The Commission considered the materials,colors, construction;design, texture,size, and historic accuracy of the elements proposed and found them to be "appropriate fa;lh&protection and preservation of the district. The Applicant provided a material sample o for,the ehimney`fo review by Commission members, which was found to be satisfactory. FINDINGS AND DECISION: The Board having considered the evidence hereby, finds and decides as follows: The Board took jurisdiction over the facility under Section 3.3A2 of its Regulations: "If the work being performed amounts to less than twenty-five percent (25%) of the one-hundred percent (100%) equalized assessed value of the building, and the cost of the work is 1 a $50,000 or more, then that portion of the work being performed shall comply with these Regulations, and an accessible entrance and toilet usable by a person in a wheelchair also shall be provided". Board Member Kathleen. Kelleher abstained from participating in, or voting in the matter before the Board. By way of background: The case originated as a complaint filed by Julie Nolan relative to access to the building. Michael Festa, the Board's Compliance Officer conducted a site inspection and found a number of problems, which he reported to the Board. The owner corrected many of the problems, and requested variances for the remaining items. The Board held a complaint and variance hearing on February 27, 1995, which the owner did not attend. - The Board went ahead with the hearing because the complainant, Julie Nolan was present. The Board found, based on the complainants testimony, and the site inspection report of the Board's Compliance Officer, Michael Festa, that the complaints filed on . the above sections, subjects of the variance request, are valid. Ms. Nolan did not attend the hearing (June 5), but submitted a letter, dated April 18, 1995, relative to the variance requests submitted by Mr. Snowden.. That letter read in part as follows: ..."The Asa Bearse.House has access violations that can be improved upon, I believe that another hearing is not necessary and the variance request should be denied." The Chair, Gregory Carell called upon Mr. Snowden to present his case for the variance requests to the Board. Mr. Snowden stated that the Asa Bearse House, built in 1814, is a recognized National Historical ,Landmark and is also registered with ' the local Historical Society. Mr. Snowden stated that he is not insensitive to disability issues, and made every effort to address the previous issues in a timely manner, as indicated in his letters of June 2, and August 30, 1994, to the Board. He noted that after completing all the work to bring the previous items into compliance, another complaint was filed relative to today's hearing. The Chair called upon Mr. Snowden to present the variance requests. 2 e The variance requests were addressed as follows: Section 21.2 The cross-slope of the wooden ramp exceeds 3%. Mr. Snowden stated that the cross-slope violation of the wooden ramp as been corrected. The Chair asked if Mr. Snowden is withdrawing his variance request for said section. He replied in the affirmative. BOARD ACTION The Board finds, based on Mr. Snowden's testimony that the cross- slope of the wooden ramp has been brought into full compliance with its Regulations, that a variance is no longer required. Section 27.2 - Width of exterior entrance door from the ramp is less than 36". Mr. Snowden stated that the width of the door is 33 1/2 inches, and this was verified by Mr. Festa. Mr. Snowden did not have the clear opening dimension of said door. Mr. Snowden stated that it may be feasible to remove the door frame to increase the width of the clear opening, but changing the door itself would be extremely difficult and involve a carrying beam for that part of the building. Mr. Snowden referred the Board to the photographs showing the location in question, and noted that there is six inches in width to the right hand side of the door before the start of the picture window, and the left hand side of the door butts right into the small building (shown in the photographs. So in effect, the whole door frame would have to be removed, and reinforced with a piece of steel. BOARD ACTION A motion was mace by Mary Connelly and seconded by Barbara Chandler to GRANT a . variance to Section 27.2 for the width of exterior entrance door from the ramp, on condition that a minimum clear opening of not less that thirty-two (32) inches in width be provided. (The motion passed with K. Kelleher abstaining) Section 30.5.3 - Eighteen inches not provided from center- line of the water closet to wall. Mr. Snowden stated that he has 19 1/2 inches between the center line of the water closet and the wall versus the 18 inches required by the Regulations. Mr. Snowden stated that he could make an adjustment of the grab bar to lessen the distance. The Board discussed the matter, 3 8 and noted that it was former Board Member Speed Davis' opinion that a small increase in space, i.e., the 1 1/2 inches, allows more room for the foot pedals of a wheelchair. Board Member Mary Connelly, who is in a wheelchair agreed with said assessment. t. BOARD ACTION The Board finds that there is no substantial- benefit for disabled persons to have the space between the centerline of the water closet to the wall reduced by 1 1/2 inches. Therefore, a motion was made by Mary Connelly and seconded by Barbara Chandler to GRANT a variance to Section 30.5.3 to the requirement that eighteen inches be provided from centerline of water closet to wall, on condition that