I went out this morning to check the signage issue at the Joke Store at 624 Main Street as requested. The"sign"
seems to be printed on some kind of screen that is hung inside the store and is not in the window itself.These
screens have become very popular in recent years as they allow for light to shine though yet remains opaque to the
outside view. Many businesses use them to capitalize on window space that previously would be unavailable
without sacrificing natural light.
Since I have been here,the rule of thumb has always been that a minimum of 2'back from the window is required
(if it is not to count towards the total signage allotment and permit requirements).
This particular screen is about 3'back from the glass. As such,the offending signage does not fall within our
jurisdiction and no permit is required. There are no no applicable regulations on interior signage,signage that
is set back but visible through the glass or the content of the display(except for adult material). To impose any
other standard would impact a multiple number of retail spaces and merchants. While this is not ideal and clearly
is not desirable,I believe our hands are tied.

Dear Mark:
The Chief and I spoke about this yesterday and agreed that neither the display nor sale of such
paraphernalia is illegal. As you know, retail sales are allowed under the applicable zoning. It
would be appropriate for Robin Anderson to determine whether the signage on the premises is
compliant but it sounds like that it is the display that is deemed objectionable rather than a
particular sign. The Chief echoed Councilor Cullum's sentiments that the members of the
community who have concerns should speak with the proprietor directly, as has been done with
similar issues in the past. Please call with any questions. All the best, Ruth

El, I have had a complaint from a Planning Board member that the Joke Shop on Main Street Hyannis, has
increased its inventory and percentage of area for adult use materials. The limit in the Ordinance outside of the
Adult Use Overlay District is 25%. They may have been over that level when the Ordinance was adopted.

minors to the adult sections of the establishment.
d) - The purchase point of Adult Use non live
entertainment materials shall be segregated from the purchase point of
non-Adult Use non-live entertainment materials .
e) Adult Use non-live entertainment purchases or rentals
shall be bagged with an opaque material.
3) Pre-existing Adult Uses
Any Adult Use that was in existence as of the first date of
publication of the notice of public hearing on the zoning amendment
inserting this ordinance regulating adult uses may continue to
operate in the same location, without material change in scale or
content of the business, provided that the owner complies with the
provisions of this section requiring a special permit including all
relevant conditions imposed thereon.

4) Prohibited Uses:
Nothing in this Ordinance is intended to authorize, legalize or
permit the establishment, operation or maintenance of any business,
r} building or use which violated any Town Ordinance or Statute of the
Commonwealth of Massachusetts regarding public nuisances, sexual
conduct, lewdness, or obscene or harmful matter, or the exhibition

EXPLANATORY PREAMBLE BARNSTABLE
WHEREAS, there Is documented experience In numerous other citieg- Including
Boston, Massachusetts; Seattle and Tacoma, Washington; Detroit, Michigan; Austin,
Amarillo, Beaumont, Dallas and Houston, Texas; Indianapolis, Indiana; Los Angeles,
California; Phoenix, Arizona; Oklahoma City, Oklahoma, and Minneapolis and St. Paul,
Minnesota showing that adult entertainment uses are distinguishable from other
business uses and that the location of adult entertainment uses degrade the quality of
life in the areas of a community where they are located, with impacts Including
increased levels of crime, blight, depreciation of property values, and late hours of
operation resulting in noise and traffic late into the night; and,
WHEREAS, it is the intention of the Town Council in the adoption of this Ordinance to
rely upon and reference the findings of the aforementioned cities in various detailed
studies said cities have conducted that empirically document the adverse influences
and effects of adult entertainment uses on surrounding properties; and,
WHEREAS, the Town of Barnstable is predominantly residential in its character and
`-velopment pattern, being approximately (84%) residential in land use based on the
Ircent of Its taxable lands assessed as residential; and,
WHEREAS, the Town of Barnstable desires to protect its residential uses from
encroachment by commercial adult uses and to ensure and promote the Town's image
as a safe, pleasant, and attractive place of residence for families with children, to
Preserve and promote the peace and quiet enjoyment of these areas for all persons,
and,
WHEREAS, it is the desire of the Town of Barnstable to preserve and protect the safety
Of children and young people in the vicinity of schools and public parks where they may
be expected to work, congregate, and play, and furthermore that children and young
people not be subjected to confrontation with-the existence of adult entertainment uses
in the vicinity of schools and parks, or in commercial areas where there is significant
Patronage and presence of children and young people; and,
WHEREAS, the commercial areas of the Town of Barnstable, particularly along Its main
commercial thoroughfares, reflect greatly on the Town's image in the region, and It is
the desire of the Town of Barnstable to promote a positive business community image,
retain and promote safe, attractive business areas, free of crime and nuisances; and,
WHEREAS the economy of the town is substantially based upon tourism, second
homes, and retirement homes and upon functioning as the regional center for all of the
:Cape,Whose economy is similarly based on tourism and second homes, and as such,

