Dear Tom:
This correspondence will serve to followup our discussion with you from last week
regarding the above-referenced redevelopment project which is presently pending before the
Cape Cod Commission as a Change of Use/Redevelopment pursuant to Section 4B of the Cape
Cod Commission's Enabling Regulations. As you will recall, this redevelopment project was
also reviewed informally by the Town of Barnstable Site Plan Review Committee on June 8,
2006 as Site Plan Review File No. 031-06.
Over the last several months since filing this redevelopment with the Cape Cod
Commission, we have had numerous meetings with Commission staff and the Town of
Barnstable Growth Management Department regarding all aspects of this redevelopment,
particularly with reference to traffic and community character. In that regard, we have
reached agreement with the Cape Cod Commission and the Growth Management Department
to seek local permitting relief with the building moved closer to Route 132, intruding into the
100 foot set back requirement of the HB Zoning District. This scheme is shown on the site
plans enclosed herewith entitled "Site Alternative".
Accordingly, in addition to the special permit which is required for this project, we will
also be pursuing a variance from the front yard set back requirements. In the event that the
variance is not granted, the project will be constructed in accordance with the other set of site
plans enclosed herewith which show the building complying with the set back requirements.
Accordingly, we are requesting that the Cape Cod Commission approve both plans with an
agreement that we will pursue the "Site Alternative" plans with the Zoning Board of Appeals.
Based upon a recent meeting with Commission staff, we have agreed to notice the
initial Cape Cod Commission public hearing as both a Change of Use application under Section

Impact review. We are still meeting with Commission staff to determine the scope of the
limited review. This will, ultimately, be determined by the Regulatory Committee at the
public hearing.
In order to allow the Commission to notice both the Limited DRI as well as the Change
of Use application, we are writing to request that you please refer the project to the Cape Cod
Commission as a Development of Regional Impact. This redevelopment will be scheduled for
a hearing with the Commission's Regulatory Committee on January 16, 2007. We therefore
request that you refer this project at your earliest convenience. Please do not hesitate to
contact us with any questions or comments regarding this request or should you need any
additional information to process the referral.
Kindly copy us on the referral to the Cape Cod Commission for our files. Thank you

I enclose herewith for your files and review a copy of the Cape Cod Commission .
application notebook, together with plans and supporting materials, which we filed this
morning with the Cape Cod Commission to allow for the redevelopment of the properties
addressed 624 and 640 Iyanough Road (Route 132), Hyannis. As was described at the
Informal Site Plan Review hearing last month, this project consists of the demolition of the
existing Rogers & Gray Insurance building and the Star City Grill, and the redevelopment and
construction of a 23,500 square foot Circuit City, together with additional site improvements,
including, without limitation, the elimination of a curb cut on Route 132, site access
improvements, additional landscaping, and improved stormwater treatment.
Please do not hesitate to contact me with any questions or comments regarding this
filing. We will continue to keep the Town involved in the process while the project is pending
before the Cape Cod Commission.
