(the "Applicant") Dear Mr. Perry: This firm represents the Applicant in connection with the replacement of an existing, building-mounted lattice tower on the Property (the "Existing Structure") with a fiberglass pole and a 5' x 6 1/2" in diameter canister containing concealed telecommunications antennas, together with the addition of radio equipment on the roof of the building (the "Installation"). The Property is located in a HB — Highway Business zoning district. As set forth more particularly below, the Existing Structure is legally.non- conforming and under Section 4-4.4 of the Ordinance, the Applicant's proposed Installation is permitted by right. A. Background The Applicant is licensed by the Federal Communications Commission to construct and operate a wireless telecommunications network in various markets throughout the country, including the Commonwealth of Massachusetts and in particular in the Town of Hyannis. A copy of the Applicant's FCC license is attached hereto. The Applicant is in the process of designing and constructing a telecommunications system to serve all of the Commonwealth of Massachusetts. One of the key design objectives of its systems is to provide seamless coverage. Such a system requires a grid of radio transmitting and receiving links located approximately .5 to 2 miles apart, depending on the location of existing and proposed installations in the surrounding area, the existing use of the network and the existing topography. The radio transmitting and receiving facilities operate on a line-of-sight basis, requiring a clear path from the facility to the user on the ground. This dynamic requires the antennas to be located above the tree line, and in a location where PRINCE . RF Coverage Determination The Applicant has performed a study of radio frequency (sometimes "RF") coverage for the Town of Hyannis and from the Property, the results of which are shown on the coverage maps submitted herewith. The Applicant has determined that a telecommunications facility located on the Property will provide adequate coverage to the targeted sections of the Town of Hyannis and the immediately surrounding area if the Applicant's antennas are located at the requested height of 47 feet (centerline of the antennas). In connection herewith, the Applicant has submitted radio frequency propagation maps, which show its current coverage and the gap in coverage that the proposed site will fill, and a radio frequency propagation map showing the anticipated coverage from the site. C. The Facility The Applicant proposes to mount its antennas in the proposed canister at the"top of the replacement fiberglass pole. The total height of the proposed Installation (fiberglass pole and canister) is 50'. In order to minimize any visual impacts on the surrounding area, the Applicant has designed the Installation so that (i) the antennas will be concealed within the canister; and (ii) the canister will be only 6 '/2" in diameter, minimizing its profile, all as depicted on the Plans. As a result, the Installation will improve the appearance of the building. The Installation will have no other impact on the neighborhood or the environment. It will operate in compliance with all applicable regulations, including FCC guidelines for radio frequency emissions. The Installation requires no employees and no sewage or waste disposal facilities. In addition, the site will generate no traffic except an occasional truck for routine maintenance of the equipment. D. Request for Building Permit The Applicant hereby requests the issuance of a building permit pursuant to Section 44.4 1)B of the Ordinance.. : Non-conforming Building or Structure Not Used as Single or Two-Family Dwellings: 1. As of Right: A. The normal and customary repair and maintenance of a pre-existing nonconforming building or structure not used as a single or two-family dwelling is permitted as " of right. The alteration and expansion of a pre-existing nonconforming building or structure, housing a conforming use, is permitted as of right, provided that the alteration or expansion does not increase or intensify . the degree of the pre-existing nonconformity of the building or structure, and that the alteration or expansion conforms in all other respects with all applicable requirements of the Zoning Ordinance. The neighborhood is already impacted by the Existing Structure. The replacement of it within the fiberglass pole and canister will not increase or intensify the degree of the preexisting non-conformity and is not substantially more detrimental to the neighborhood than the Existing Structure. In fact, the removal of the Existing Structure and whip antenna will decrease the overall height of the structure by 15'. After construction, the proposed Installation will only require periodic short-term visits (approximately 1-2 visits per month) by the Applicant's technicians. The Installation will not require long-term parking and will not cause any measurable increase in traffic (pedestrian or vehicular) flows at the subject Property. The proposed Installation will not create any excess noise, vibration, dust, heat, smoke, fumes, odor, glare or other nuisance. The Installation is a passive use and will not be measurably different than the existing use on the Property. Water, sewerage and drainage facilities are unnecessary. As set forth in more detail below, the proposed facility will have minimal impact upon the scale, character and visual effects of and from the building and with respect to the neighborhood. Under section 4-8 of the Ordinance, wireless communications facilities are permitted in all zoning districts. The Applicant's substitution of the dimensionally nonconforming Existing Structure with the Installation for its attachment of wireless communications antennas is consistent with the general purposes of the Ordinance. The Ordinance encourages the use of existing structures over the construction of new ground-mounted facilities for wireless communications installations. The substitution of the Existing Structure with the proposed Installation is consistent with the goals of the Ordinance and otherwise fully conforms with its requirements. Moreover, the Applicant has proposed a design that will minimize the aesthetic impact of the antennas as well as the impact of the radio equipment within the building. Consequently, the Applicant believes that its proposal is in harmony with the purposes and intent of the Ordinance. Absent a grant of building permit for this facility, the Applicant will need to construct a ground-mounted facility of comparable height to fill its radio frequency coverage objectives in this area of Hyannis.