_rhaintaining an attractive environment for residents and visitors is essential to
aintaining a strong and viable economy; and
4M EREAS the Town of Barnstable, as an aid to mitigating the aforementioned impacts

residences, schools, parks and playgrounds, and churches and chosen places of
worship; and,
.W.1i WHEREAS, adult uses engaging in the sale, rental or display of sexually explicit
materials, including books, magazines,, periodicals, pictures, photographs, slides,
�I movies and videos, may legitimately be controlled by a municipality, either through
concentrating in certain locations, or separating from other uses which will be
inordinately impacted by the sale, rental of display of sexually explicit materials an
d
furthermore Section 9A.of Chapter 40A of the Massachusetts General Laws specifically
provides for municipal regulation of adult uses through special permits and standards
i related to location and separation of such uses; and,
WHEREAS, mapping by Geographical Information Systems (GIS) technology by the
Planning g Department
p . ment of identified uses sensitive to Adult Uses, including residences,
r: cultural and recreational uses, public lands and services including schools, churches
and day care centers, revealed that a 500 foot separation leaves only the IND industrial
�I districts and small portions of the business districts available to site Adult Uses; and
WHEREAS permitting Adult Uses to be located throughout the-industrial Zones is
is contrary to the Town's approved Local Comprehensive Plan goals to reserve this area
for the development of high tech light industries in order to increase the number of
higher paying job opportunities available in the town and region; and
WHEREAS, the Town of Barnstable does not desire to suppress any speech activities

protected by the First Amendment, but rather to enact a content-neutral ordinance

10: concerned with the secondary effects of adult uses on the surrounding community,
especially crime and effects upon children and family life, and therefore'desires
reasonable regulation of the location of adult uses in order to provide for the protection
of the image of the community, its property values, and to protect the residents of the
community from any adverse affects of such adult entertainment land uses, while
providing to those who desire to patronize adult entertainment land uses such an
opportunity in areas within the Town which are appropriate for location of such land
uses; and,
WHEREAS, it is the intention of the Town Council In the adoption of this Ordinance to
rely upon the opinion of the Supreme Court of the United States in the cases.of City of
Renton v. Playtime Theatres, Inc., 475 US 41, Young v. American Mini Theatres, 427
US 50, and FW/PBS, Inc., v. City of Dallas, 110 US 596, to regulate and limit the
location of adult entertainment uses, to promote the Town of Barnstable's great interest
in protecting and preserving the quality of Its neighborhoods, commercial and industrial
districts, and the quality of life through effective land use planning;
NOW THEREFORE, THE TOWN COUNCIL OF THE TOWN OF BARNSTABLE,
MASSACHUSETTS DO ORDAIN AS FOLLOWS: ORDERED:
SECTION 1
1 That Chapter III, Article III of the Ordinances is hereby amended by inserting, at
the end of Section 3-6 thereof, the following new section:

Section 3-7 Adult Use Overlay District
1) District Established
An Adult Use Overlay District is hereby established, and shall be considered as
superimposed over any other districts established by this Ordinance, and is
shown as an overlay on the official zoning map established pursuant to Section
2-2-, `Zoning Map,' herein.
2) Adult Use
Within the Adult Use Overlay District, and only within the Adult Use Overlay
District, an Adult Use may be permitted provided that a Special Permit is first
obtained from the Zoning Board of Appeals, subject to the following conditions of
approval:
A) The Special Permit shall be issued to the owner of the Adult Use and shall
not transfer with a change in ownership of the business and/or property.
B) The Special Permit shall lapse after two years, unless a shorter term is
specified by the Zoning Board of Appeals. Upon receipt of a valid
application, the Zoning Board of Appeals may grant another Special
Permit provided that the Board finds that all conditions of this Section 3-7
herein, have been complied with, and all conditions of approval of the
Zoning Board of Appeals.
C) The Special Permit shall not be renewed if any of the following has taken
place on or in proximity to and associated with the premises, as provided
for in B), above:
a) unlawful sexual activity;
b) gambling;
c) drug use;
d) violent crimes;
e) offenses against children;.
f) repeated public disturbances requiring intervention by the police; and,
g) any other Illegal activities.
D) Violation of any of the conditions of approval of the Special Permit shall be
grounds for non-renewal of the Special Permit as provided for in B) above.
E) No Special Permit shall be issued to an owner convicted of violating MGL
Ch. 119, § 63, (Inducing or abetting delinquency of a child) or MGL Ch.
272 § 28, (Matter harmful to minors, etc.), or similar laws in other states.
F) Where necessary to protect adjacent uses, the Zoning board of Appeals
may require buffering by fencing, vegetation or other screening methods.
G) No Adult Use shall be allowed within a building containing residential use,
or upon a lot with residential use. No adult use shall be located within 500
feet of a residence.
H) Where the Adult Use is not governed by the Licensing Board, the
following conditions shall apply:
a) A manager responsible for the operation of the establishment shall
t r be designated by the owner, if the owner is not the manager. The
3 manager shall register with the Building Commissioner. No
manager shall be designated who has been convicted of violating
MGL Ch. 119, § 63, (Inducing or abetting delinquency of a child) or
MGL Ch. 272, § 28, (Matter harmful to minors, etc.) or similar laws
in other states
b) The owner and/or manager of g the establishment shall be

