The owners through there builder have applied for a building permit to raise and replace the existing dwelling on the property. We have been asked to give our opinion as to the buildability of the lot, as the owners have a pending building permit on file with your office, for which they have been told cannot be issued until a determination has been made as to whether the lot is in fact buildable. T The town assessing records reveal that the existing dwelling was constructed in in 1952 (see assessors filed card attached). The dwelling does not have any direct frontage on the roadway, however gains its legal access from a right-of-way over 41 Mount Vernon Avenue (see plan of Record dated 1950), t In order to make this determination we reviewed Section 240,91, H•(1) (a) through (c) of the Zoning ordinance, which sets for the requirements for an As-of-right demolition and rebuild on a preexisting non-conforming lot, In order to qualify under 240-91(1), two things must be satisfied. First, the lot must be a preexisting legal nonconforming lot; and second, the lot must also contain_ over 10,000 sq ft of contiguous upland: Preexisting lejzal nonconforming lot The subject lot, when built upon was in fact conforming. In our case we have a dwelling i which is located in the RF1 Zoning District. The lot was created on a 1950 subdivision plan and the dwelling was constructed in 1952 (see assessors field card.attached). The dwelling is shown on the 1950 Plan of record as well and it is believed the dwelling was constructed around the time of the plan (see attached 1950 Plan of Record). At that time there was no required frontage requirement in the RF1 District. In was not until 19.83, some 33 years after the dwelling was constructed that a frontage requirement was established in the district (see attached Zoning Ordinance 1983). As a result the lot is a preexisting legal nonconforming lot. Lot must also contain over 10,000 sq ft of contiguous upland Secondly, that the lot contains a minimum of 10,000 sq ft of contiguous upland, which it does. The lot when established consisted of 13,200 sq ft, all of which is upland, which- exceeded the required 10,000 sq ft minimum. In 2000, a small portion of an abutting lot (lot 12) on Land Court Plan 20173 F was acquired and added to the lot giving it a new total of 18,182 sq ft (see attached Site Plan prepared by Sullivan Engineering). In this case the additional square footage added by Lot 12 was not needed to establish the 10,000 sq ft of contiguous upland requirement (as the lot already had 13,200 sq ft). Its addition only made the lot more conforming than previously existed, a a If the lot meets the requirements set forth above, a proposed demolition and rebuilding shall be permitted as-of-right, provided that the Building Commissioner determines that. all of the criteria are met; (a) The proposed new structure conforms to all current use and setback requirements of the zoning district it is located in; The proposed new replacement dwelling will conform to all current use and setback requirements of the zoning_district (see Site Plan attached prepared by Sullivan Engineering). (b) The proposed construction conforms to the following requirements of lot coverage, floor area ratio and building height: [1] Lot coverage by all buildings and ali structures shall not exceed 20% or the existing lot coverage, whichever'is greater; [2] .The floor area ratio shall not exceed 0.30 or the existing floor area ratio of the structure being demolished and rebuilt, whichever is greater; and [3] The building height, in feet, shall not exceed 30 feet to the highest plate,and shall contain no more than 1/2 stories. The building height, in feet, shall be. defined as the vertical distance from the average grade plane to plate. The proposed construction conforms to the requirements of lot coverage, floor area ratio and building height: The proposed lot coverage is 14.3%,where a maximum of 20% is allowed. The floor area ration (including full basement, first and'second floor, but excluding garage) is 4,352 SF or 23.9% where a maximum of 30% is allowed. The building height will be less than 30 ft and shall contain less than 2 '/2' stories. (c) Further expansion of the rebuilt°structure must conform to Subsection H(1)(b) above, Therefore, it is my opinion that all the requirements of Section 240.91, H.(1) (a) through (c) have been met and a building permit can be issued.
