The lot is developed with a 1.5 story single-family residence of 1,293 sq.ft. of livable area. The dwelling was built in 1988 and has 2 bedrooms and 1.5 bathrooms. The applicant is seeking to add a 9 foot by 20 foot addition to the west side of the structure for a new bathroom and closet area. A small out door deck is also being proposed. The proposed addition is located 24.9 feet from the right-of-way of Newspaper Road.: A variance from the district's bulk regulations, front yard setback would be required to implement the plan as proposed. The variance would be for 5.1 feet from the required 30 foot front yard'setback. The proposal appears to meet all other zoning requirements. Newspaper Road is a private road, approximately 300 feet in length and 40 feet wide. It was created in 1969 by Subdivision No.-132, and services only three lots. ' Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 18, 2000. A public hearing beforethe Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The.hearing was opened on May 24, 2000 at which time the Board granted the Special Permit requested. Hearing Summary: Board Members hearing this appeal were Gail.Nightingale, Richard Boy,`Gene Burman, and Chairman Ron Jansson. Rita M. Thornton represented herself before the Board. Upon opening this appeal, Chairman Ron S. Jansson explained that there are only four Board Members present tonight who can hear and vote on this appeal: Under MGL Chapter 40A, a positive vote-of at least four out of a five memberboard is needed to grant the relief being sought. The applicant was given the opportunity to ha'e her appeal heard this evening by only four Board Members, or the option of asking.for a continuance to a date when five members will be present. 'Ms. Thornton elected to;proceed with a four member,board. Ms. Thornton submitted a signed certified plot plan: Ms. Thornton explained her proposal to the Board. The home is located on a private road with only three houses. They own part of the road. She is seeking to add a 9 x 20 addition to the side of the house but Town of Barnstable-Zoning Board of Appeals-Decision and Notice Thornton-Appeal Number 2000-41 Variance-Section 3-1.4(5)Bulk Regulations-front Yard Setback she must comply with the front yard setback because of the usual way the house is situated on the lot. The interior of the house is so constructed so that the addition must be placed where they are proposing it be located. The addition can not be moved forward or move to the back further than proposed as many big fir trees would have to be destroyed. The house can not be seen from the road. The applicant showed photographs of the house and its location on the street. Ms. Thornton indicated she spoke to her neighbors and no one voiced any objection. The abutter most affected by the addition told her they have no objection. Public Comment: No one spoke in favor or in opposition to this appeal. Due to the unique situation of the street, which,stops between her front yard and side yard, the Board questioned if she did in fact need relief as the addition may actually be entirely within the side yard setback. But to alleviate any confusion, the Board proceeded assuming she needed relief from the front yard setback. Findings of Fact: At the hearing of May 24, 2000, the Board unanimously found the following findings of fact as related to Appeal Number 2000-41: 1. The applicant, Rita M. Thornton, is seeking a Variance to Section 3-1.4(5) Bulk Regulations- Front Yard Setback. 2. The property address is 20 Newspaper Road, Centerville, MA, as shown on Assessor's Map 253, Parcel 012.002 and located in the RCA Residential C-1,Zoning District and the GP Groundwater Protection Overlay District. 3. The applicant is seeking to add a 9' x 20' addition to the west side of the structure which will be is located 24.9 feet from the right-of-way of Newspaper Road. There is a question as to whether or not the relief is needed. 4. Pursuant to MGL Chapter 40A, Section 10, there is a slope to the property which is a topographical feature unique to the site. Due to the way the structure is laid out on the site, there is no other way of placing the addition on the site without expending a substantial amount of money. There would be a hardship to the petitioner if she were forced to remove many large trees on the property. 5. The relief may be granted without substantial detriment to the public good or neighborhood affected and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in Appeal Number 2000-41 subject to the following terms and conditions: 1. The addition shall be as represented to the Board and as shown on a plan entitled " Certified Plot Plan (Showing Proposed Addition) Prepared for Rita Thornton" dated May 8, 2000, drawn by Down Cape Engineering, Inc., signed by Arne H. Ojala. 2. This is a Variance for a one story addition only. There shall be no living area above the first floor of the addition. The vote was as follows: AYE: Gene Burman, Gail Nightingale, Richard Boy, and Chairman Ron S. A variance from the district's bulk regulations, front yard setback would be required to implement the plan as proposed. Newspaper Road is a private road, approximately 300 feet in length and 40 feet wide. .It was created in 1969 by Subdivision No. 132, and services only three lots. Staff assumes the addition to be one-story because only one level was submitted on the floor plans. Variance Findings: In consideration for the Variances, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the requested Variances, they may wish to consider the following conditions: 1.
