She believes the sign is necessary, as her business is effectively blocked by the outdoor dining operation of her neighbor.She&rsquo;s also complained about inconsistent enforcement up and down the street. Businesses make case to change prohibition A-frame signs in front of a business can tell passersby that it is open for business,what the day&rsquo;s specials are and otherwise provide another way to let the world know the business exists. The problem is that in the Town of Barnstable,all such signs are illegal. On April 12,the planning board sought the input of businesses to determine what, if any, changes could be made to the sign code to accommodate businesses that believe A-frame signs in front of their operation are an integral part of their business. Last fall,the planning board set the issue aside as something of an intractable problem.Among the difficulties are the wildly uneven property bounds up and down the street. Such signs cannot be placed on town property, but the town does not own all of the sidewalk area in all places. The easiest remedy for fairness and enforcement was to prohibit the signs. The concern on the town side is that once commercial signs are allowed on town property, even if just a sidewalk,then all town property is vulnerable to such use. Planning board chair Felicia Penn told the business owners at the April 12 meeting that the board is taking as much input as possible as it looks at the issue again. Amanda Converse wears three distinct hats in the sign discussion.She&rsquo;s a business owner,operating Shift Boutique in the West End, she chairs the Barnstable Economic Development Commission and she serves as resource development director for the Hyannis Main Street Business improvement district.With all three hats, she sees the need for such signs to be accommodated for Main Street in particular. Converse said that the origin of the ban on A-frame signs came from a fear of proliferation along Route 132 as the number of commercial malls along Route 132 grew, not from Main Street or village commercial centers. &Idquo;We all have the same goal,but we all just have to sit down at the table and figure things out,&rdquo;Converse said in an April 14 interview. At the planning board meeting,Converse pointed to the challenges faced by downtown businesses in getting noticed, including different facade setbacks,the street&rsquo;s one-way traffic flow and an unintended consequence of outdoor dining,which can block the visibility of neighboring businesses. That proved to be the case with Red Fish, Blue Fish. http://www,barnstablepatfiot.com/home2 Powered by Joomlal Generated:22 April,2010,08:36 1 y The Barnstable Patriot Owner Jane Walsh said her sidewalk sign became a necessity five years ago when her neighbor installed a canopy and introduced outside dining,all of which serves to block her business from those driving down Main Street. &Idquo;lt was a necessity,&rdquo;Walsh said in an interview at her store April 14.Without it, she said that customers had a difficult time finding her, even asking if she&rsquo;d gone out of.business or moved. Two days earlier,Walsh told the planning board that she&rsquo;s been cited by the zoning enforcement officer for an illegal sign. She said that she&rsquo;s seen other businesses within her block continue to use similar signs,and continued to put hers out. The woman writing the citations for the town is Robin Giangregorio, Barnstable&rsquo;s zoning enforcement officer. Along with all other zoning-related enforcement, she is in charge of the town&rsquo;s sign code. Last fall, Giangregorio and building commissioner Tom Perry walked Main Street looking at problem signs. She said they started talking with business owners then about a plan to step up enforcement in the spring. Main Street has been under an unofficial moratorium regarding A-frame signs for about three years. The hope was that during the enforcement lapse a workable arrangement could be reached. In that time,the use of A- frame signs increased, but the regulation banning them remains unchanged. All are illegal and subject to enforcement. She said that her first role and approach for any enforcement is education.With signs, her preference is to confiscate them, as it will require someone to come and recover them, allowing for an in-person conversation. The sign code applies to everyone and is town-wide. Giangregorio said that she prefers having to tell people they can't build on a lot, more than telling them they can't have a sign. "It's a very emotional issue,"she said. Last week, Giangregorio collected five signs for the West Barnstable Village Day Spaghetti Supper because they were on town property. &Idquo;We&rsquo;re not unsympathetic, but we don&rsquo;t have discretion,&rdquo; she said,adding that when something is brought to the department&rsquo;s attention, staff needs to respond and enforce the town&rsquo;s regulations. &Idquo;l hope that after hearing from you,A-frames are not off the table any more,&rdquo; planning board member Dave Munsell said at the meeting. Planning board member Paul Curley encouraged the board to move the issue along, as the