This petition was a request for variance relief from .the 100% contiguous
upland <--requirement, for the parcel located at 178 Marchants Mill Way, Hyannisport
in an RF-1 zoning district - the lot contains one acre, of which 27,540 square
feet is contiguous upland. On February. 6, 1986, the attorney for the petitioner,
John McCormick, appeared before the Board requesting that the petitioner be
allowed to withdraw the application for relief _without prejudice. The Chairman,
Luke Lally, after reading the letter, made. a motion to allow the petitioner to
withdraw without prejudice - the Board voted unanimously to allow the petition
to be withdrawn without prejudice..

Attorney Dwayne Landreth represented the petitioner, Dennis Knause, who has the
property under a purchase and sale agreement and is requesting variance relief
fran area and 100o contiguous upland requirements at 178 Marchants Mill Way,
Hyannisport in an RF-1 zoning district. There has been serious concern of the
suitability of this -lot for septic installation, as the lot contains 41,470
square feet, with only 24,994 being contiguous upland. This particular lot, 3 -B,
was created by an ANR Plan, indicated as two lots which the Scribner's subdivided
and said lot was recorded on January 13, 1971 - pursuant to a survey plan created
in February 1986 was the first indication of a substandard sized lot - it is not
determinable whether the difference with area size is the result of a more precise
survey or result f erosion. In 1978, by virtue of the increase to one acre and
the 70o upland,/Zich this lot does not meet that requirement, these lots merged
for purposes ofzoning and became one lot; the conveyance in lebr-dary 1984 actually
created a zoning violation. Gail Nightingale made a motion to deny the relief
sought by the petitioner - the motion was seconded by Dexter Bliss. The Board
found that the petitioner created his own hardship. To allow this would be
detrimental to the neighborhood and in derogation of the spirit and intent of the
zoning by-laws. , The Board voted unanimously to deny the variance - the petitioner
did not prove hardship, soil, shape, topography as outlined in Section 10 of
Chapter 40A.
