DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is,or is intended to be, a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. Many homeowners who use this exemption are unaware that they are assuming.the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. Crossen Building Commissioner Town of Barnstable 367 Main Street Hyannis, MA 02601 Re: 67 R Maple Avenue, Hyannis, (Map#307/Parcel#087) Dear Mr. Crossen: I represent Gary Famigliette, who is the owner of 67 Maple Avenue, Hyannis, and the subject of the zoning question concerning the pre-existing non-conforming use of a 16 X 26 ft. "guest cottage" located at the rear of his property. The current Town Assessor's records correctly describe the premises as consisting of a cottage and a single family dwelling located on 23,000 sq. ft. residential lot. The lot has 140 feet of frontage on Maple Avenue (a 40 foot public way taken by the Town of Barnstable in 1927) and 130 feet of frontage on Dumont Drive (a private way servicing six (6) dwellings). The lot and its buildings are serviced by the Town Sewer and the Barnstable Water Company and have existed in their current configuration for many years. The buildings are clearly shown on the "1967-8 Avis aerial photographic maps." The residential subdivision in which the subject property is located was created in 1925 and pre-dates the adoption of Subdivision Control and Zoning by the Town of Barnstable. The subdivision contains seventeen(17) 7,500 to 10,000 sq. ft. lots. Most of the lots have not changed during their seventy-four(74) year existence. Our subject lot is more than twice the size of the original lots and is made up of a combination of three (3) smaller lots. The property is located within 300 ft of the 67 Sea Street Apartment Complex, a 70-unit multi family apartment development with a dwelling unit density that would allow 10 dwelling units on the subject property. Cottage colony style developments, duplexes and small lots are the dominant character of the area. This intense high density of development is the direct product of the Town of Barnstable's zoning history. Additionally, the property is located within 600 feet of the intersection of Main Street and South Street. This places the subject property within 400 feet of the Town's most permissive commercial zone appropriately designated as the"B" or"Business District."During the early years of Town's zoning development, the commercial heart of the Town was granted the most permissive and intense development classification. This was done to encourage centralized commercial growth and development in"the downtown area." The abutting residential zone was classified as a Residence A District and for many years permitted single and two family dwellings on 7,500 and 10,000 sq. ft. lots. This area was given the "A" classification because it permitted the smallest lot size for single and two family residential dwellings. This high-density residential classification was created to provide convient affordable housing with in walking distance of the commercial downtown area. It also provided important volume support for the costly municipal sewer distribution system. The subject property is located in the old Residence A District. The elimination of the "two family dwelling"use in 1971 from.the Residence A District caused the subject"guest cottage" to become a pre-existing non-conforming use. In 1972, Residence A District was deleted from the Town Section I Use Regulations-Residence Districts and the old Residence A District was re-designated as a Residence B District. This is the current zoning district of the subject property. It is interesting to note that at the time the Resident A District was deleted, the owner of the subject property had more than enough frontage and lot area to have subdivided the lot into two (2) 10,000 sq. ft. single family dwelling lots. The owners choose to continue to,use the property as one premise in common ownership. I have reviewed the history of the property located at 67 Maple Avenue, Hyannis, Massachusetts, and it is my opinion that the current rental cottage at the rear of the property is a proper pre-existing non-conforming use grand-fathered and protected under Section 6 of M.G.L.A. Chapter 40A. The property is not in conformity with the current zoning requirements for Resident B District. This is also true for nearly all of the residential properties located within the old Residence A District. It would appear that all of the residential lots within the old Residence A District have by the series of upgrading density changes become nonconforming with the current residential one (1) acre minimum Town Bulk Regulations.. This does not make the current use and occupancy of the premises illegal or in violation of the Town of Barnstable Zoning By Laws. When the Planning Board presented the many up grading zoning changes to the residents and Town Meeting members, it was done with the assurance that pre-existing uses and structures would not be rendered illegal. The grand fathering protections of the state law played a key part in the Town's vote to,adopt the more restrictive zoning regulations. The current property has not changed its bulk configuration since 1949 when Lots 13 and 14 were reconfigured to consist of Lot 13A and 14B and a thirty foot strip of land added to the rear of the subject property to give it its current shape. The current Assessors card describes the building as a"cottage." Edmond W. Dery, Jr., a neighbor who has resided at 14 Potter Avenue since July 1962, states in a signed written statement that Lucille B. Dumont rented the cottage at the rear of the property from the mid 60s forward and confirmed that the cottage has continued to be rented through to the present time. The Famigliette family acquired the property in 1982. The rental cottage was sold to them as a part of the property and represented as being legal and not in violation of Town Regulations. For more than seventeen (17) years, the family has continued to rent the rear cottage to persons who needed inexpensive affordable housing. There is a severe shortage of safe affordable rental property within the Town of Barnstable. Abandoning this pre-existing non-conforming use and eliminating the cottage would only add to the housing shortage for the Town and serve no social benefit to the community. The cottage poses no environmental or public safety risk or hazard to the community. The cottage is connected to the Town Sewer system. The property fronts on a paved and maintained public street. The property is well landscaped and maintained. The resident owner lives on the premises and pays real estate taxes based upon the non- conforming