To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. He noted that a memorandum was submitted in support of the petition.Mr.Kenney explained the history and background of the issue before the Board. He cited, that the two lots were merged due to the common ownership of Helen M. Yabrosky from 1985 to 1990. Helen M.Yabrosky is the mother of the applicant,Barbara Butch.Both women do not live in the area and use the property on occasion. Therefore,they did not have common knowledge of the zoning mergers nor how to protect their investment. Mr.-Kenney cited that taxes have been paid over the years on both lots as buildable lots. He noted that the land is assessed at$117,800 and.$183,900 and these lots are similar in size to the lots in the neighborhood. There is no vacant land from which the applicant could add to this lot to make it conform to today's minimum area requirements of 1-acre. Mr.Kenny stated that without this relief,Lot 30 could not be used for residential purposes. Therefore,a literal enforcement of the Ordinance would produce a hardship. Due to the size and development of the neighboring lots the granting of the variance would not represent a detriment to the neighborhood and given that it must conform to current title 5 requirements it would not be a detriment to the public good. The Board and applicant discussed the level of development being proposed for the lot. Mr. Kenney noted that no firm plans have been formulated by the applicant.Nonetheless,the applicant would comply with all of the suggested staff conditions. A public hearing before the Zoning Board of Appeals was dul y advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing opened on June 21, 2006, at which time the Board found to grant the variance subject to conditions herein. Board Members deciding this appeal were, Ron S. Jansson,Jeremy Gilmore,John T.Norman,Kelly Kevin Lydon and Chairman, Gail C.Nightingale. Attorney John W.Kenney represented the applicant. He noted that a memorandum was submitted in support of the petition.Mr.Kenney explained the history and background of the issue before the Board.He cited, that the two lots were merged due to the common ownership of Helen M.Yabrosky from 1985 to 1990. Helen M. Yabrosky is the mother of the applicant,Barbara Butch.Both women do not live in the area and use the property on occasion. Therefore,they did not have common knowledge of the zoning mergers nor how to protect their investment. Mr. Kenney cited that taxes have been paid over the years on both lots as buildable lots. He noted that the land is assessed at$117,800 and$183,900 and these lots are similar in size to the lots in the neighborhood. There is no vacant land from which the applicant could add to this lot to make it conform to today's minimum area requirements of 1-acre. Mr. Kenny stated that without this relief,Lot 30 could not be used for residential purposes.Therefore, a literal enforcement of the Ordinance would produce a hardship. Due to the size and development of the neighboring lots the granting of the variance would not represent a detriment to the neighborhood and given that it must conform to current title 5 requirements it would not be a detriment to the public good. The Board and applicant discussed the level of development being proposed for the lot. Mr.Kenney noted that no firm plans have been formulated by the applicant.Nonetheless,the applicant would comply with all of the suggested staff conditions. The number of bedrooms was discussed.Ms.Nightingale cited that she would only vote to grant this variance if conditions included a provision that the on-site septic syst em would comply with all Health Division regulations without variance. Public comment was requested and the Chairman noted that four letters in support were submitted to the file. Those letters were from,Hortensia Medeiros and Angelo Medeiros of 117 Straightway,Maria M.Medeiros of 67 Melbourne Road, Curtis and Maria Pierson of 97 Straightway, and Richard Hewson and Ruth Hewson of 87 Straightway. No one spoke in.opposition to the request. Findings of Fact: At the hearing on June 21,2006, the Board unanimously made the following findings of fact: 1. Appeal number 2006-054,is Barbara Butch seeking a Variance from the Zoning Board of Appeal to Section 240-1 LE,Bulk Regulation,Minimum Lot Area of the Zoning Ordinance. The issue is a merger of undersized adjoining lots held in common ownership. The subject lots are addressed 107 Straightway and 104 Melbourne Road,Hyannis MA. Fair market value was paid for the lots.and taxed accordingly over the years.Both parcels are taxed as buildable lots. 6. The 107 Straightway lot is developed with a three bedroom single-family dwelling and 104 Melbourne Road lot is vacant. There is no excess land to add to the existing lot to make it conform to the minimum lot area of one acre. 7. If this variance is not granted,the applicant could not develop the lot and use it for what it was created and zoned for. Most other lots in the neighborhood are approximately 10,000 sqft. and developed. Therefore,the relief may granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings,of fact,a motion was duly made and seconded to grant the Variance with the following conditions: 1.
