The property that is the subject of this appeal consists of a 28,462 sq. ft. parcel commonly addressed as
400 Mitchell's Way, Hyannis. The site is improved with a single-family residential dwelling.
The applicants recently sold 30 feet of frontage to the adjacent lot to the west The sale of this land
creates a more nonconforming lot. The minimum lot area required in the RB District is one acre. The sale
of this frontage has reduced the area by about 5%, from 30,000 sq. ft. to 28,462 sq. ft. The adjacent lot to
the west, also nonconforming with regard to lot size, has increased in area from 13,882 sq. ft. to
approximately 15,420 sq.ft. This lot is also developed with a single-family residential dwelling.
The applicant is applying for a Special Permit pursuant to Section 4-4.2, Nonconforming Lots, to legitimize
the increased nonconformity of the subject lot due to the sale of a portion of it to the abutting neighbor.
Section 4-4.2(5), Merged Lots, states:
"No lot, or portion thereof, may be changed or transferred in any manner that will increase the
degree of nonconformity unless a special permit has first been obtained from the Zoning Board of
Appeals. No such special permit may create any additional buildable lot(s)."
Procedural Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
August 5, 1998. A 60 day extension of time for holding the hearing and for filing'of the decision was
executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of
Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The
hearing was opened October 7, 1998, at which time the Board granted the request with conditions.
Hearing Summary:
Board Members hearing this appeal were Ron Jansson, Gail Nightingale, Richard Boy, David Rice, and
Chairman Emmett Glynn. John Rosario represented himself before the Board.
Mr. Rosario reported his house is part of a subdivision created in 1960. He built his house on two lots
making it one of the bigger parcels in the neighborhood. He has been allowing his immediate abutter to
use a portion of his land for a driveway for the past 30 years. Recently, she offered to buy that triangular

piece of property that she has been using. The lot is nonconforming as to size and by"carving off this
small triangle the lot becomes more nonconforming which is why the applicant is seeking a Special
Permit. A proposed Approval Not Required (ANR) Plan was submitted. The locus was 30,000 sq.ft. and
will become 28,462 sq.ft. The abutting parcel was 13,882 sq.ft. and will become 15,419 sq.ft. Mr. Rosario
indicated the granting of the requested relief would not represent a substantial detriment to the public
good or the neighborhood affected because this is(and will remain)one of the biggest lots in the area.
For clarification, Mr. Rosario stated that although he owns the two lots, the house is on one lot and the
garage is on the other lot so he does not plan on selling that second lot There are three cesspools on
this lot that accommodate his house.
Public Comment: No one spoke in favor or in opposition to this appeal.
Findings of Fact:
At the Hearing of October 7, 1998, the Board unanimously found the following findings of fact as related to
Appeal No. 1998-114:
1. The applicants are John and Hilda Rosario with a property address of 400 Mitchell's Way, Hyannis,
MA as shown on Assessor's Map 291, Parcel 025. The site is located in the RB Residential B Zoning
District, and the WP Well Protection Overlay District. -
2. The property that is the subject of this appeal consists of a 28,462 sq. ft. parcel and is improved with a
'single-family residential dwelling.
3. The applicant is seeking a Special Permit pursuant to Section 4-4.2 Nonconforming Lots.
4. The applicant is proposing to sell 30 feet of frontage to the adjacent lot to the west. The sale of this
land creates a more nonconforming lot. The minimum lot area required in the RB Residential B
Zoning District is one acre. The sale of this frontage will reduce the area by about 5%, from 30,000
sq. ft. to 28,462 sq. ft. The adjacent lot to the west, also nonconforming with regard to lot size, will
increase in area from 13,882 sq. ft. to approximately 15,420 sq. ft. The abutting lot is also developed
with a single-family residential dwelling which is under construction.
5. The applicant is applying for a Special Permit pursuant to Section 4-4.2, Nonconforming Lots, to
legitimize the increased nonconformity of the subject lot due to the sale of a portion of it to the
abutting neighbor.
6. The relief may be granted because the application falls within a category specifically accepted in the
ordinance for a grant of a Special Permit and after evaluation of all the evidence presented, the
proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial
detriment to the public good or the neighborhood affected.
Decision:
Based upon the findings a motion was duly made and seconded to grant the Applicant the relief being
sought in Appeal No. 1998-114 with the following terms and conditions:
1. The lot shall be divided as shown on the proposed Approval Not Required (ANR) Plan presented to
the Board and titled"Plan of Land in Hyannis, MA for Adrin M.S.Piper, dated 09-23-98, drawn by All
Cape Engineering."
2. The ANR Plan, to be approved by the Planning Board, shall reference this decision of the Board and
both the plan and decision shall be recorded at the same time.
3. The locus shall comply with all requirements of the Board of Health.
4. There shall be no further subdivision of the subject property.