Adult Bookstore: An establishment having as a substantial or significant
portion of its stock in trade, books, magazines, and other material, which are
distinguished or,characterized by their emphasis depicting, describing or relating
to sexual conduct or sexual excitement as defined in MGL Ch. 272, § 31. For
purposes of this paragraph, "substantial or significant portion of stock" shall
mean greater than twenty-five percent (25%) of the subject establishment's
inventory stock; or greater than twenty-five percent(25%) of subject premise's
gross floor area, or 200 sq. ft., whichever is greater.
Adult Paraphernalia Store: An establishment having as a substantial or
significant portion of its stock devices, objects, tools, or toys which are
distinguished by their association with sexual activity, including sexual conduct or
sexual excitement as defined in MGL Ch. 272, § 31. For purposes of this
paragraph, "substantial or significant portion of stock" shall mean greater than
twenty-five percent (25%) of the subject establishment's inventory stock; or
greater than twenty-five percent (25%) of subject premise's gross floor area, or
200 sq. ft., whichever is greater.
Adult Motion Picture Theatre: An enclosed building used for presenting
material motion picture films, video cassettes, cable television, slides or any

other such visual material distinguished by an emphasis on matter depicting,
describing, or relating to sexual conduct or sexual excitement as defined in MGL
Ch. 272 § 31.
1 Adult Video Stores: An establishment having a substantial or significant portion
J of its stock in trade for sale or rent, movies, videos, and similar audio/visual
media, which are distinguished or characterized by their emphasis depicting,
describing, or relating to sexual conduct or sexual excitement as defined in MGL
Ch 272 § 31. For purposes of this paragraph, "substantial or significant portion of
stock" shall mean greater than twenty-five percent (25%) of the subject
establishment's inventory stock; or greater than twenty-five percent (25%) of
subject premise's gross floor area, or 200 sq. ft., whichever is greater.
Establishment Which Displays Live Nudity: An establishment which provides
live entertainment for its patrons, which includes the display of nudity, as that
term is defined in MGL Ch. 272 § 31.
Adult Use: As defined herein, an Adult Bookstore, Adult Paraphernalia Store,
Adult Motion Picture Theatre Establishment, or an Establishment Which Displays

That Chapter III, Article III, Section 7 of the Ordinances is hereby amended by
inserting, at the end of Section 4-3.3 Prohibited Signs thereof, the following new
section:

advertising which is distinguished or characterized by emphasis depicting or
describing sexual conduct or sexual activity as defined in MGL Ch. 272, § 31,

the air, roads, highways,. or a public area.

That Chapter 111, Article. III, Section 2-2 of the Ordinances is hereby
amended by amendment to the official Zoning map by the addition of an
Adult Use Overlay District as shown on the map on file with-the Town Clerk
entitled: Adult Use Overlay District, Plant Road and Cit Avenue, Hyannis,

Received a call from Intercity Alarms for the fire alarm sounding at the Java and Joke shop 624/628 Main Street.
Response_ Engine 822 Capt. E_ Farrenkopf F/Fs Sylvester, Lamothe.
Upon arrival had a one and one half story wood frame commercial with nothing showing. Upon investigation gained
entry into # 624 and found that zone three on the alarm panel was sounding.-All zones were not marked as to there
locations. Investigating found a smoke detector activated In the adu action of the store from an unknown cause.
Caretaker "Sheldon" was notified by Intercity Alarms and advised.
Alarm reset, Front door relocked and keys placed back in the FL) key box