businesses were approaching their high season.Any suggested change would need to be presented to the town council and require public hearings before both the council and planning board prior to a council vote.There is nothing on the table at this point. Town officers, enforcing the town's sign ordinances for the first time in several years, issued warnings to about 30 town businesses this week, notifying them their signs violate town ordinances. The warnings address a range of"Open"flags, banners, A-frame displays and other signs prohibited under the town codes. But the signs are intended to draw customers and boost sales at a time when business is lagging, several owners and managers said this week. "This is a tough time for all of us, and we can use all the help we can get," said Stephen Baril, manager of Ardeo's Mediterranean Taverna in Hyannis, which removed an "open"flag after receiving a warning on Monday. "We want to be in compliance, but we need something," Baril said yesterday. "This is just ridiculous." Enforcement officers largely looked past the codes in recent years while town officials considered changes to the town regulations—much to the benefit of the business community, according to Deborah Converse, president of the Hyannis Area Chamber of Commerce. "A lot of businesses say they really need (those signs)so people know they're open,"she said. "They can make a big difference." But, after several years of discussion, the issue was put on the back burner when no formal proposals came forward, and town officers were left to enforce the existing regulations, according to Tom Geiler, director of the town's Regulatory Services Department. Department officials notified business owners last year they planned to renew their enforcement efforts, and they issued several warnings last fall, Geiler said. After taking the winter off, officers returned to the street last weekend, noting about 30 violations including illegal flags and banners, oversized displays and flashing neon signs, among others. They sent warning letters this week to first-time offenders, and issued three $100 fines to one business, Gladstone Furniture of Hyannis, which had been warned in the past, Geiler said. Gladstone managers could not be reached yesterday for comment. "(This weekend)was an opportunity to put everybody back on notice," Geiler said. "We don't want to give newer merchants the impression they're legal, let them spend the money and then make them take 'em down. ... We have to be as consistent as we can." While enforcement officers patrol the streets, local business owners, led by the Hyannis Main Street Business Improvement District and the Hyannis Chamber, have brought the issue to the town planning board, and they plan to meet with board members soon to begin discussion of possible changes to the sign ordinances. "We're hopeful we can get something together in short order,"said Felicia Penn, chairwoman of the planning board. Board members would have to approve any proposed changes before they go to the town council for final approval. The maximum height of any freestanding sign will be 10 feet, except that a height of up to 12 feet may be allowed by the Building Commissioner if it is determined that the additional height will be in keeping with the scale of the building and will not detract from the appearance or safety of the area and will not obscure existing signs that conform to these regulations and have a Town permit. Incidental business signs indicating the business, hours of operation, credit cards accepted, business affiliations, "sale" signs and other temporary signs shall be permitted so long as the total area of all such signs does not exceed four square feet and is within the allowable maximum square footage permitted for each business. G. When a business property is located on two or more public ways, the Building Commissioner may allow a second freestanding sign, so long as the total square footage of all signs for a single business does not exceed the provisions of this section. H. When two or more businesses are located on a single lot, only one freestanding sign shall be allowed for that lot, except as provided in this section, in addition to one wall or awning sign for each business. The applicant received a Certificate of Appropriateness for the proposed sign from the Hyannis Main Street Waterfront Historic District Commission on July 13, 2010. Procedural and Hearing Summary: The special permit application was filed with the Town Clerk's office on July 22, 2010. A public hearing was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The public hearing was opened on August 9, 2010 and continued to August 23, 2010. On August 23`d, the Planning Board voted to close the public hearing and to grant Special Permit 2010-04 to Jane Walsh d/b/a Red Fish Blue Fish Studio for display of one location hardship sign on the public sidewalk leading to the primary business entrance, subject to findings and conditions stated herein. }" Planning Board members Raymond Lang, Matthew Teague, David Munsell, Felicia Penn, Paul Curley, and Patrick Princi voted unanimously to grant the permit with conditions. Ms.Jane Walsh, owner of Red Fish Blue Fish Studio, was present to represent herself before the Board. Ms. Walsh stated there are two substantial obstructions to her existing signage: an awning and outdoor dininginstalled b the adjacent business. That after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected, 3. Site plan approval is not required for Location Hardship Signs. The Building Commissioner,has approved a sketch plan displaying the proposed sign location. 