Activity Request: To permit construction of a new free standing sign on Main street indicating parking for the Roadhouse Cafe in addition to an existing one on South Street. Procedural Provisions: Section 5-3.2 (3) : Variances Filed: Feb. 25, 1994; to 3/6/94 ZBA Mtg. Background Information: The locus is on the south side of Main street three lots east of the intersection with South Street in the B - Business District of Hyannis and has 0.15 acres of land. The petitioner has obtained a demolition permit for the building on site. The petitioner is requesting relief from the sign ordinance to allow a second sign to be erected on Main Street on property recently acquired for additional parking. site Plan Review approved (letter dated June 3, 1994) a "Site Plan of Land for the proposed parking lot off Main Street in Hyannis, .Town of Barnstable, MA" prepared for Roadhouse Cafe by Down Cape Engineering, Inc., Yarmouth, MA dated April 25, 1994, last revised May 13, 1994 (entrance & parking) . DEPARTMENT COMMENTS: The new parking lot (Map 308-135, the subject of this variance request) adds 21 spaces to the 42 spaces already existing on parcels 308-139, 308-270 and 308-141, which also includes the restaurant. The Board may consider the advantage of having the petitioner combining all four lots to insure integrating all parking. Staff Report - Appeal No. 1994-53 variance - Sign Ordinance: Columbo, Roadhouse Cafe The new location of parking ingress/egress on Main Street for the restaurant warrants a new sign to insure that customers driving on Main street can see and access the lot efficiently. The location of the proposed sign is on the property owned by the applicant and is approximately four feet off the right of way of Main Street. The dimensions indicated on the sketch of the proposed free standing sign need to be clarified and the total sign area indicated using methods outlined in the ordinance. SUGGESTED CONSIDERATIONS: If the Board should find to grant this request for a Sign ordinance Variance, it may wish to consider the following conditions: 1. The free standing sign shall be designed as shown on sketch submitted with the application and to be 12 square feet in area. 2. That no further signage be permitted for any purpose on the combined four lot site. 3. All conditions of Site Plan review be satisfied. 4. All four lots, (Map 308, Lots 135, 139, 270 and 141) are to be combined into one lot. 5. The 21 parking spaces on this area shall not be utilized as valet parking. valet parking shall be restricted to the area presently approved by a previous special permit issued by the former selectman's office. 6. Applicant shall implement the approved site plan, inclusive of an improvement showing the reduction of the curb cut on South Street to 24 feet. DAra 939 main St. yarmouth, ma •,E�,,,E,,b, `I� , D7-c.2 DAVID COLUMBO D/B/A ROADHOUSE CAFE SIGN PERMIT COMPUTATIONS Currently existing on the site are two signs that would qualify within the definition of signs contained in Section 4-3 of the Zoning Ordinance, a sign on the face of the building itself, which is approximately 32 square feet, and a free standing sign which is approximately 12 square feet (there is also a Roadhouse Cafe parking sign and a lounge entrance sign which are approximately a total of 5 . 75 square feet) . The total square footage of all those existing "signs" in the aggregate is 49 . 75 . Under the provisions of Section 4-3 . 7 (3) the total square footage of all signs for a business shall not exceed ten (10%) percent of the area of the building wall facing a public way or 100 square feet, whichever is the lesser amount . Section 4-3 .4 (5) limits the portion of the front building wall that may be used in calculating this area as no more than 10 feet in height from the ground. The length. of the front wall facing the street of the Roadhouse Cafe is 80 feet and, therefore, the total square footage of the front wall eligible to be used under the formula is 800 square feet resulting in a total aggregate square footage for all signs on the property of 80 square feet . The new proposed free standing sign to be located at the Main Street entrance is proposed to be 12 square feet resulting in a total square footage of all signs on site of 61 . 75 square feet, almost 256 below the allowed square footage . Finally, Section 4-3 . 7 (1) of the Ordinance limits the number of signs to a total of two. . However, Section 4-3 . 7, Subparagraph t `1 7, would appear to permit the Building Commissioner to allow an additional free standing sign. This Section could easily be read to permit the second free standing sign to be an addition to the two signs permitted under Subparagraph 1 .
