1.1. The applicant shall apply for a.building permit.for the'accessory.unit,:whether the,unit is new
or re existing. Before issuing an occupaney,permi and;cerfificate of compliance, the
Building Commissioner shall determine that the,unit conforms to the-approyed plans,-,as
submitted with the building'permit application and meets state building.,and fire codes. The.
Health Division shall determine that the dwelling;is in compliance with applicable.,on-site
wastewater discharge,requirements:'
12. The applicant may select his<own tenant from-the:pospe''ctive'tenantssupplied by the
Administrator of the Ready to Rent List. The,tenant must meet the.requirements:of,the
Accessory Affordable Apartment.Program. The tenant's'income.shall be reviewed and
approved by the'Growth Management Department.. The applicant shall.work with.the AAAP
Coordinator to provide necessary information"and'documentatlon of tenant income eligibility.
13. The unit shah be rented'on an'open'and fair basis to an 'income eligible individual. Whenever

to Rent List actrhinistrator:
15. Everytwelve:months the.applicant shall review the income eligibi}ity-of the AAAP unit tenant.
No.later than a yearfrom the date of issuance of this Comprehensive'Permit, the applicant
shall file with the AAAP`Coordinator,as Monitoring Agent, an annual affidavit stating the rent
charged and income of:the,unit tenant. The property owner and/or tenant shall provide the.

C. LINII`FAIO ON PROFITS
1. The Owner.agrees,to hiriit iris/her profit by^renting;the Designated,Affordable.Unit in perpetuity to a
household with w.maximum"income<of 80%or less of the Area,Nled'ian Income (AM) of 3arnstabler
Metropolitan Statistical Area;;(MSA);and that rent(including,,,41* es),shall not-exceed an:amount that is
affordable.to;a-household whose income is`80%,ofahe median income of Barnstable,MSA. In the.event that
utilities are separatelgirietered,a'util'ty.allowance,established by the Barnstable Housing Authority shall"be
deducted`from the rent.
2. The.Ownershall'annually'dehver to tlie,Munuipality and.to the. Monitoring.Agent;as designated by the
Town Manager,,proof-that the Designated Affordable Un t.isxented,the tenant's income wenttCapon,a copyof
the lease axeement and the rent char'- for the unit or un ts. Such information shall also' .... . warded to the
Monitoring.Agen.t within 30 days.of the occupation.of the dwellii g unit ox uw' ts,by'a'ne'w tenant. The,Owner
shall:notify the Monitoring Agent,as'.designated,by the Town Manager,within'thi`rty(30).daays of the date that,a'
tenant.has vacated the Designated Affordable Unit..
III MUNICIPALITY-COVENANTS;AND RESPONSIBILITIES
1: The MUNICIPALITY, through the monitoring agent designated`by the Town Manager agrees to
perform the:duties of verifying that the Designated Affordable Units being rented in perpetuity to a household
with a maximum income of 80%or less of the Area_Median Income,(AMID of Barnstable MSA and that rent
(including utilities)shall not exceed an amount thatis affordable to a household whose,income is.80%of the-
median income of Barnstable MSA...In,the_event that utilities are separately,metered,a utility allowance
established by the Barnstable.Housing Authority shall be deducted:from,the rert.

I received a phone call today from the owner, James Mullin who has a family apt at 14 Marstons Ave in Hyannis. He came
in to the office in December informing me that his daughter who resided in the apt has purchased a house and will be
vacating the apt. I told him his options, remove the apt or apply to Amnesty.
I sent out second notices for the affidavits on 3/1/11 and he was on my list. He called me this AM to say he was going to
go into Amnesty at the end of the month, he was re-doing the floors and would not be ready until then. I asked him if he
had contacted Cindy, he had not. I transferred him to Cindy. She called back to say that Mr. Mullin has no intention on
going into Amnesty. I referred this to you for enforcement.

On behalf of Mr. Bird, I have, this day, contacted Joseph D. Daluz, Building
Commissioner regarding this matter. As I explained to Mr. Daluz,'at the time
Mr. Bird purchased this property it was already being used as a two family
dwelling and in fact,-leases for both sides, already in effect, were transferred
to Mr. Bird at time of closing. It was our understanding this property fell into
the category "non-conforming use", as it has been used as a two family for years.
As I will be away until February 9, 1987, Mr. Daluz has allowed extra time in

as well as Zoning Board of Appeals records indicate that the use of that address as
anything other that a single family home is illegal.
You are hereby ordered to discontinue the use of the above-referenced property as it is
now being used and restore it to a single-family home. You are to accomplish this work
and notify this office to inspect within fourteen (14) days of receipt of this letter.

Apartment,Special Permit iri accordance•with Section 34,1(3)(D)to allow a family apartment of 550
sq.ft. within an existing single-family dwelling. The property is shown on Assessor's.Map 288'as
Parcel 197, commonly addressed 14 Marstons Ave.,Hyannis,MA,in a Residential B Zoning District.

2. According to the Assessor's record,the property before the Board is a .17-acre parcel developed with a
one-story, 3-bedroom;single-family dwelling of 1308 sq.ft, built in 195.0. The locus is one lot off`of
the intersection of Marstons and Scudder Avenues. The dwelling is served by public water and on-site
septic system.
3. ,With reference to the requirements for a family apartment,the Applicant,lias submitted orrep'esented
that the apartment and property will be maintained in accordance with Section'3-1.1(3)(D).'
4. The,family apartment,at 550 sq.ft.,is less,than fifty percent'(50%) of the total square footage of the
residential structure that is1,308 sq:ft: According to'a January-25, 2001,Mortgage Inspection Plan,

Just to let you all know, the owner of 14 Marston Ave, Hyannis came in today to inquire about the Amnesty program. He
presently has a Family Apt and his daughter has recently purchased a house and will be vacating the apt in a few months.
I gave him the Amnesty packet and Cindy's card to contact her.
He mentioned he may do"nothing" after she leaves. I quickly told him he had to get another family member in the apt, go
into amnesty or remove the apt. He kind of chuckled and left!