4. A permitted sign is not visible due to substantial obstruction(s) outside the control or ownership of the business owner,including, but not limited to, other signs, awnings, trees in leaf, outdoor dining or other business appurtenances or where building facades are excessively setback; or 5. The applicant has secured a Certificate of Appropriateness from the Hyannis Main Street Waterfront Historic District Commission for the proposed sign. 6. The applicant has received a license from the Town Manager for the sign at the proposed location and proof of insurance has been provided. 7. This Special Permit is subject to renewal so that the Planning Board has an opportunity to evaluate impacts to the neighborhood, abutting and adjacent business owners, and safe passage for pedestrians. Decision: Based on the findings of fact, a motion was duly made a seconded to grant a special permit pursuant to Section 240-71(E)(4) to Jane Walsh d/b/a Red Fish Blue Fish Studio, located at 374 Main Street, Hyannis, for the display of a location hardship sign on the public sidewalk leading to the. primary business entrance, subject to the following conditions: 1. This permit is issued Jane Walsh and Exchange d/b/a Red Fish Blue Fish Studio to allow for display of one Location Hardship Sign, to be located as shown on the sketch plan approved and signed by the Building Commissioner on July 20, 2010. The sign shall be consistent in appearance with the sign proposed in the Special Permit application dated July 22, 2010. 2. The sign shall be in conformance with the performance standards outlined in Section 240- 74.E.4.b. 3. This Special Permit shall lapse on January 31, 2012, unless prior to January 31, 2012, the applicant applies for and is granted a renewal. Failure of the Planning Board to take action within sixty days of a timely request for renewal shall result in a renewal of said special permit for an additional two years until January 31, 2014. Any permit so extended may be renewed by the Planning Board upon.application received prior to the lapse of the special permit. 4. This special permit must be recorded at the Barnstable County Registry of Deeds. A copy of the recorded decision shall be submitted to the Building Division and the Planning Board prior to submission of a sign permit application. 5. A sign permit from the Building Division is required prior to displaying the sign. 6. With this in mind,I am compelled to explain that you are not entitled to secure your hardship sign to a street tree. This action not only violates Zoning Code Chapter 240 Section 61 but may also render harm to the tree; a violation under General Ordinance Chapter 221-Section = 30. The maximum square footage of all 1'signs, shall be 50 square feet or 10% of the building face, whichever is less. C. The maximum size of any freestanding sign;shall be 12 square feet. D. Temporary street banners may be permitted in the ;HVB; Business District only, for the purpose of informing the general public of community events and activities, with approval of the Town Manager. Street banners shall be hung in prescribed locations, securely.fastened to buildings, maintain a minimum height of 16 feet above the street, be constructed of durable materials, used solely for community events in the district, and remain in place for no more than three weeks prior to the event and be removed within one week after the event. The maximum height of any freestanding sign will be 10 feet, except that a height of up to 12 feet may be allowed by the Building Commissioner if it is determined that the additional height will be in keeping with the scale of the building and will not detract from the appearance or safety of the area and will not obscure existing signs that conform to these regulations and have a Town permit. C. The total square footage for all signs of each business shall not exceed 10% of the area of the building wall facing a public way or 100 square feet, whichever is the lesser amount. D. Only one freestanding sign is allowed per business, which may not exceed half the allowable size as permitted in this section. E. One projecting overhanging sign may be permitted per business in lieu,of either a freestanding or wall sign, provided that the sign does not exceed six square feet in area, is no higher than 10 feet from the ground at its highest point and is secured and located so as to preclude its, becoming a hazard to the public. Any sign projecting onto Town property must have adequate' public liability insurance coverage, and proof of such insurance must be provided to the Building Commissioner prior to the granting of a permit for such sign. F. Incidental