After registration with the Building Inspector,a customary home occupation shall be permitted as of right subject to the following conditions: • The activity is carried on by the permanent resident of a single family residential dwelling unit;located within that dwelling unit • Such use occupies no more than 400 square feet of space. • There are no external alterations to the dwelling which are not customary in residential buildings,and there is no outside evidence of such use. No traffic will be generated in excess of normal residential volumes. • The use does not involve the production of offensive noise,vibration,smoke,dust or other particular matter, odors,electrical disturbance,heat,glare,humidity or other objectionable effects. • There is no storage or use of toxic or hazardous materials,or flammable or explosive materials,in excess of normal household quantities. • Any need for parking generated by such use shall be met on the same lot containing the Customary Home Occupation,and not within the required front yard. • There is no exterior storage or display of materials or equipment • There are no commercial vehicles related to the Customary Home Occupation,other than.one van or one pickup truck not to exceed one ton capacity,and one trailer not to exceed 20 feet in length and not to exceed 4 tires,parked on the same lot containing the Customary Home Occupation. • No sign shall be displayed indicating the Customary Home Occupation , • If the Customary Home Occupation is listed or advertised as a business,the street address shall not be included. Applicant: Date: 0�— ��` Z 0 l :57 C� � DATE Feb 2,2011 TO Building File FROM R Anderson RE 99 Linden Street,Hyannis Richard Burnham, Gas Inspector transferred a call to me regarding 99 Linden Street. Apparently, Mr. Horan, a plumber from off-Cape replaced a gas furnace and submitted a permit application after the fact. That application was returned to him as records contained in our property file indicate an that Paul Roma issued an exit order for a basement bedroom created without permits and lacking proper egress. I explained to Mr. Horan that to rectify this situation a building permit is necessary to undo the exit order either by installing egress or removing the bedroom. A permit would trigger inspections and a satisfactory inspection would close out the exit order; allowing for future permitting without restriction. Mr. Horan asked about fees. I said a nominal expense is involved approximately$50.00. I stated this is our process. I apologized that he got caught in the middle but this is our process and it's our only leverage to insure the matter is addresses. He replied that he understood and knew what he needed to do. Mr. Horan called again. He said he had just spoken on the phone with the realtor and he wanted to know who could waive the permit fee. I replied only the town council could do that,that we can't even waive fees for the town. . He wanted to know the town council was so he could speak to him. I explained that this would be a public meeting and didn't see that happening. Mr. Horan then informed me the realtor said the exit order was issued 2 owners ago and we (the town) should have taken action to make sure the issue was resolved back then and we can't hold a new owner responsible. I reminded Mr. Horan that realtors represent buyers and sellers and must also do due diligence. I informed him we don't have the staff to baby sit each and every property;that's why we have this process in place. At this point, Mr. Horan wanted to speak to the building inspector in charge. I gave him the main number and advised him that the BC is in court all week.