the said distance is no more than 19 1/2 inches. (The motion passed with K..Kelleher abstainin') Section 30.5.1 - Men's toilet stall is 54" wide by 61" deep Mr. Snowden stated that men's rest room complies with all requirements in the Board's Regulations, except the stall size, which is 54 inches wide by 61 inches deep. The Board's Regulations call for a stall to be 60 inches wide by 72 inches deep. "Mr. Snowden stated ' that the rest room was built in 1963, and was remodeled in the 1980's. Mr. Snowden stated that he does not know how to increase the size of the stall without doing major work. Mr. Snowden stated that a friend of his in a wheelchair finds the stall usable. He noted that moving one of the walls back one foot, into the woman's room, would involve changing all of the plumbing that comes up the chase. The Chair asked if Mr. Snowden had investigated different ways to modify the rest room in order to increase the size of the stall. Mr. Snowden replied that he used an architect for the work already performed, and it was found that it would be quite costly to enlarge the stall, because all of the plumbing has to be removed. Mr. Snowden stated the other option is to go into the dining room, and it looks dreadful. Mr. Ca ell stated that it may be infeasible to increase the size of the stall, there may be no solution, but that has to be proven to the Board. BOARD ACTION • The Board found that it did not have sufficient information presented to prove that it is impracticable to comply with its Regulations. That compliance with its Regulations is either technologically infeasible, or the cost for compliance is excessive without any substantial benefit for disabled persons. Therefore, a motion was made by Barbara Carell and seconded by Mary Connelly to take Section 30.5.1 4 w r under advisement, to allow Mr. Snowden time to explore all options for increasing the size of the stall. The Board requested that Mr. Snowden submit his findings, in writing, by August 1, 1995, relative to the feasibility/infeasibility, what can and cannot be done to increase the size of the stall; the impact on the building, and the cost for same. (The motion passed with K. Kelleher abstaining) Section 21.2 Cross-slope of walkway exceeds 3% Mr. Snowden stated that the cross slope of the walkway. exceeds 3% in only a few places. Mr. Snowden referred the Board to Michael Festa's letter, dated July 29, 1994, relative to his findings during the site inspection on July 18, 1994. Mr. Festa took measurements from the ramp to the sidewalk to. determine the cross slope of the walkway. He found that the cross slope o► the walkway exceeded 3% at both edges of said walkway. The Board viewed photographs showing the brick walkway. Mr. Snowden stated that the condition of the edges of the walkway is due to settling over the years, and he proposed to fill in both edges with crushed bluestone as a method to correct the cross slope violation. Mr. Snowden also noted that the photographs show that the center of the walkway is. not a problem, ' only the edges. Mr. Snowden asked the Board to allow him to correct the condition by filling in the edges with bluestone to make the walkway as level as possible.. Board Member Edward Kelly asked Mr. Snowden if, by positioning of bluestone, he can bring the walkway into compliance with the 3% cross slope requirement. Mr. Snowden stated that he can close to it, but noted that time and weather will wash it away. Mr. Carell stated that he needs some assurance that Mr. Snowden's proposal for the walkway will work, before accepting bluestone as a final solution for bringing the walkway into compliance with the 3% cross slope requirement. The Chair called fora motion in the matter. Board Member Edward Kelly made a motion to grant a one .year time variance, until July 1, 1996, to Section 21.2, on condition that Mr. Snowden put bluestone down to correct those areas where the cross slope of the walkway exceeds 3%, as he proposed at the hearing. The following persons appeared: Julie Nolan, Access Advocate for the Cape Organization for the Rights of the Disabled (CORD), and the complainant in the matter. The petitioner in the matter, William Snowden did not appear at the time scheduled for the hearing (3:00 p.m.). Deborah Ryan, the Executive Director of the Board stated for the record that a representative of Asa Bearse House telephoned the office for 1 1 William Snowden (owner of Asa Bearse House) at 3:10 p.m. to report that he would not be at the hearing, because the facility is in Chapter 11 bankruptcy. All persons offering testimony were sworn in by the Chair. 4. FINDINGS AND DECISION: The Board having considered the evidence hereby, finds and decides as follows: The Board voted to go forth with the hearing, so that Ms. Nolan could present her testimony to the Board. The Board stated that it notified Mr. Snowden, by certified mail of the date, time and location of the hearing, and it did not receive any. information prior to said telephone call relative to bankruptcy, or that he would not attend the hearing. Board Member Kathleen Kelleher stated for the record that she will abstain from voting in the matter of the Asa Bearse House, due to her affiliation with CORD. By way of background: The case originated as a complaint filed by Julie Nolan relative to access to the building. Michael Festa, the Board's Compliance Officer conducted a site inspection and found a number of problems, which he reported to the Board. The owner has corrected many of the problems, and he has requested variances for the remaining items. The Chair