business signs indicating the business, hours of operation, credit cards accepted, business affiliations, "sale" signs and other temporary signs shall be permitted so long as the total area of all such signs does not exceed four square feet and is within the allowable maximum square footage permitted for each business.. G. When a business property is located on two or more public ways, the Building Commissioner may allow a.second freestanding sign, so long as the total square footage of,all signs for a ` single business does not exceed the provisions of this section. H. When two or more businesses are located on a single lot, only one freestanding sign shall be allowed for that lot, except as provided in this section, in addition.to one wall or awning sign for each business. If approved by the Building Commissioner, the one freestanding, sign can include the names of all businesses on the lot. I. One awning or canopy sign may be permitted per business in lieu of the allowable wall or freestanding sign, subject to approval by the Building Commissioner. J. In addition to the allowable signs as specified in this section each restaurant may have a menu sign or board not to exceed three square feet. K. In lieu of a wall sign, one roof sign shall be permitted per business, subject to the following requirements: (1) The roof sign shall be located above the eave, and shall not project below the eave, or above a point located 2/3 of the distance from the eave to the ridge. The maximum allowable height of all ;s9ns; on buildings shall be 12 feet, and the maximum height of a freestanding sign;shall be eight feet. B. The maximum square footage of all 's_igns, shall be 50 square feet or 10% of the building face, whichever is less. C. r--, The maximum size"of any freestanding'Sigrn shall be 12 square feet. D. Temporary street banners may be permitted in the;HVB; Business District only, for the purpose of informing the general public of community events and activities, with approval of the Town Manager. Street banners shall be hung in prescribed locations, securely fastened to buildings, maintain a minimum height of 16 feet above the street, be constructed of durable materials, used solely for community events in the district, and remain in place for no more than three weeks prior to the event and be removed within one week after the event. Chapter 240-65 Signs in B,BA,UB,HB,HO,SD & SD-1 A. Each business may be allowed a total of two signs. B. The maximum height of any freestanding sign will be 10 feet, except that a height of up to 12 feet may be allowed by the Building Commissioner if it is determined that the additional height will be in keeping with the scale of the building and will not detract from the appearance or safety of the area and will not obscure existing signs that conform to these regulations and have a Town permit. C. The total square footage for all signs of each business shall not exceed 10% of the area of the building wall facing a public way or 100 square feet, whichever is the lesser amount. D. Only one freestanding sign is allowed per business, which may not exceed half the allowable size as permitted in this section. E. One projecting overhanging sign may be permitted per business in lieu of either a freestanding or wall sign, provided that the sign does not exceed six square feet in area, is no higher than 10 feet from the ground at its highest point and is secured and located so as to preclude its becoming a hazard to the public. Any sign projecting onto Town property must have adequate public liability insurance coverage, and proof of such insurance must be provided to the Building Commissioner prior to the granting of a permit for such sign. F. Incidental business signs indicating the business, hours of operation, credit cards accepted, business affiliations, "sale" signs and other temporary signs shall be permitted so long as the total area of all such signs does not exceed four square feet and is within the allowable maximum square footage permitted for each business.. G. When a business property is located on two or more public ways, the Building Commissioner may allow a second freestanding sign, so long as the total square footage of all signs for a single business does not exceed the provisions of this section. H. When two or more businesses are located on a single lot, only one freestanding sign shall be allowed for that lot, except as provided in this section, in addition to one wall or awning sign for each business. If approved by the Building Commissioner, the one freestanding sign can include the names of all businesses on the lot. I. One awning or canopy sign may be permitted per business in lieu of the allowable wall or freestanding sign, subject to approval by the Building Commissioner. J. In addition to the allowable signs as specified in this section each restaurant may have a menu sign or board not to exceed three square feet. K. In lieu of a wall sign, one roof sign shall be permitted per business, subject to the following requirements: (1) The roof sign shall be located above the eave, and shall not project below the eave, or above a point