Other restaurant owners resent his actions and the town's lack of enforcement. Several years ago, we at the Hyannis Main Street Waterfront Historic District Commission anticipated outdoor dining when the ban on indoor smoking was passed. We surveyed available patio furniture to select acceptable steel furniture to enhance the appearance of Main Street and to protect the town from lawsuits by patrons that might have a poor quality plastic or wood chair collapse from beneath them onto the town sidewalk. Although the cost of steel furniture varies widely from as little as $35 to$150 per chair,the strength.of the chair is not compromised by age or weather exposurq. The appearance of rust is the first and most obvious indicator of wear and deterioration. Plastic chairs, however, are not of consistent strength from the beginning and may not be strong enough to support an overweight man or woman. Plastic furniture manufacturers are required to post a label warning of the capacity of the chairs. As the style and construction of chairs may appear to be similar and substantial when, in fact, they are not, the label is the only proof of capacity. I am not a large man in my view; however, I am listed as too heavy for some of the furniture sold. Wood furniture has its own problems with adhesive failure and fastenings loosening and failing with little warning after weather exposure. You have the power to enforce compliance by denying permitting for outdoor dining for the year (or any portion thereof.).. I know the legal department is easily bullied by threat of lawsuit but this merchant's obnoxious behavior has gone on long enough. It is time to act before this restaurateur's reckless actions provide the town with a real lawsuit to defend. Sincerely yours, ' George Jess , 'r. I gave him a copy of the regulations. 2) 7/28/03 I received a written complaint from Kevin Buckley, who could not get through the chairs and menu sign in his wheelchair. 3) 7/30/031 issued a written warning to owner Michael Macheras of Schooner's Restaurant for plant pots and menu boards in the sidewalk passage way. 4) 5/11/041 went to Schooners Restaurant on a complaint of a blocked sidewalk. I took pictures of the menu board and tables in the sidewalk passage way. I spoke to an employee about the problem. Also in attendance: Michael Macheras, Attorney Mike Ford, Roy Catignani, This meeting was called to order at 9:05 AM and adjourned at 10:55 AM SPR 081-01 Schooners Restaurant,372 Main Street, Hy (327-002) Michael Macheras appeared before the panel seeking approval to establish a new restaurant use in the former Subway Shop on Main Street. This proposal includes 95 seats. The former Subway provided twenty seats without table service. Mr. Macheras indicated that he obtained permits for interior renovations. The applicant must rely on the North and South Streets municipal lots for parking and whatever is available on Main Street. It was noted that the square footage was not included on the submittal q g . The applicant was asked to provide a list of uses and corresponding hours of operation. The applicant indicated that there are 276 spaces in the rear lot and 38 out front for a total of 314. The Commissioner amended the meeting status to informal due to the lack of information and detail available for the panel. Health requested the applicant to identify the location of the dumpster and grease trap on a revised site plan. Engineering offered no comments. Planning remarked that the applicant indicated a seating capacity of 95. He requested a seating plan showing the layout. He also requested to know how many employees are anticipated. Mr. Macheras replied that he would start with six employees. Mr. Bill focused on parking explaining that there does not appear to adequate parking. Discussion included Alberto's (Restaurant). It was noted that Alberto's obtained zoning relief in the form of a special permit to reduce their parking provision. Dialogue included the use of public property for private enterprise. It was recommended that the applicant obtain permission from the Town Manager for this use. The idea, Mr. Bill explained is to catch parking spaces being used for each business and keep a record. SPR Notes of 10/25/01 The applicant was asked if he checked the assessor's records (to identify the surrounding uses and parking needs). Mr. Macheras responded that he had not. Discussion included advising the applicant to identify all areas by use in order to calculate the actual parking needs. Mr. Bill reiterated that the applicant must seek approval for reduction of parking from the ZBA. Signage and building separation were also briefly discussed. The applicant must file with the local historic commission. The Fire Department stated that access is not a problem but indicated that the capacity of 95 seats and six employees would exceed 100. Building and Fire code issues are triggered in access of 100. The applicant was advised to work this out with the Building Commissioner. The applicant was requested to proivide a revised, scaled plan,the total number of employees and floor plans reflecting dimensions were requested. A copy of an agreement with the Town Manager enabling the applicant to rely on the municipal lots shall also be provided. Mr. Bill also informed the applicant to show the roof drainage on the plan. The Building Commissioner inquired about outside dining. The applicant indicated that they are interested in exploring this and perhaps receiving approval now. Lt. Eric Hubler of the Hyannis Fire Dept. remarked that outside smoking creates a need to