My clients Edward McAndrews and Thomas J. Rypkema, Trustees of Iyanough Realty Trust, have engaged us to apply for a variance from the Barnstable Sign Code with the Zoning Board of Appeals, which application we are currently proceeding with. We are working with Fleet Bank to come up with an acceptable sign design which ;could allow the two existing standing signs to be consolidated into one sign approximately 14 feet in height for which a variance shall be sought. My clients are in the process of obtaining proper sign designs and ascertaining the location of the sign on the premises which are necessary to complete the filing with the Zoning Board of Appeals. My clients feel that if allowed by the Zoning Board of Appeals, this petition would result in a positive resolution of this matter. As you are aware, the pending clerk's hearing has been continued until October 2,1997. I request, on behalf of my clients, that the Clerk's hearing date be continued by agreement, for sixty days, to allow time to obtain final designs agreeable to Fleet Bank, and to submit the final design with the Zoning Board of Appeals filing. My clients are also reviewing information to assist them in coordinating the relocation of the existing signs with the pending Eminent Domain Taking for the widening of Iyanough Road. By the time you received this letter, both bays should be vacant and we invite you or your designee to inspect them.. As per your advice, we contacted Lt. Hoobler of the Hyannis Fire Department regarding the possibility of installing a sprinkler system in the building in question. Although, we of the trust, are not certain where the money will come from, we will obtain estimates for a sprinkler system from the companies mentioned by Lt. Hoobler. When prospective tenants are in consideration for occupying bays 1 and 7, we shall inform your office of their business method so that you can assist us with determining if they fall into the "F-1" category. This situation will also be repeated in the future as other bays become vacant. We shall endeavor to learn what it is that we must do so as to enable the church in bay 8 to continue to assemble and we would appreciate it if you could refer us to the appropriate code governing public assembly. We will ask the gentleman that repairs lawnmowers in bay 5 to provide us with a written procedure for the storage and disposal of oil and gasoline.