The applicant is seeking a 550 sq.ft. efficiency family apartment unit within the 1,300 sq.ft. dwelling. The
apartment unit is to be occupied by the-daughter and granddaughter of James Mullin. The total number
of bedrooms will remain at three. According to the applicant, he purchased the property about 18
months ago.
Procedural & Hearing Summary:'
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
August 02, 2002. A public hearing before the Zoning Board of Appeals was duly advertised and notice
sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 04, 2002,
at which time the Board found to grant the family apartment special permit.
Board members deciding this appeal were,Richard L.Boy, Ralph Copeland, Randolph Childs, Ron S.
Jansson and Daniel M. Creedon. The applicant, Mr.James Mullin represented himself before the Board.
He stated that his daughter and granddaughter would use the apartment. He also stated that he has read
and understand rules governing family apartments. Mr. Mullin stated that he would abide by the
regulations and that when vacated,the kitchen would be removed and the dwelling restored to a single-
family dwelling.
Public comment was requested and no one spoke for or against the petition.i
Findings of Fact:
` At the hearing of September 04, 2002,the Board unanimously made the following findings of fact:
1. Appeal 2002-108 is that of a family apartment request by James Mullin. He is seeking a Family
Apartment Special Permit in accordance with Section 3-1.1(3)(D)to allow a family apartment of 550
sq.ft. within an existing single-family dwelling. The property is shown on Assessor's Map 288 as
Parcel 197, commonly addressed 14 Marston Ave.,Hyannis,MA, in a Residential B Zoning District.
2. According to the Assessors record,the property before the Board is a .17-acre parcel developed with a
one-story, 3-bedroom, single-family dwelling of 1,308 sq.ft.built in 1950. The locus is one lot off of
the intersection of Marstons and Scudder Avenues. The dwelling is served by public water and on-site
septic system.
3. With reference to the requirements for a family apartment,the applicant has submitted or represented
that the apartment and property will be maintained in accordance with Section 3-1.1(3)(D).
4. The family apartment, at 550 sq.ft., is less than fifty percent (50%) of the total square footage of the
residential structure that is 1,308 sq.ft. According to a January 25, 2001,Mortgage Inspection Plan,
submitted with the application, a Land Surveyor has certified that the buildings shown on the plan do
conform to setback requirements.
5. The applicant has identified the family members to occupy the unit are a daughter and granddaughter
and occupancy of the family apartment will not exceed two (2) family members.
6. The application falls within a category specifically accepted in the ordinance for a grant of a Special
Permit.
7. After evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning
Ordinance and would not represent a substantial detriment to the public good or the neighborhood
affected.
Decision:
Based on the findings of fact, a motion was duly made and seconded to grant the family apartment special
permit with the following conditions:
1. This permit is for a family apartment of 550 sq.ft. located within the existing dwelling. It is issued to
James Mullin only and is not transferable.
2. The family apartment shall be limited to no more than 550 sq.ft. Occupancy of the unit shall be
limited to the daughter and granddaughter of the applicant. If they should vacate the unit,the
apartment use shall be removed or a new permit required identifying the family member(s) to then
occupy the unit.
3. All parking shall be located on-site.
4. The unit shall be as presented to the Board in a plan entitled"Floorplan" as prepared for James
Mullin. Prior to the occupancy of the unit,the applicant shall secure all necessary permits.
5. The apartment unit shall be maintained in accordance with all requirements of Section 3-1.1(3)(D).
6. The on-site septic system shall meet the requirements of Title 5 without variance.
7. The property shall be maintained in compliance with all applicable building, health and conservation
regulations.

Massachusetts General Laws chapter 152 requires all employ8rs to provide workers'compensation for their employees.es.
Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire,
express or implied,oral or written."
An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
rP�eiXRr nr trtee-of an individual.partnership,association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to'operate a business or to construct buildings in the commonwealth for any
applicant who has not produced-acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapter 152,§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for.the performance of public work until-acceptable evidence-of compliance with the insurance
requirements of this chapter have been presented*to the contracting authority."

2. According to the Assessor's record;the property before the Board is a .17-acre parcel developed with a
one-story, 3-bedroom,single-family dwelling of 1,308 sq.ft. built in 1950. The locus.is one lot off of
the intersection of Marston and Scudder Avenues. The dwelling is served by,public water and on-site
septic system.
3. With reference to the requirements for a family apartment,the applicant has submitted or represented
that the apartment and property will be maintained`in accordance with Section,3-1.1(3)(D).
4. The family apartment,at 550 sq.ft.,is less than fifty percent (500/6) of the total square footage of the
residential structure that is 1,308 sq.ft. Accordingto a"January 25, 2001, Mortgage Inspection Plan,
submitted with the application,a Land Surveyor has certified that the buildings shown on the plan do
conform to setback requirements.
5. The applicant has identified the family members to occupy the unit are a daughter and granddaughter
and occupancy of the family apartment will not exceed iwo (2) family members.
6. The application falls within a category specifically accepted in the ordinance for a grant of a Special
Permit.
7. After evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning
Ordinance and would not represent a substantial detriment to the public'good or the neighborhood
affected.
Decision:
Based on the findings of fact, a motion was duly made and seconded to grant the family apartment special
permit with the following conditions:
1" This permit is,for a family apartment of 550 sq.ft.located within the existing dwelling. It is issued to
James Mullin only and is not transferable..
2" The family apartment shall be limited to no more'than 550 sq.ft. Occupancy of the unit shall be