use. There is apparently no building permit on file with your records permitting the conversion from a"shed"to a"guest cottage." It would appear that at some point during the early 60s the 16 x 26 foot building was converted into a"guest cottage." This guest cottage conversion was done by the owner, and may or may not have included the obtaining of a building permit from the building inspector's office. Obviously, at that time building permits, while required for the construction of new dwelling, were not readily obtained for structural alterations or use changes that were permitted under the existing zoning regulations. My client does not wish to litigate this issue with the Town. He simply wishes to continue to use the property, as he believes it to have been used for the past thirty-five (35) years. I request that you consider this matter, and give due weight to the facts set forth above. I recognize that you, as the Town's zoning police officer, have a responsibility to uphold the building and zoning codes for the Town of Barnstable as authorized under the Zoning Enabling Act of the Commonwealth of Massachusetts. I acknowledge that the public records (Assessors records and Building Permit files) that have been brought to your attention give you reason to investigate my client's usage of the subject property. Like a police officer, you get to evaluate the specific usage of an owner's property and determine when to prosecute that person for possible criminal violations. You also have the opportunity to make those judgments in the light of the best interests of the community and the individual property owner. "guest cottage"located at the rear of his property. The current Town Assessor's records correctly describe the premises as consisting of a cottage and a single family dwelling located on 23,000 sq. ft. residential lot. The lot has 140 feet of frontage on Maple Avenue (a 40 foot public way taken by the Town of Barnstable in 1927) and 130 feet of frontage on Dumont Drive(a private way servicing six(6) dwellings). The lot and its buildings are serviced by the Town Sewer and the Barnstable Water Company and have existed in their current configuration for many years. The buildings are clearly shown on the"1967-8 Avis aerial photographic maps." The residential subdivision in which the subject property is located was created in 1925 and pre-dates the adoption of Subdivision Control and Zoning by the Town of Barnstable. The subdivision.contains seventeen(17) 7,500 to 10,000 sq. ft. lots. Most of. the lots have not changed during their seventy-four(74)year existence. Our subject lot is more than twice the size of the original lots and is made up of a combination of three (3) smaller lots. The property is located within 300 ft of the 67 Sea Street Apartment Complex, a 70-unit multi family apartment development with a dwelling unit density that would allow 10 dwelling units on the subject property. Cottage colony style developments, duplexes and small lots are the dominant character of the area. This intense high density of development is the direct product of the Town of Barnstable's zoning history. Additionally, the property is located within 600 feet of the intersection of Main Street and South Street. This places the subject property within 400 feet of the Town's most permissive commercial zone appropriately designated as the "B" or"Business District." During the early years of Town's zoning development, the commercial heart of the Town was granted the most permissive and intense development classification. This was done to encourage centralized commercial growth and development in"the downtown area." The abutting residential zone was classified as a Residence A District and for many years permitted single and two family dwellings on 7,500 and 10,000 sq. ft. lots. This area was given the"A" classification because it permitted the smallest lot size for single and two family residential dwellings. This high-density residential classification was created to provide convient affordable housing with in walking distance of the commercial downtown area. It also provided important volume support for the costly municipal sewer distribution system. The subject property is located in the old Residence A District. The elimination of the "two family dwelling"use in 1971 from the Residence A District caused the subject "guest cottage"to become a pre-existing non-conforming use. n , Resi ence A District was deleted from the Town Section I Use Regulations- sidence Districts and the old Residence A District was re-designated as a Residence B District. This is the current zoning district of the subject property. It is interesting to note that at the time the Resident A District was deleted, the owner of the subject property had more than enough frontage and lot area to have subdivided the lot into two (2) 10,000 sq. ft. single family dwelling lots..The owners choose to continue to use the property as one premise in common ownership. I have reviewed the history of the property located at 67 Maple Avenue, Hyannis, Massachusetts, and it is my opinion that the current rental cottage at the rear of the property is a proper pre-existing non-conforming use grand-fathered and protected under Section 6 of M.G.L.A. Chapter 40A. The property is not in conformity with the current zoning requirements for Resident B District. This is also true for nearly all of the residential properties located within the old Residence A District. It would appear that all of the residential lots within the old Residence A District have by the series of upgrading density changes become nonconforming with the current residential one(1) acre minimum Town Bulk Regulations. This does not make the current use and occupancy of the premises illegal or in violation of the Town of Barnstable Zoning By Laws. When the Planning Board presented the many up grading zoning changes to the residents and Town Meeting members, it was done with the assurance that pre-existing uses and structures would not be rendered illegal. The grand fathering protections of the state law played a key part in the Town's vote to adopt the more restrictive zoning regulations. We moved here in July 1962 and I still reside here. When we arrived, Mr. Fred Dumont and his wife had been long time residents on Maple Aven'.e. Mr Dumont owned and operated what was then Dumont Pharmacy on Main Street. He passed away shortly after our arrival and his widow continued residence at the same property many years later. She rented the small apartment at the rear of her property presumably for the security of having some- one near by - this was in the mid 162s. She feared leaving her house so my son rand her errands.
