As quoted from the"law", an employee is defined as every person inthe service'of another under any contract of hire,express or implied, oral or written. An employer is defined as anindiyidual,partnership, association,corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership, association or other legal entity, employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer. MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth.for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority. The soil consisted of a dense fine sand that was constantly collapsing as it dried (due to exposure to the air). The contractor has provided pressure treated plywood along one face'of4he'­ekcavati0'n1.td,'keep'=the sand in place. In addition, there was a fairly large chunk of concrete (approximately 3 to 4 feet in diameter) located roughly in the center of the pit just below the existing slab on grade elevation. Based'on the existing tsite rendition's-and'after-a discussion-of the pour.method-it;was agreed...thata.one sided form would"be ipeemissible provided certain precautions took:place. It was,.recommended.that the sand be. sprayed prior to the concrete pour to help prevent it from collapsing into the concrete footing before it had a chance to set. In addition, it was noted that if sand started to mix into the concrete as it was being placed then the operation would have to be halted and two sided formwork be used (with the exception of the footing which will be located under the existing concrete wall. -The framing at the second floor and roof was reviewed. The contractor headed off the existing framing (which spanned from front to back) at the wall being built around the elevator. The size and spacing of the horizontal steel was in conformance with the design drawings and supporting by means of steel chairs in order to maintain the minimum clearance between the bottom of steel and-bottom of footing. In addition, the vertical steel for the wall,which is doweled into the footings, has been placed and again, the size and spacing is in conformance with the design drawings. Finally, the horizontal steel for the wall was approximately 50% complete. The size and spacing of the steel is in conformance with the design drawings.
