Answer: You are correct on the items that you have noted. MA has modified the checklist in several important ways. The MA version allows a roof with a pitch up to and including 8 in 12 to not be "counted" as a story. Further, if the building will have furring strips installed in the ceiling abutting the gable wall then 2 x 4s installed on top of the ceiling joists are not required. The question of what setback is applicable is therefor at issue when location and construction of the proposed garage is examined. I have enclosed a copy of Section 4-4.5 - Non-conforming Lots, taken from the Zoning Bylaws for the Town of Barnstable. I have underlined the particularly relevant portion of the section in red. In short, if certain conditions are met, Section 4-4.5 means that you can build along the original setback lines contained in the earlier version of the bylaw despite more restrictive setback requirements that may have been enacted in more recent versions of the bylaw if the tests set forth in sub-sections 1, 2, and 3 are met. If those tests are met, then sub-section 4 allows the construction to proceed adhering to the earlier version of the bylaw setback requirements. You will need to review this section as well as the plan and show the building inspector a copy of �,th'e deed which is also enclosed. The building inspector will then make note of the date of endorsement by the Planning Board on the plan and that date as you can see is January 4, 1951. The building inspector should also have a copy of the building permit for that lot so that when he compares the date of construction with the date of any changes in the bylaw changing the sideline setbacks, he can determine whether either sub-section 1 or 2 was complied with. It may be that the building inspector will need a little bit more information from the Registry of Deeds to determine I c. Mr. Sheehy -2- September 28, 1992 when separate ownership was created in lot 29 as distinct from either lots 27, 28 or 31, those being lots that under sub-section 2 might well have to have been combined with lot 29 for zoning purposes within five (5) years of a change in zoning. I own the contiguous property. A few years ago, I received a notice that Mr. Sheehy was applying for a variance to build a "garage" on his property closer to my property line than permitted by the Town' s Zoning By-Laws. I did not contest the variance because I assume a garage was a one-story low building. Mr. Sheehy built at least a two-story building which contains a bathroom and bedrooms. I went to the Town Hall in July, 1996 and spoke to the Zoning Administrator, Ms. Urenas. She was not very helpful so I asked her for the file on Mr. Sheehy' s property. Ms. Urenas said the file was missing. I completed an inquiry form at that time because I wanted to know what was approved and what the legal notice contained. Later in 1996, I called Ms. Urenas and she told me that she had not investigated the inquiry and terminated the conversation. Because I did not receive any information from my inquiry, I went back to the zoning office on April 23, 1997 and again asked for the file on Mr. Sheehy' s property. The file was somehow still not available so I filed a complaint and Ms. Urenas told me to call back in a week. When I called back, Ms. Urenas told me that the. engineers were going to measure the property and ended the conversation and told me not to call back. Although my attorney has told me that a variance is not legally appropriate to solve a setback problem for a second A Page 2 Robert D. I am contesting (i) that the building which was erected does not comply with the notice of variance and (ii) the building cannot be used as living quarters. I am concerned that the zoning administrator is not investigating this issue. I am appealing to you to investigate this matter. Please inform me if you will look into this matter and provide me with accurate information, or do I have to seek other means to see Mr. Sheehy' s file and determine if there has been an "oversight" in this matter.
