
Our records indicate'that the property stopped being used some time before July of
1992. The building was then briefly reactivated and used for storage from July to December
of 1992. Since December of 1992 the building has been abandoned / not in use.
The front of the site has become a parking area for tractor trailers, further limiting or
restricting our access, one was on site during this last fire.
I ,
The property owners have made ongoing efforts to clear and secure the site. This
morning they were, once again, on site cleaning and securing. Until they are allowed to
remove the building from the site this will continue to be an ongoing problem.
It is our opinion that this property presents an imminent danger to the life and limb
of those who trespass on the property and the emergency workers who will be called to the
property. The structure has not been used for an extended period of time, and could not be
occupied in its present state. Given the length of time the property has been abandoned /
not used there is no known zoning benefits to keeping the building. Finally present plans
of the owners call for the demolition of this structure and an adjacent abandoned structure
(1200 Iyanough Road, formerly Shirdan's Restaurant).
We wish to work with your office and the property owners in declaring this property
an especially unsafe structure. We desire to see the structure removed, the site cleaned
and made safe, and then secured appropriately to prevent further dumping. If there are no
plans for the reuse of the existing structure located at 1200 Iyanough Road we would like
to see this site treated in the same manner.

><•0 SCOPE OF WORD AND SCREDULE
A. Introduction:
The instant plan involves asbestos abatement from the basement of one portion of a
structure located at the above entitled address. The building is vacant and has been
unoccupied for an extended period of time. The structure is in actuality three distinct
buildings. The westerly most building, (that is to say the section of the building closest to
the street)was a car wash. The middle building appears to be a hewer construction, one
level building with no suspect asbestos containing materials. The easterly most building
has a basement and an upper level.
Based upon an asbestos inspection I performed on November 12,2005 it was determined
that there was extensive asbestos contamination in the basement of the rear building. The
source of the asbestos contamination is AC pipe insulation which was apparently
removed or, in some instances,had fallen from pipes within the basement. Some of the
upper portion of the building dm$is fire damaged. Some of the embers from the fire have
fallen through a pre existing hole or hatch located at the cxtreme rear of the building. The
hatch was designed to haul material from the basement to the first floor and vise versa.
The portions of the rear building where work will be performed does not appear to be
structurally compromised as a result of the fire.
The inspection report generated by Al Spectrum Services was forwarded to Andrew
Clooney of Mass DEP. At his request the instant abatement plan is being generated.
The basement is approximately 15' in height and the area of the basement is 100' x 95"
(see diagram). The ceiling is corrugated steel and the walls and floor are smooth
concrete. There are numerous windows/vent holes which lead to the outside of the
building.
B. Abatement and Disposal:
Basement
The scope of work includes the removal and disposal of all asbestos containing and
asbestos contaminated building materials located in the basement. This would include
asbestos containing pipe insulation, asbestos contaminated fiberglass insulation, fire
embers,porous debris located in the basement. There are 2 mechanical rooms and 2
small offices in the basement as well. The rooms are partially constructed of wallboard.
This wallboard is painted and smooth, However, some of the wallboard is damaged. The
asbestos abatement contractor shall render the
damaged portion and encapsulating the remaining wallboard intact by carefully removing the

critical barriers and negative pressure.
The asbestos abatement contractor plans to remove ACM and ACW
in Gaylord Boxes.
C. Execution:
1. Install critical barriers at each window and door opening. The barriers shall be
constructed of a rigid material which will not be compromised by adverse weather
conditions. The barriers shall be sufficiently rigid as to bar public access to the site.
A rigid barrier must be constructed on the 1 st floor,rear most section of the building
so as to bar public access. The entrance to the decon must be lockable and the
secondary entrance must be locked out as well.
2. Post OSHA required danger and keep-out signs.
3. Construct one three-chambered decontamination unit consisting of a clean room,
change room, shower room and dirty room with appropriate air locks, attached to each
work area enclosure. The decon shall be constructed at the top of the SE stairwell.

6. Notify the Department of Environmental Protection(DEP)for eachpre-abatement
inspection.
7. Remove and dispose of all contaminated debris inside the basement to the extent of
no visible asbestos or suspect asbestos remaining.
9. Metal and non-porous materials may be cleaned and removed from the building as
regular construction debris.
10. Following the bulk removal, fine cleaning operations will begin. All surfaces within
the containment shall be HEPA vacuumed and wet wiped_ All removable permeable .items shall be removed and disposed of as asbestos contaminated waste. Stationary
permeable items shall be decontaminated to the fullest extent. These surfaces may be

encapsulated until DEP has inspected the material and found it to be free of suspect

11.An IH shall perform aggressive clearance air sampling after completion of all work in accordance with 453 CMR 6.00.

The ACM within the boxes shall be wetted in accordance with the asbestos
NESHAP (40 CFR part 61) and Mass DEP regulations(310 CMR 7.00., 18.00
and 19.00). This would include:
I. Wetting and Labeling .
A. Mix control devise asbestos waste to form as slurry; adequately wet other
ACM.
B. Discharge no visible emissions to the outside air.
C. After wetting, seal all asbestos containing waste material in leak tight
containers whale wet.
D. Label the boxes in accordance with OSHA compliant"Danger Asbestos" 29
CFR 1910.10010)(2).
E.Affix waste generator label as required by EPA's NESHAR
The Gaylord boxes shall be equipped with double thickness poly bags which are
greater than or equal to 6 mil thickness.
II. Addressing Surface Permeability Issues
Due to the fact that the Gaylord boxes are constructed of a permeable material
(cardboard)and were inside containment,additional measures are required to
eliminate the possibility of releasing emissions outside the containment from the
cardboard surfaces of the boxes. The AC will address this issue by using the
newer,non permeable finish boxes or,polying the containers.
Once the material inside the boxes has been wetted,above,the boxes shall be
securely sealed by tying off the bags inside the boxes and firmly sealing the
cardboard lid with duct tape and spray glue if necessary.Extra care
shall be taken to ensure the box remains leak tight regardless of its position.
D. Waste Holding Area
Due to the fact that the AC will be using Gaylord boxes and there is no cicvator
lift to remove the boxes from the area, it is our plan:to construct a waste holding
facility inside the containment, at the extreme rear of the building. The
dimensions of the facility will be 15 x 20',and it will be 8' in height. The waste
holding facility shall be constructed of 6 mil poly sheeting. 1 additional 2000
CFM HEPA shall service this area. At the conclusion of the proj act tree waste
holding facility shall be visually inspected and air tested,

