Petitioner: Laurie A. Warren Property Address: .976 Phinneys Lane(soon to be readdressed 21 Midway Drive), Hyannis, MA Assessor's Map/Parcel: Map 251, Parcel 222 Zoning: Residence C-1 Zoning District Relief Requested & Background: In this petition for a variance, the applicant is proposing to reconfigure an existing non-conforming buildbale lot. The existing lot is approximately 88 feet wide by 1,866 feet deep (3.76+/-acres) and fronts approximately 90 feet on Phinneys Lane and 250 feet on Midway Drive in Hyannis. The applicant seeks to-segment off the northerly area of the lot creating a new lormeasuring 87.9-feet wide by 477.50 feet deep (47,298 sq.ft. or 1.09-acre) fronting on Phinneys Lane and Midway Drive. The subject locus is zoned Residence C-1. The minimum lot area is 43,560 sq.ft. (one-acre) and the minimum lot frontage is 125 feet. The proposed new lot.meets those requirements. However, the.lot configuration cannot conform to the required lot shape factor of 22 or-less as required under Section 240-7(D) Lot Shape Factor Residential District. The resulting new lot would have,a shape factor of 33.21. The petitioner seeks a variance to the.lot shape factor in order to allow for the adjustment!of the developable lot. q With respect to the remaining area of the lot, the plan submitted shows a division of that area into 25 smaller lots ranging in area from 2,745 sq.ft. to 6,930`sq.ft. All of the 25 lots are land Locked, divided and correspond to abutting lot'lines. The intent being, to offer those lots for sale or transfer to the abutting lot owners. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's office and at the office of the Zoning Board of Appeals on November_ 08, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened January 3, 2007, at which time the Board found to grant the:variance to Lot A on the plan only subject to conditions herein. Board Members deciding this appeal were, Randolph Childs, Daniel M. Creedon.,James R. Hatfield, Ron S.Jansson, and Chairman, Gail C. Nightingale. 1 Variance 2007-003-Warren Attorney Bernard T. Kilroy represented the applicant at the hearing. Mr. Kilroy cited that a memorandum in support of the grant of the variance had been submitted. He noted that the lot, as it now exists, is a legally created nonconforming lot that is buildable as it stands. He stated that a building permit had been issued to the locus and a single-family dwelling is under construction on it. Attorney Kilroy cited that the lot dates back.to an 1845 deed from Augustus Crocker, et al, to Charles Lewis recorded at the Barnstable Registry of Deeds in Book 37,-page 97. The property remained in ,separate ownership since that recording and has not been altered. That fact establishes the lot as a legal, pre-existing, nonconforming lot and is considered buildable under the zoning ordinance. The only nonconformity is the lot shape factor. He noted that a plan of the lot was recorded in 1972 with an Approval Not Required perimeter plan of the lot designating a 207foot wide by 366-foot long water easement to the easterly side or the property. That plan was recorded in Plan Book 270 page 78. In late June of 2006, a building permit was issued as-of-right by the Building Division for the construction of a single-family dwelling on the lot. The dwelling is to be a three-bedroom, 1,728 sq.ft., 1.5 story structure. With respect to the variance conditions, Attorney Kilroy cited the unusual shape of the lot and the impracticality of using this 1,866 foot deep lot.. He noted that the lot shape factor that now exists exceeds the limitation of 22. The proposed new lot would conform to the minimum lot area requirements, the frontage requirement, and would not, therefore, present a detriment to the. neighborhood. He cited that most surrounding lots range from 1/3 to A of an acre in size. The Board and Attorney Kilroy discussed the nature of the relief and noted that the granting of this , variance would not create any new buildable lot(s). The only effect would be the alteration of an existing nonconformance in lot shape. Effectively, this is'a change in a pre-existing, legally created nonconformity. However, the Board acknowledged that this could only be accomplished under the ordinance by a variance. Public comment was requested. Robert W. Drake of 177 Bishops Terrace posed several question and noted that many of the abutters to this lot have been using the land for a number of years. Edward Gagnon of 2 Longview Drive-stated that he was in opposition to the granting of the relief. Michael Fredericks of 68 Longview.Drive stated the he would favor the grant of the relief provided the abutters would be offered the opportunity to secure the excess land area abutting the ir'property. Mr. Paul Lebel also spoke in favor of the granting of the relief. Findings of Fact: At the hearing of January 3, 2007 a motion.was duly made and seconded to the following findings of fact: - 1. Appeal 2007-003 is that of-Laurie A. Warren seeking a variance to Section 240-7(D) Lot Shape Factor in a Residential District to allow for the adjustment of an existing buildable lot that would result in a lot shape factor of 33.21. That factor exceeding the maximum of 22 that is allowed in the ordinance. The property is addressed as 976 Phinneys Lane, Hyannis, MA. The lot is shown on Assessor's-Map 251 as Parcel.222. 2. It is in a Residence C-1 zoning district. That zoning district now requires a minimum'lot area of one-acre of upland and a lot frontage of 150 feet. The proposed reconfigured lot meets those 2 ., Variance 2007-003-Warren minimums; however, it does not comply with'the lot shape factor requirement of Section 240-7(D) applicable in all residential zoning districts: 3. The relief is-being sought for one lot only. No relief is sought for the other 25 Lots to be created as those lots are undersized and landlocked. They are'not independently developable lots.= 4. The existing lot dates to 1845 when the property was conveyed by Augustus Crocker et al to Charles Lewis by deed dated December 1, 1845 and recorded in Book,37, page 97. The lot has not changed since that date. It predates zoning and has remained a separate lot from that time to present. That existing lot does not meet the requirements of lot shape factor. This is a nonconformity that predated the adoption of the lot shape factor requirement. The proposed reconfigured lot still cannot meet that lot shape factor requirement: 5. The hardship is found by that shape of the existing lot and the fact that excess.and`unusable land exists. The long narrow shape'creates a situation.in which the far end of the lot cannot be used with the proposed developed portion of it. 6. The adjusting of this lot to a one-acre lotwould not be in derogationto the neighborhood as the resulting lot is still larger than most surrounding lots. Granting of the variance would not be in derogation of zoning as it creates no new buildable lot(s). The.vote was as follows: AYE: Daniel M. She cited that it just is going to give him the ability to use all the other little lots,,and that is not variance conditions.` : Decision: Based on the findings of.;fact, a motion was duly made and seconded'to grant the variance subject to the following conditions: 1. The lot shall be divided as proposed and submitted to.the Board in a plan entitled "Plan of Land,in Barnstable (Centerville) for Betsy T. Newell, Trustee East Precinct Nominee Trust"clated December 9, 2006 as drawn by Edward E. Kelly. The title of this plan shall be corrected to reflect Hyannis._ and not Centerville as the locus. 2.' The relief granted is only to the.proposed 47,298 sq.ft. Lot A�as shown on that plan. ' 3. This relief is subject to the Planning Board's endorsement ofz}the Approval Not Required (AN�R) Plan: 4.