corral patrons. The Fire Department needs to be aware of this location. Conclusion: Continued. SPR 082-01 Dunkin Donuts, 627 Main St., Hyannis (R308-131-001) Roy Catignani appeared before the panel seeking approval to construct an addition to the Dunkin Donuts on Main Street. The net increase is 199' square feet. This application is currently pending before the local Historic committee. Currently, there are sixteen seats inside including a handicap accessible table and stools. This site is primarily used for walk-in coffee service. The new spaces are proposed to allow for the relocation of new paper boxes. The second story office is proposed to be converted to a residential apartment deeded with parking restrictions. It was noted that a bike rack is provided. Parking was discussed. The applicant recognized that they have deficient parking for the existing needs. It was also noted that they have attempted to address handicap accessibility. 2 SPR Notes of 11/1/01 by all. The Building Commissioner asked if there were any bounds in the ground. All parties agreed that there were none. The Commissioner thanked Mr. Cole for bringing his concern forward. Health advised the applicant to connect to the town sewer or obtain a variance from the Board of Health. Discussion ensued about a calculation error. Mr. Crossen promised to rectify it and submit a corrected calculation. The Building Commissioner advised the applicant that the primary concern first and foremost is the status of the `ancient way'. He admonished Mr. Crossen to provide documentation demonstrating his rights to this parcel and its access. Ultimately, the Commissioner concluded that a continuance would be in the best interest of the applicant in order to afford him an opportunity to submit the requested information. Mr. Crossen argued, "...Access is not debated here—maybe at the ZBA". The Commissioner replied, "We must determine if this plan is approvable. There are too many questions to continue". After some debate Mr. Crossen was advised of his right to appeal the pending denial with the Zoning Board of Appeals. At this time Town Attorney Bob Smith entered the hearing room and was called upon for his expertise. Discussion ensued during which Mr. Smith ruled the matter of ancient ways to be too convoluted to be resolved on this date. The Commissioner again advised the applicant to demonstrate adequate access in accordance with local requirements and the right to provide such access. Mr. Crossen retorted that this "determination is unrelated to the building permit". The Commissioner warned the applicant that if pushed to render a decision immediately he would be forced to deny the application. Conclusion: Denied. SPR 082-01 Schooner's Restaurant,372 Main St.,Hyannis (R327-002) Continued from Oct. 25th. The applicant seeks to establish a full service restaurant in the former Subway location on Main Street and directly across form the village green. The storefront is currently vacant. The parking issue is the primary concern. Ralph Crossen, representing the applicant indicated that parking is available in the municipal lots, which are located in the same zone within 300' as required for consideration. 2 f ` a SPR Notes of 11/1/01 Discussion ensued regarding the available number of spaces. The applicant protested that there would be some day use but more of an evening use when the parking demands are less intense. The Commissioner interrupted to ask the applicant how the pending proposed zoning change would affect this application. Mr. Crossen replied that the parking needs shall be "released" in the downtown area. The other issues, Ralph Crossen declared are the grease trap and drainage. There are common downspouts. At this time,pictures were circulated for the benefit of the panel. "The downspouts", he continued"go into a drywell and the others go into the parking lot. The owner agrees to install gutters tied into catch basins located by the grease trap". After some discussion, it was agreed that the dumpster unit shall be fenced in,placed on a pad and have a gate for easy access. Lt. Hubler advised that although there is no set requirement they recommend"the further away,the better". Engineering addressed the roof drainage. Mr. Doherty advised that one spout(next to George's Cafe) dumps on to the ground. He recommended that at the time the fence is installed, this would also be an ideal time to install a drywell. It was noted that under 4- 7.6 it is appropriate to ask for a drywell. The Building Commissioner advised that the major issues are the occupancy load,the number of employees, basement area and outside dining. Ralph Crossen remarked that owner delivered a layout for the first floor and basement. The Commissioner replied that although the plans were received the areas were not labels and no dimensional information was included. Discussion ensued again regarding the parking issue and a letter of reply from the Town Manager. Doug Bill remarked that the letter appeared to advise the applicant to seek a special permit for a reduction of parking. Peter DiMatteo and Eric Hubler reviewed the layout for occupancy load. It was determined that the total number of seats is limited to 47 and 6 staff members for a complete occupancy load of 53. Eric Hubler interjected that comments are in response to the analysis on the plan resulting in a difference of 10 spaces. " If the Board finds there is adequate parking for 53, we'll do that", he stated. The applicant remarked that the ten spaces are "a wash". Health commented that they want to know the exact square footage.