E: Definitions
IH(Industrial Hygienist):A licensed Project Monitor who has received training
required by Federal and State regulations as an asbestos abatement project supervisor,
The IH has also successfully taken a NIOSH 582 equivalent course for Phase Contrast
Microscopy(PCM) in accordance the NIOSH 7400 Method, "A"rules.
On this project the role of the IH is to:
• Conduct sampling required in 29 CFR 1926, 453 CMR 6 and 40 CFR 763. Use
NIOSH method 7400 for air sample collection and PCM analysis.
• Perform project monitoring activities.
• The 1 H will notify the DEP should any problems arise during the abatement work
• The IH will notify the DEP prior to commencement of the abatement work.
• The IH will notify the DEP at the end of the abatement work.

Recommendations: The front roof contains trace asbestos. In order to categorize the roof as n
on
asbestos containing additional samples would have to be collected which would
need to undergo a more stringent analytical protocol(Point Counting). There is a
good likelihood that a sample would exceed the state and federal limit of 1%. I
suggest that the material be removed as asbestos containing. The disposal'
requirements`are not as stringent on this type of asbestos containing material and
therefore, disposal is less expensive as compared to other materials, The roof
could be removed by a non asbestos licensed contractor provided that OSHA
guidelines, EPA disposal requirements and DOT regulations are followed. Many
owners avoid these issues by simply hiring an asbestos abatement contractor to
remove and dispose of the material.
The remaining asbestos containing materials must be removed by a Mass:
DLWD licensed asbestos abatement contractor.
There is a ten day notification period which must lapse prior to the start of

Section 1.
It shall be unlawful for any person or persons occupying or having
charge of any building, dwelling, structure, premises, shelter, boat or
conveyance or any part thereof in the town, to cause or suffer to allow
any unnecessary, loud, excessive or unusual noises in the operation of
any radio, phonograph or other mechanical or electronic sound making
device or instrument, or reproducing device or instrument, or in the
playing of any band, orchestra, musician or group of musicians, or in

dwelling, structure, premises, shelter, boat or conveyance in which or
from which it is produced. The fact that the noise is plainly audible
at a distance of one hundred fifty (150) feet from the building,
dwelling, structure, premises, shelter, boat or conveyance from which it
originates shall constitute Prima Facie evidence of a violation of this
ordinance.
Section 2.
It shall be unlawful for any person or persons being present in or
about any building, dwelling, structure, premises, shelter, boat or
conveyance or any part thereof, other than that section of any
establishment licensed under Chapter 138 of the General Laws, who, shall
cause or suffer or countenance any loud, unnecessary, excessive or
unusual noises, including any loud, unnecessary, excessive or unusual
noises in the operation of any radio, phonograph, or other mechanical or
electronic sound making device, or instrument or reproducing device or
instrument or in the playing of any band, orchestra, musician or group
of musicians, or the making of loud outcries, exclamations or other loud
or boisterous noises or loud and boisterous singing by any person or
group of persons, or in the use of any device to amplify the aforesaid
noise, where the aforesaid noise is plainly audible at a distance of one
hundred and fifty feet from the building, dwelling, structure, premises,
shelter, boat or conveyance in which or from which it is produced. The
fact that the noise is plainly audible at a distance of one hundred and
fifty feet from the building, dwelling, structure, premises, shelter
boat or conveyance from which it originates shall constitute Prima Facie
evidence of a violation of this ordinance. Any person shall be deemed
in violation of this ordinance, who shall make, or aid, or cause, or
suffer, or countenance, or assist in the making of the aforesaid and
described improper noises, disturbance, breach of the peace, and the
presence of any person or persons in or about the building, dwelling,
structure, premises, shelter, boat or conveyance or any part thereof
during a violation of this ordinance shall constitute Prima Facie
evidence that they are a countenance to such violation.
Section 3.
It shall be unlawful for any person while in control of any motor
vehicle in the Town of Barnstable to cause any unnecessary, loud,

excessive, or unusual noise in the operation of the motor vehicle. The
fact that the noise is plainly audible at a distance of one hundred
fifty (150) feet from the motor vehicle from which it originates shall
constitute Prima Facie evidence of a violation of this ordinance.
Section 4.
The owner of any building, dwelling, structure, premises, shelter,
boat or conveyance which is let, rented or leased shall provide any and
all tenants, lessees and sublessees with a copy of this ordinance.
Section 5.
Any person violating the provisions of this ordinance shall be
punished by a fine not to exceed two hundred ($200.00) dollars for each
offense.

town's Zoning Ordinance requires that 30% of each lot be retained in natural vegetation,
and that 50% of each lot be pervious. (Section 3-5.2, Groundwater Protection Overlay
Districts, paragraphs C and D). Therefore , open space requirements will need to be met
on-site, unless a variance is obtained from the Zoning Board of Appeals. If the decision
is made to provided open space off site, then this open space should be located the
same distance, or closer to the wellhead in terms of time of travel, than the proposed
development.
