Ellen S. —Citizen's Resource Line RE: Complaint 90 Mulberry Street, Hyannis Owners Santricia Walker& Petrice Watson CALLER: Barbara and Arthur Quelle of 83 Mulberry Street, Hyannis 508-771-2401 • Call came in to the Citizen's Resource Line over the weekend. Called back on Monday, spoke with Barbara and Arthur-Quelle who live at 83 Mulberry Street. They were mostly registering a complaint about 78 Mulberry Street,(see file) and also mentioned possibility of the use of 90 Mulberry Street as a multi family. The Quelles stated, and the file for this address does indicate, that the Quelles and - another neighbor had complained in the past about 20 people living at this address and work to finish the basement without permits. A realtor had advertised that the basement was finished. There were no building.permits indicating this. • The file indicates that letters were sent from the Town in 2006 informing the owner to restore to single family, apply for amnesty program, or prove that the . multi-family was legal. A cease and desist order ended up being issued for them not to use the basement. • The property was foreclosed in 2007 and the file does not indicate that any of the above remedies were used back then or since. There are no building permits in the file and this is not an amnesty apartment. • Caller stated that although there are not 20 people living there now.as before, it still seems like the new owners may have more than one family living there. • It should be noted that the e ownership is in two different seemingly unrelated names. It is perceivable that each owner has a family that is legally living there together. • However, not sure about if or how the basement space is presently being used. Although you advised me that no one is currently living in the basement, the un-permitted renovations coupled with the layout,equipment and utilities certainly defines the area as an independent living unit. Upon inspection,I informed you that there appears to be egress issues with regards to the sleeping quarters in the basement. This caused me concern and I informed you that it is unsafe for occupants to sleep downstairs as configured. I explained the reasons accordingly and you noted that you not only understood the issue but assured me that no one would sleep here again. Subsequently,you reminded me that the property is currently for sale. I requested that you advise potential owners to see me regarding the use of the basement,which is currently limited to your own personal use. As stated above,this unit is not a legal independent dwelling unit nor can it be used as additional sleeping quarters but a new owner may seek to legitimize the unit through our Amnesty Program or Family Apartment registration process. At the conclusion of our discussion,I repeated that the legal use of this property is that of a single-family. As a result,you identified yourself, spouse, child, and one couple as occupants of the three bedrooms in the primary residence (reserving the basement for entertainment). You also identified your devotion to youth ministries in affiliation with a local church and indicated that visitors seeking your assistance leave their vehicles at that facility. Since no permits for this work were ever pulled, I'd guess that the result is illegal This address regularly has 6 to 8 cars parked over there and they have basically turned a small ranch into a boarding house. As I understand it, this is exactly the issue that is before the town council at the moment.
