The property is shown on Assessor's Map 292,Parcel 320, addressed as 16 Masa's Place,Hyannis,MA in a Residential B Zoning District. Background&Review: The parcel at issue is a 0.23-acre lot developed with a 1-story, 994 sq.ft. 2-bedroom single-family dwelling built in 1978. The subject undersized lot was held in common ownership with an adjoining Parcel 81 of approximately 2.5-acres. The locus is zoned Residential B and the minimum lot area requirement of 1 acre was imposed February 28, 1985. In accordance with MGL Chapter 40A, Section 6, adjoining undersized lots held in common ownership would be merged 5 years from the date of the zoning change. Both of the lots were held in common ownership of Alfred H. Hutchinson and Emily G. Hutchinson. On February 04, 1986,the larger Parcel 81 was transfer to; Charles A. Hutchinson,Richard H. Hutchinson, Robert B. Hutchinson, John A. Hutchinson and Annette A. Grant. Then, on March 24, 1987, the smaller Parcel 320 was also transferred to the five siblings. On February 21, 2001, by an order of taking by eminent domain,the larger 2.5-acre parcel was acquired by the Town of Barnstable for open space. In that taking,the undersized developed Parcel 320 was left behind in the name of the five siblings. Although undersized, g g s ed, it is not a legal pre-existing nonconforming lot under zoning. The applicant seeks a variance to legitimize the undersized lot. Staff Comment: Some zoning ordinances provide relief when a government taking is involved, however, Barnstable's does not. Given the situation before the Board-a developed, undersized lot with no built-in zoning relief- not only creates a hardship but also places the applicant in a unique condition. r. F f Planning Division-Staff Report Variance Findings: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • Unique conditions exist that affect the locus but not the zoning district in which it is located, • A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the variance, staff would suggest that no conditions be imposed on the parcel. The subject undersized lot was held in common ownership with an adjoining Parcel 81 of approximately 2.5-acres. The locus is zoned Residential B and the minimum lot area requirement of 1 acre was imposed February 28, 1985. In accordance with MGL Chapter 40A, Section 6, adjoining undersized lots held in common • ownership would be merged 5 years from the date of the zoning change. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on February 06, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened July 11, 2001, at which time the Board found to grant the variance. Board Members deciding this appeal were; Gail Nightingale, Richard L. Boy, Ralph Copeland,Jeremy Gilmore and Ron S.Jansson. Charles A. Hutchinson represented the petition before the Board. He gave the background of events that lead to the situation of the undersized lots. The Board discussed whether relief was necessary. The Board issued the variance to assure the legal existence of the undersized developed lot. The Town of Barnstable through eminent domain created the need of a variance as a result of a taking of land. In doing so, it left behind an undersized lot developed with a single-family dwelling. 3. The undersized lot is a 0.23-acre lot developed with a 1-story, 994 sq.ft. 2-bedroom single-family dwelling built in 1978. The undersized lot was held in common ownership with an adjoining lot of approximately 2.5-acres that was taken for open space. 4. The situation of the applicant was created by an act of the Town of Barnstable,through no fault of the landowner. 5. This is a unique circumstance and the petitioner is entitled to a variance;the granting of which would not be of substantial detriment to the public good and would not derogate from the intent or purpose of the Zoning Ordinance.