called upon Ms. Nolan to present her complaint to the Board. Ms. Nolan reported that the front entrance of the facility is inaccessible due to steps: the surface of the brick walkway which leads to the inaccessible front entrance and to the wooden ramp at the side of the facility is' uneven and the cross slope exceeds 3%. The cross slope of the wooden ramp (at the end of the brick walkway going to the accessible entrance) exceeds 3%, and the exterior entrance door at the top of said ramp is less than the 36 inches in width as required by the Board's Regulations (33 1/2 provided,. Ms. Nolan stated that she could not say whether the violations in the rest rooms have been corrected. Ms. Nolan stated that there is an inaccessible patio area at the front of the facility where tables and chairs are set for use of the 2 B � customers of the restaurant during the good weather. Ms. Nolan suggested that it may be feasible and less costly for the owner to provide a ramp to the front entrance, than it is to fix the brick walkway. This solution would also provide equal access for disabled persons. Ms. Nolan also stated that she is opposed to the Board granting the variances, for the reason that there is benefit for disabled persons to have said violations corrected. BOARD ACTION The Board found based on Ms. Nolan's testimony, and Mr. Festa's report, that the complaint's filed by Ms. Nolan are valid. Therefore, a motion was made by Mary Connelly and seconded by Barbara Lybarger to find in favor of the complainant. that the above sections are in violation of the Board's Regulations. (The motion passed) (K. Kelleher - abstained from voting in the matter) The Board further found, after reviewing the application for variance, that it was not proven to be impracticable to comply with its' Regulations. That compliance with the Regulations would be technologically infeasible, or compliance with the Regulations would result in excessive and unreasonable costs without any substantial benefit to physically disabled persons. Therefore, a motion was made by Mary Connelly and seconded by Barbara Lybarger to DENY the variance requests to Sections 21.2, 27.2, 30.5.3, 30.5.1 and 21.2. The Board further ordered that all work be performed to bring the above sections into full compliance with its Regulations by June 1, 1995. (The motion passed) (K. Kelleher - abstained from voting) Any person aggrieved by the above decision may request an a.djudicatory hearing before the Board within thirty (30) days of receipt of this decision by filing the attached request for an adjudicatory hearing. If after thirty (30) 3 . days, a request for an adjudicatory hearing is not received, the above decision becomes a final decision and the appeal process is through Superior Court. Weston,Inspector of Wires RE: Violations at 415 Main Street,Hyannis d/b/a Asa Bearse House On January 24, 1996 I was requested to meet Lt.Eric Hubler at the above address with regard to wiring violations or hazards to the premises'wiring system. The following items observed require correction as per 527 CMR 12:00 Massachusetts Electrical Code. Main Basement: • Covers to circulators missing-exposed 120 volt wiring • Covers to 4"square boxes missing-exposed 120 volt wiring • Four foot cover of auxiliary gutter missing(exposed 240 volt wiring) • General Electric Panels-contain unlisted breakers,IE,I.T.E.,Westinghouse,Bryant,etc.: violation of ART.110-3(b)and are not listed for use in General Electric panels due to proper overcurrent protection. Subpanel has mini-breakers containing more than the allowed number of circuits. Basement Under Reading Room: • Panel covers have knockouts removed leaving exposed live wires • Open splice cabinet at base of stairs(exposed live wires) • Ambient temp in this area is high,possibly having adverse effect on conductors and circuit breakers in this area. Ventilation should be installed for this area. • Recessed fixtures by bar-hanging in mid-air,wiring method is NM cable,violation of ART.5184. These fixtures require removal or rewiring and ceiling structure put back in place. • Extension cords are being used to connect various lights,televisions,and other equipment. Several of these cords penetrate ceilings. • Extension cords require removal and permanent wiring methods with the use of outlet boxes to serve these locations need to be installed. , I • Lighting fixture over pool table has open box(exposed wires)fixture is not grounded. Q960129A • The front patio and exterior areas primarily use extension cords. Fixtures on awnings are open brass with two-wire extension cords(ungrounded). • All exterior fixtures require U.L.listing for wet locations with permanent wiring methods, outlet boxes if used for portable wiring must be ground fault protected with listed weatherproof covers. Paddle fans also are not listed for damp or wet locations. Exit Sign: (Several are not in proper operating condition) Neon Lighting • Approximately 35 interior neon signs are being used. Many connected to two wire extension cords which provide no grounding provisions and are in violation of ART 110 3(b) • The fixtures require installation per ART.600-4 and ART 600-37 which states conditions by the manufacturers of allowed installation. The majority of the fixtures will require outlets to be installed to assure proper grounding. • • Rule 4 states that where an actual hazard exists,the owner of the property shall be notified in writing by the authority enforcing this code(See M.G.L.chapter 166 Section 32 and 33 for enforcement authority) cc: Lt.Hubler,Hyannis Fire Department I I
