Procedural Summary: The application was filed in the office of the Town clerk and at the Zoning Board of Appeals office on September 14, 1992. A public hearing, duly noticed under M.G.L. Chapter 40-A, was opened on October 08, 1992, at which time. the hearing was closed and a decision rendered. The petition was heard by Board Members: Gail Nightingale, Ron Jansson, Richard Boy, Luke Lally and Chairman Dexter Bliss. Mr. Andrew S. Kaski, the son of Terho A. & Kirsti E. Kaski, represented the petitioner before the Board. He explained that it was his fathers original f Decision and Notice Appeal No. 1992-58 intent for the neighboring lot to be developed as a second residence for his family. Today, Andrew Kaski would like to build that second home on this lot, but due to the increase in the required minimum lot area required in the district, a building permit will not be issued without a Variance. He presented the Board with a series of letters from abutters supporting the request. Andrew Kaski, stated that the lot would be divided according to the original 1963 subdivision plan and both lots would be 110, x 120, and contain 0.30 acres. He cited that it would be an economic hardship if he had to purchase a new lot at market rates. He noted that the current 0.60 acre lot is one of the largest in the neighborhood and that all surrounding lots are developed. Most of those lots are in the range of 0.25 to 0.33 acres. The Board chairman read the letters from Arthur B. Leaman, Ruth M. & Andrea H. McArthur, Jean Mitchell, and Mr. & Mrs. Lester D. Mason, that were presented and in support of the petition. No one spoke in opposition to the request. PP Find of Facts Based upon the evidence presented and the testimony given at the meeting of October 08, 1992, the Zoning Board of Appeals unanimously finds as follows: 1. To grant the relief sought would not derogate from the spirit and intent of the Zoning Ordinance and would not be detrimental to the neighborhood affected. 2. No one spoke in opposition to the granting of this relief. 3. Unique conditions do exist in the topography of the lot in that it is visually separate from the existing developed portion and reads to the passerby as a separate lot. 4. The lot was originally created in 1963 as a 0.30 acre buildable lot. surrounding lots are all of this same size and are developed. conclusion: Accordingly based upon the information supplied, a motion was duly made and seconded that, Appeal No .1992-58 be granted to permit the division of land as shown on Assessorls. Map and Parcel No.291/070 into two (2) lots as originally layed out in the plan titled "Subdivision Plan of Land in Barnstable (Hyannis) , Whitney & Bassett, Surveyors, and dated June of 1963, subject to the following condition. 1. An- Approval Not Required Plan (ANR) , for the lots is to be prepared and endorsed by the Planning Board. A copy of which shall be submitted to the Zoning Board of Appeals Files when endorsed. General Laws (MGL) Chapter 40A require that the Board be provided with facts which justify the granting of the relief sought. The applicant should be prepared to present the circumstances relating to soil, shape, or topography which justifies the granting of this relief and should also be prepared to substantiate that the granting of the relief will not be in detriment to the neighborhood nor derogate the intent of the Zoning Ordinance. 1 Staff Report - Appeal No. 1992-58 Bulk variance Applicants Standing: The applicant in this case is the son of the owner of the property. The applicant, should be prepared to verify the right to represent his father in this case. A letter submitted to the file, with original signatures of the property owners, certifying that the applicant is acting on his father's behalf should be presented. Certified Plot Plan: The applicant has submitted the original subdivision plan and is proposing the division to be in accordance with that plan. Assessors Records: The 1992 Assessors records show that the lots have been combined and is assessed as one developed parcel for tax purposes (see attached) . Neighboring Lot Sizes: The subject lot and the neighboring lot (#69) are 0.60 acres. They are the largest lots in the immediate surrounding neighborhood. Most of the lots within this section of Hyannis range from 0.25 to 0.33 acres. SUGGESTED CONDITIONS: ;If the Board should find to grant this request for a Bulk variance, it may ;want to consider the following condition: The Lot is to be divided in accordance with the previous 1963 approved subdivision. An Approval Not Required Plan (ANR) , endorsed by the Planning Board will be required and a copy of it shall be submitted to the Zoning Board of Appeals Files when endorsed.
