Leo J. McKeon, seeks a variance at four Maple Street, Hyannis , in an RB zoning district at Map 246, Lot 148, to widen and lengthen an existing structure on the property .by adding a total of 328 sq.. ft. of living. a.rea to the rear and side of the tiui .d'iny, and to replac6 a deck c : the 'n.i_d:e of the building with an 18x2.0' addition. The petitioner was . represented by Richard S. Burling, Esquire, at the Tearing and presented the following facts . The petitioners are' ihe owners of four Maple Street , Hyannis , Massachusetts , which consists of a lot of 8,.000 sq. ft . with a single-family residence thereon. The subject property is located at the intersection of Maple Street and Seventh Avenue in Hyannis . The petitioner proposes to add additions to the building pursuant to plans submitted to the Board consisting of seven sheets showing_ I additions to the side, rear, and the replacement of a deck on the other side of the house with an 18x20 ' addition. The addition as proposed will result in an encroachment of approximately 12 ' into the required. setback from Seventh Avenue. At the present time , there exists an encroachment from an existing deck of' 8 ' from the same vantage point . The existing building has been utilized by the wife of the petitioner for many years as a summer residence . They intend to 'retire to the Cape and convert the home to a year-round residence. At the present time, the total livable. square footage of the build- ing is approximately 1, 400 sq. ft . and changes are necessitated to the house in order for the McKeons to do this . Because of the configuration of the present house , and. the existence of the location of the septic systems , it is inpussikble to locate the proposed addition in any other area. The 328 sq. The petitioner seeks a variance to further encroach into the front yard setback from Seventh Avenue by an additional 4 ' for the purpose of constructing the addition to their house. The portion of the home upon w -ii( h 'ehe addition is sought to be constructed .'i_s a slope, which, accordi,:ng to the petitioner, cannot be .utilized for any other purpo ;e. One resident came forward and indicated that she felt the addition would be more attractive and therefore more .acceptable to the neighborhood. No one spoke in opposition to the petition. DECISION Member Dexter Bliss made the following findings : 1. That the topography of the lot is somewhat unique in the neighborhood affected in that it abuts Seventh Avenue and Maple Street , and it is this configuration of the lot which leads to the basis for which the petitioner seeks relief; namely, having to comply in essence with what amounts to setback requirements from two front yards ; 2 . That the denial of the relief sought would result in a hardship to the petitioner who is unable to make any further additions to the building and utilize the same as a year-round residence because of the location of the building ' s existing sept:_ic system,; 3 .
