The applicant submitted a sketch plan illustrating the proposed sign location.The applicant received a Certificate of Appropriateness for the proposed sign from'the Hyannis Main Street Waterfront Historic District on July 17, 2019. Procedural&Hearing Summary The application for Special Permit Application No. 2019-05 was filed at the Town Clerk's office and the office of the Planning Board on July 3, 2019. A public hearing for Special Permit 2019-05 before the Planning Board was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The public hearing for Special Permit Application No. 2019-05 was opened on July 22,2019. The applicant, Michael Lyons, presented a brief history of the property and gave an overview of the proposal and Special Permit relief requested through application 2019-05.The Board Chair requested public comment and no one spoke. Following the close of the public hearing, the Planning Board approved Special Permit Application 2019-05 at the July 22 hearing subject to conditions. Board Members deciding this application were Steven Costello, Jeffrey Swartz, Patrick Foran, Mary Barry, Walter Watson, and Stephen Robichaud. Findings of Fact At the hearing on July 22, 2019,the Board unanimously made the following findings of fact for Special Permit Application No. 2019-05, a request for a special permit,filed by Michael Lyons of Mass Cone Fusion, Inc. The application falls within a category specifically excepted in the ordinance for the grant of a Special Permit.The applicant seeks a Special Permit under Section 240-71.E(3) to allow a location hardship sign in the Hyannis Village Business District. 2. That after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected, 3. Site plan approval is not required for Location Hardship Signs. The Building Commissioner must approve a sketch plan displaying the proposed sign location prior to issuance of a building per 4. The issuance of this Special Permit is consistent with the Downtown Hyannis Design and Infrastructure Plan. 5. The proposal maintains pedestrian access along the Main Street sidewalk pursuant to 240- 24.1.2.E(1)-Special Permit criteria in the Hyannis Village Zoning Districts. Decision Based on the findings of fact, a motion was duly made and seconded to grant Special Permit No. 2019-05 subject to the following conditions: 1. DBA Ben &Jerry's to allow for display of one Location Hardship Sign,to be located as shown on the sketch plan in the special permit application submitted July 3, 2019 or as further modified by the Building Commissioner. Location Hardship Sign Special Permit Application-Revised 2018 To Whom it May Concern, We at Ben &Jerry's are requesting a permit for a Hardship Location sign in front of our address at 352 Main Street. The sign will be an A-Frame design, with a dark wooden frame and black chalkboard face. The sign also features a small header on either side displaying a Ben & Jerry's logo, as seen in the attached photos. Dimensions for the sign will be 20" x 40". We believe that our request for a hardship location approval is justified given the changing landscape of Hyannis Main Street. In recent years, tree growth, awning additions,-and outdoor dining additions have--while improving the aesthetic of Main Street as a whole-- obstructed our business's sightlines and diminished the level of foot traffic to our store. Our blade sign is now completely blocked to customers from the east side (as shown in photos), including those entering from the North Street lot. From the west, we are blocked by some tree branches and by storefront awnings. Our use of an A-frame was our only way to counteract the above obstructions. Our view is that with all the upgrades on the street, that some flexibility in regards to temporary signs may be granted. Thank you for your time and consideration.
