As you will recall, I provided to the Site Plan Review Committee a zoning analysis relating to the above project. In that analysis I reviewed the use of the property as a shopping plaza, viewing the collective use of all of the various tenants on the site as one "use." I enclose for your information and review a copy of our correspondence to the Zoning Board of Appeals in which I have set forth on Page 2 a section entitled "Need for Zoning Relief." That section summarizes the arguments which I made to Site Plan Review at the time of the our presentation. I also enclose for your information and review a copy of the Cape Cod Commission decision regarding the change of use associated with the Festival Mall, which I noted at Site Plan as being analogous to the current situation. You will also note in my correspondence to the Zoning Board of Appeals that I have cited the numerous small shopping plazas on Route 28 and West Main Street within which tenants have changed within units, but do not require Zoning Board of Relief as a "change of use." Specifically, the applicant is proposing to utilize the existing,Unit No. 5 (with no change to foot print), as shown on the plan entitled "Site Plan of Land in Hyannis (Barnstable), MA prepared for John Araujo/Rainbow Trading" prepared by Down Cape Engineering, Inc. which was revised on May 22, 2002, a copy of which is attached hereto as Exhibit "A". The applicant received Site Plan Review approval for the proposed change of use on May 30, 2002. Background Unit 5 is part of the shopping plaza located at 55 Iyanough Road, Hyannis, which plaza is shown on Assessors' Map 343, as Parcels 5, 20, 8, and 4. The property is located within the Highway Business (HB) Zoning District as well as within the Wellhead Protection Groundwater Overlay District. The shopping plaza contains retail and service uses, including a florist, hair salon and bakery. The plaza is owned by the D'Olympio Realty Trust, which has agreed to leased Unit 5 to the applicant. Since its construction, the shopping plaza has contained a variety of mixed uses. In approximately 1959, a sheet metal business was located on the locus. In approximately 1975, the uses present at the locus included a butcher shop and convenience store and retail. In 1985, the D'Olympio Realty Trust purchased the plaza, which had a mixture of retail and service uses, which at that time contained a take out deli, bakery, restaurant for approximately 150 to 160 seats, a catering business and market which sold dry goods. Most recently, Unit No. 5 from 1999 to 2001, was occupied by Bagel Port Restaurant, which use included a sit down restaurant and take-out bakery and deli. Need for Zoning Relief At its presentation to Site Plan Review on May 30, 2002, the applicant presented a zoning analysis which supports the proposition that the use of Unit No. 5 within the shopping plaza for the use proposed by the applicant does not represent a "change of use" or "intensification of use" which would require zoning relief from the Zoning Board of Appeals. In point of fact, since 1975 the "use" occurring on the property has been a shopping plaza consisting of multiple retail, service, business, restaurant and food service activities. That "use" will not be changing by the applicant's tenancy. It is currently a "shopping plaza" and will continue to be a "shopping plaza." Such use of the property is pre-existing, non- conforming as it relates to application of the special permit standards of the Highway Business Zone adopted in 1983 and 1985 by Barnstable Town Meeting. Numerous analogous examples of shopping plazas that exist as pre-existing, non-conforming uses within the Highway Business District can be cited where.individual tenants within existing space change from one "shopping plaza use" to another "shopping plaza use." One example would be the change of use of pharmacy space to restaurant space within the Festival Mall in Hyannis which is currently occupied by Old Country Buffet. There have been numerous changes of tenants within the Airport Shopping Plaza and small shopping plazas on West Main Street and Route 28. So long as the new tenant does not result in a "intensification of use" as defined under Section 7 of the Barnstable Zoning Ordinances or result in a change of foot print to the premises, such a change of tenant does not result in a "change of use." Under the definition section of the Zoning Ordinances, "intensification of use" is determined by whether or not a particular activity will result in an increased parking demand. In this particular case,the proposed tenant within Unit No. 5 of the shopping plaza will require less parking spaces. Further, the proposed tenant will not be changing, in any manner, the foot print or exterior walls of the structure and will not be conducting any activities or uses which have not been previously conducted on the premises during its non-conforming status. Based on the foregoing, the applicant would argue that no zoning relief is required and that the Zoning Board may make a determination that the proposed conversion from a Zoning Board of Appeals June 5, 2002 ` Page 3 restaurant/deli/bakery to retail market including groceries, butcher shop and bakery as proposed by the applicant does not require zoning relief and may properly be conducted. In the alternative, the applicant has sought