Additionally,MGL chapter 152, §25C(7)states`Neither the commonwealth nor any of its political subdivisions shall enter into any contract for.the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented'to the contracting authority." In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. Board of Health Hyannis, MA 02601 RE: RENTAL OF RESIDENCE AT 83 MULBERRY STREET, HYANNIS We, the undersigned, wish to petition the Board of Health and the Building Department to refuse to issue to ANH NGUYEN of Charlestown, MA, either a temporary permit or certificate to rent and/or lease seasonally for dwelling purpose for the residence located at 83 Mulberry Street in Hyannis. During the summer 1988, when Anh Nguyen rented the residence at 83 Mulberry Street to an unspecified number of persons, the following violations were observed by neighbors and reported to the owner. o The renters repeatedly violated Article XXI, Anti Noise Regulation, of the Town of Barnstable. Several calls were made by neighbors and responded to by the Barnstable Police Department. The owner, Anh Nguyen was notified of violation several times by neighbors. She responded by saying that she did not live there and could not control what went on at all times.. o The owner violated Section 3-1.1, 2A, Renting of rooms to not more than three (3) non-family members by the family residing in single-family dwelling in an RB zone. Neighbors were told repeatedly by Anh Nguyen that she was living in the house and was renting to six persons. However, neighbors were told by some of the persons renting that there were ten (10) persons renting and it was "tight quarters for the $90 per week" that each renter was paying. o The owner violated Regulation 4-2.7, Schedule of Off-Street Parking Requirements of the Building Department which requires 1.2 parking stalls per bedroom. There is one, single-width driveway which could accommodate three cars maximum. if they were closely parked one behind .the other. Cars were continuously parked in the road, often on both sides, on neighbor's property causing damage and making passage along Mulberry Street.difficult. r The owner repeatedly contradicted herself by saying she lived at 83 Mulberry and would take care of any problems that arose and that she did not live in the house and could not control everything that happened there. During the summer 1988, the violations created a less-than-ideal situation in the neighborhood. During the summer 1989, the following violations were observed and reported to appropriate Town of Barnstable department personnel including Board of Selectmen, Building Department and Board of Health. No satisfaction was received in pursuing resolution to the infractions. o Tenants repeatedly violated Article XXI,. Anti Noise Regulation, of the Town of Barnstable. Numerous calls were made and responded to by the Barnstable Police Department. One particular incident began about 2:00 a.m. and was not resolved for at least two hours. The neighborhood was woken from sleep by the cars :'convoying" on Mulberry and neighboring streets and by the party-goers walking and socializing on Mulberry. Neighbors estimated 200 people coming and going from the house at 83 Mulberry. Street. Many of the vehicle occupants rudely and maliciously caused damage to neighbors' property and grounds. Driveways were blocked, cans and bottles were strewn up and down the street and there were several incidence of persons urinating on lawns and shrubs. The police responded quickly but were soon summoned again when the crowds returned when the "coast was clear. " o As in 1988, the owner violated Section 3-1.1, 2A, Renting of rooms to not more than three (3) non-family members by the family residing in single-family dwelling in an. RB zone, and Regulation 4-2.7, Schedule of Off-Street Parking Requirements of the Town of Barnstable Building Department, requiring 1.2 parking stalls per bedroom. . Neighbors were told by renters that one of the bedrooms downstairs was locked and not available for the use of renters because it was the owner's room for when she visited. Her application for certificate (#295-89) filed on May 18, 1989, requested tenants numbering 11. She was automatically issued a temporary certificate and the house was inspected that day. On May 30, 1989, a complaint was made concerning 83 Mulberry and an inspection was made. The attached inspector's report dated May 30, 1989, directed that a certificate be denied until the parking violation was corrected. The violation was not corrected. Anh Nguyen told neighbors there were only six renters in the house and she was "legal. " One of the renters told a neighbor there were nine persons renting. It was obvious from the number of vehicles (often 9 or 10) parked in the driveway, on the street, and in front of neighbors' homes that there were more renters living in the house than permitted by Section 3-1-1, 2A. Phone calls were placed to the owner of the house at her Charlestown residence notifying her of the disturbances caused by her renters, including noise at night, excessive speed when driving in the neighborhood, and driving on neighbor's property. She was also notified in person when she visited on week-end days. According to Section 4-3 of Article 14 regarding inspections, when the deficiencies were not corrected, the owner was renting without proper certificate. In conclusion, we consider Anh Nguyen to be running a seasonal rooming house at 83 Mulberry Street. We feel there is sufficient cause to refuse a temporary permit or certificate for the summer of 1990 and in the future unless the property is reinspected and the owner abides by the regulations of the-Board of Health and the Building Department.