Staff Review:
Most of the lots in this area of Town are nonconforming with regard to lot size and have been developed
with single-family residential dwellings. The property was subdivided prior to the adoption of Subdivision
Rules and Regulations. In August of 1985, the previous owner of the adjacent lot to the west, applied for
a Variance from the minimum lot size and width requirements(Appeal No. 1985-108). According to that
application, the land was subdivided May 12 of 1960; having been approved by the Board of Selectmen.
The property was originally zoned RA-1 in 1956, which had a minimum lot size requirement of 7,500 sq. ft.
In 1972, the property was rezoned to an RB Zoning District to increase the minimum lot area requirement

to 10,000 sq. ft. (ATM 4/5/72,Art. 126). Finally, in February of 1985, the minimum lot area was increased
to one acre(STM 2/28/85, Art. 1).
The sale of a portion of the subject site does not affect other bulk regulations of the Zoning Ordinance.
Both parcels conform to the minimum frontage, width, and setback requirements. However, the applicant
should be aware that the reduction in lot area from 30,000 sq. ft. to 28,462 sq. ft. may affect the number of
bedrooms permitted on this site. The property is located within a WP Well Protection Overlay District and
is served by a private septic system. The Town's General Ordinances and Title V of the State
Environmental Code(310 CMR 15.00) limit the amount of wastewater discharge and the amount of
nitrogen loading allowed within zones of contribution to public water supply wells. Nitrogen loading is
based upon the number of bedrooms on the property and the size of the lot. Without a variance from the
Board of Health, Title V allows 3 bedrooms for two-thirds of an acre(30,000 sq. ft.) and only 2 bedrooms
on lots between a half to two-thirds of an acre(20,000 to 30,000 sq. ft.); based on one acre equaling
40,000 sq. ft.
According to the Health Division, there are no septic system records for this property which probably
means that a cesspool exists. If at some future time the owner or subsequent owner wishes to upgrade
the property, requiring a building permit or disposal works construction permit, the property would be
required to be brought into conformance with current regulations.
Special Permit Findings:
The granting of a Special Permit requires the following finding of facts to be made by the Board (as
required under Section 5-3.3(2)):
• that the application falls within a category specifically excepted in the ordinance for a grant of a
Special Permit, (Special Permit pursuant to Section 4-4.2(5) -allows for the creation of a more
nonconforming lot with regard to lot size), and,
• that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the
Zoning Ordinance and would not represent a substantial detriment to the public good or the
neighborhood affected.
Suggested Conditions:
If the Board should find to grant the requested Special Permit, they may wish to consider the following
conditions:
1. The lot shall be divided as shown of the proposed Approval Not Required (ANR) Plan presented to
the Board and titled "Plan of Land in Hyannis, MA for Adrin M.S.Piper, dated 09-23-98, drawn by All
Cape Engineering."
2. The ANR Plan, to be approved by the Planning Board, shall reference this decision of the Board and
both the plan and decision shall be recorded at the same time.