a special permit for conditional use under Section 3-3.6 and/or pursuant to Section 4-4.5 as a change of a non-conforming use to another non-conforming use. Section 3-3.6(3) Conditional Use The proposed use is conditional in the HB district pursuant to Section 3-3.6(3) of the Zoning Ordinances in that it is permitted within the Business Zoning District. The applicant respectfully submits that special permit relief is appropriate under that section in that the proposed use will not adversely affect the public health, safety, welfare, comfort or convenience of the community. In fact, the proposed use will be less intense as compared to what was previously existing within Unit 5. The proposed new use will require less parking spaces than were necessary to service the previously existing restaurant. In addition, the applicant will be improving the drainage system on site, as well as enclosing the existing dumpsters with six foot stockade enclosures. It is further anticipated that the proposed new use will generate less traffic.than the pre-existing restaurant/deli/bakery. Further, the proposed new use will result in a reduction of water usage as compared to the previously existing restaurant use. In that respect, the applicant submits that the proposed change of use will actually benefit the public health, safety, welfare and comfort of the community which includes adjacent residences, and that special permit relief should be granted in accordance with the Zoning Ordinances. Section 4-4.5 Change of a Non-Conforming Use to Another Non-Conforming Use In the alternative, the applicant has also applied for special permit relief pursuant to Section 4-4.5 of the Zoning Ordinances. As previously described herein, the.subject shopping plaza has contained a variety of pre-existing, non-conforming uses dating back to as early as 1959. The requirement for special permit for uses within the Highway Business District was adopted in 1983 by Article B-1(a). Therefore, the prior uses existing on the site, as previously described herein, predated this zoning amendment. Section 4-4.5(1) allows a pre-existing, non-conforming use to be changed to another non-conforming use by special permit provided that the "proposed non-conforming use is no more detrimental to the neighborhood" and further provided that the various criteria as set forth in Subparagraphs (A) and (B) of that section are satisfied. The applicant respectfully submits that the proposed change of use meets all of the criteria as set forth in Section 4-4.5(l)(A) and (B). Specifically, the applicant has received Site . . In addition, it is anticipated that the proposed new use will generate less traffic than the previous use as well as require less parking. The proposed new use will not result in an increase in on or off site noise, dust and odors, and in fact, the applicant will be enclosing the existing dumpsters, as well as installing a new drainage system, which should decrease noxious odors as well as improve storm water runoff to the property generally. The proposed new use will not result in an increase in the number of tenants within the existing shopping plaza nor will the proposed new use result in an increase in foot print. The applicant proposes to maintain business hours of approximately 7:30am to 10pm, which are similar and consistent with normal restaurant operation hours. The proposed new use will be located entirely within the existing Unit 5 of the plaza, and as such, will not be expanded beyond the zoning district. The applicant respectfully requests that the Board grant the special permit relief requested under Section 3-3.6, or in the alternative, under Section 4-4.5. The proposed new use will be less intense than what was previously existing, and taken together with the site improvements proposed by the applicant, the change of use will not adversely affect the public health, safety, welfare, comfort or, convenience to the community. We have also conducted trip generation analyses for the previous use at the site, which was a 150-seat sit down restaurant. The results of those analyses are summarized below. Project Description w The proposed project consists of the reuse of 5,600 square foot space at an existing shopping plaza at 55 Iyannough Road (Route 28) in Hyannis, Massachusetts. The proposed use is a specialty Brazilian grocery market with a bakery and butcher shop. Trip Generation Trip Generation analysis of the proposed Brazilian market was conducted to determine how many trips the proposed use will generate on daily basis and in the afternoon peak hour as compared to the`previous use (a 150-seat sit down restaurant). The trip generation comparison is presented in Table I,. As shown in Table 1, the proposed use will generate approximately 230 trips on a daily basis and approximately 28 trips in the afternoon peak hour. The previous use generated approximately 775 vehicle trips on a daily basis and approximately 67 trips in the afternoon peak hour. Therefore, the proposed Brazilian market will generate approximately 545 less daily trips and approximately 39 less trips in the afternoon peak hour than the previous use. Additionally, the expected trip generation of the proposed market represents a 70 percent reduction in daily trips and a 60 percent reduction in afternoon peak hour trips as compared to the previous use.