located 2/3 of the distance from the eave to the ridge. (2) The roof sign shall be no higher than 1/5 of its length. Copies of the sign J code were left at each site along with a written warning for the offending sign. A written warning (Bar 5624)was in fact issued on this date (11/18/09)to the retail business Red Fish Blue Fish for a portable sign installed on the sidewalk. Chapter 240 Section 61, The Prohibited Sign section is referenced on the written warning. A brief discussion occurred with the sales clerk concerning the sign code and I left my business card. The Building Commissioner was present during this discussion. Dec. 14,2009 The offending portable sandwich board sign was noted to yet again be posted on the public sidewalk advertising Red Fish Blue Fish. Dec. 18, 2009 The Building Commissioner directed me to issue a $100.00 citation for the 12/14/09 citing the prohibited sign code section pertaining to portable signs (240-61 H) and location pertaining to public property (240-61 K). A single citation (Bar No. 76176 ) was issued covering both offenses for infractions that occurred on 12/14/09. Feb. 9, 2010 A-Frame sign reported by Tom Geiler to be posted on sidewalk on Sunday 2/7/10. Building Commissioner directed that another citation be issued. Citation 76182 in the amount of$100.00 issued and mailed on this date. 1 t 4/2/2010 Citations dismissed by magistrate without preducie. If sign is,re-posted all citations to be brought forward with new. 5/13/2010 Found sign to be posted again on Main Street—leaning against the tree near crosswalk. Anderson, ZEO Re: Sign Code Violation Red Fish Blue Fish 374 Main Street,Hy Nov. 18, 2009 Walked Main Street with Building Commissioner in order to determine sign code violations and advise business owners and managers accordingly. Copies of the sign code were left at each site along with a written warning for the offending sign. A written warning (Bar 5624)was in fact issued on this date (11/18/09) to the retail business Red Fish Blue Fish for a portable sign installed on the sidewalk. Chapter 240 Section 61, The Prohibited Sign section is referenced on the written warning. A brief discussion occurred with the sales clerk concerning the sign code and I left my business card. The Building Commissioner was present during this discussion. Dec. 14, 2009 The offending portable sandwich board sign was noted to yet again be posted on the public sidewalk advertising Red Fish Blue Fish. Dec. 18, 2009 The Building Commissioner directed me to issue a$100.00 citation for the 12/14/09 citing the prohibited sign code section pertaining to portable signs (240-61 H) and location pertaining to public property(240-61 K). A single citation (Bar No. 76176 )was issued covering both offenses for infractions that occurred on 12/14/09. 1 flown of Barnstable, MA Page 1 of 2 § 240-61 Prohibited signs. The following signs shall be expressly prohibited in all zoning districts, contrary provisions of this chapter notwithstanding: A. Any sign, all or any portion of which is set in motion by movement, including pennants, banners or flags, except official flags of nations or administrative or political subdivisions thereof. B. Any sign which incorporates any flashing, moving or intermittent lighting. C. Any display lighting by strings or tubes of lights, including lights which outline any part of a building or which are affixed to any ornamental portion thereof, except that temporary traditional holiday decorations of strings of small lights shall be permitted between November 15 and January 15 of the following year. Such temporary holiday lighting shall be removed by January 15. D. Any sign which contains the words "Danger"or"Stop"or otherwise presents or implies the need or requirement of stopping or caution, or which is an imitation of, or is likely to be confused with any sign customarily displayed by a public authority. E. Any sign which infringes upon the area necessary for visibility on corner lots. F. Any sign which obstructs any window, door, fire escape, stairway, ladder or other opening intended to provide light, air or egress from any building. G. Any sign or lighting which casts direct light or glare upon any property in a residential or professional residential district. H. Any portable sign, including any sign displayed on a stored vehicle, except for temporary political signs. I. Any sign which obstructs the reasonable visibility of or otherwise distracts attention from a sign maintained by a public authority. J. Any sign or sign structure involving the use of motion pictures or projected photographic scenes or images. K. Any sign attached to public or private utility poles, trees, signs or other appurtenances located within the right-of- way of a public way. L. A sign painted upon or otherwise applied directly to the surface of a roof. M. Signs advertising products, sales, events or activities which are tacked, painted or otherwise attached to poles, benches, barrels, buildings, traffic signal boxes, posts, trees, sidewalks, curbs, rocks and windows regardless of construction or application, except as otherwise specifically provided for herein.
