As you are aware,the property is currently in violation of both State Building Codes and the Town of Barnstable Zoning Ordinance and as discussed on the phone,you need a plan to bring the property into compliance. Your letter does not clearly state a plan to achieve this objective. You need to identify one path of compliance and then proceed to execute said plan. In the spirit of cooperation and your expressed interest to resolve the violations,the timeline for compliance shall be extended to March 13, 2018. Please be advised; however, failure to either obtain a building permit or apply for a variance by the above date will result in this office to pursue legal action to fullest extent as allowed by law. I 's i BUILDING DEPT FEB 15 2018 February 12, 2018 TOWN OF BARNSTABLE Dear Jeff, Thank you for taking the time to speak with us about 21 Nob Hill Road in Hyannisport. We purchased the house in September of 2017. You asked us to send you a letter describing the timeline of events related to the screen porch that has transpired since then. As we mentioned on the phone we are absolutely appalled about this. We now know that we should have done things differently but didn't think to question what the builder told us. Particularly because he was from the Cape and he had highly recommended by a friend. This is not our primary residence and we haven't moved in yet. We hired John Fleury (Bud the Builder) to build a screen porch on the existing bluestone terrace off the back of the house in October. He told us that it was a simple addition that would take a few weeks. He began the work but there were many delays.' Catherine had hip replacement surgery and we were unable to get to the Cape for-several weeks. We paid the builder for the work he had done and the money for all of the windows, screens and skylights. He then became difficult to get in touch with and didn't return Peter's calls. He cashed our check but never purchased any of the screens, windows or skylights. Meanwhile we had a new washer and dryer installed in the laundry on the second floor. A week later we came to the house and there was a significant amount of water that had been pouring through the ceiling into the kitchen. (In a house that had just been completely renovated.) We didn't know if the builder had hit a pipe with a nail or the appliance store didn't install the washer properly. Again we were unable to get hold of John Fleury so we contacted the building company (Longfellow) who had done all of the renovations on the house, and asked if they would help us. They were still finishing a few,punch list items that had not been completed before the closing so we were in touch with them. They agreed and came to the house to determine what happened. They removed a portion of the ceiling and determined that the washer wasn't installed properly. They told us they could repair it but we needed to get a service manager from the appliance store to the house for a meeting with the builder to show them the cause before any work could be done. It was November by then and everyone was busy finishing up projects for customers who needed their projects done for the holidays. We were told that the plumber might need to pull a permit to fix the pipes and that would suffice to repair the ceiling etc.. They arrived the end of November to start the work and called us to say there was a stop work order on the door. James at Longfellow(our contact there) agreed to call the building in'speetor's office to find out what was wrong and to let them know that we were no- longer working with the original builder and had hired Longfellow to address the problem and move forward. Peter asked if we could remove the sticker if we were not doing any work on the porch and Longfellow told us we could as long as we did not do any additional work on the porch. We kept trying to reach the original builder and have not been able to reach him since. Work on the porch had not.been going on for several weeks by this time and we agreed with Longfellow that we needed to come up with a solution to present to the town as soon as possible. Longfellow told us that the porch wasn't within the setbacks needed and we would need to get a variance to be able to obtain a permit. In order to get a variance, we needed a site plan done. Longfellow advised us to get a site plan from an engineering company whom they work with, design the porch from the beginning stages and get structural engineering to be able to be able to apply for a permit for a variance which would hopefully allow us to keep the porch structure. We agreed and Longfellow told us the first step Was to get the site plan and that they couldn't do anything until that was completed. Longfellow was giving us a date of getting all the information to the town of Barnstable for a February meeting. We were in contact with Longfellow every week or so to get an update on when the site plan would be finished and was given one delay after another. We had asked Longfellow,on multiple occasions if they were in contact with the town of Barnstable and they assured us they were. While the process wasn't going quickly, we kept getting reassured by Longfellow that they were in contact with the town of Barnstable and "everything was fine....they know our intent". After a number of delays, Longfellow's plumber came to repair the pipes and then their carpenters repaired the ceiling. The only thing that has been done on the porch since we saw the order was Peter cleaned the area and stacked the wood neatly because it looked horrible and we wanted to be good neighbors. We saw another stop work order on the doors February 2 when we came to the house and again we contacted Longfellow and they reiterated that they have been in contact with the town of Barnstable. We assumed everything that could be done was being done. We called your office the day we saw the second stop work order but you were out of the office for a few days. James told us he would call you when you returned because he had previous conversations about the porch with you. We have the site plan now and a designer from Longfellow came to the house to do all the measurements for the proposed structure which we need in order to do anything including modifying the structure to comply with setbacks or taking it down. We do not have those plans yet. We were promised a week to a week and a half from Saturday, February 3. We have been pushing as hard as we can to move the process along but we don't have much leverage. Longfellow is helping us fix a mess that they aren't responsible for and they have many other projects they are trying to get done for other customers. If we push too hard they could wash their hands of the project and we are worried about that. We have been trying to see if there is any way to salvage any of the work that has already been done because we have already paid a considerable amount of money. Our intention is to work with the town to resolve this as soon as possible. We had no idea that the town wasn't completely informed and understood what we were doing. We purchased h p d the house in September of 2017. You asked us to send you a letter describing the timeline of events related to the screen porch that has transpired since then. As we mentioned on the phone we are absolutely appalled about this. We now know that we should have done things differently but didn't think to question what the builder told us. Particularly because he was from the Cape and he had highly recommended by a friend. This is not our primary residence and we haven't moved in yet. We hired John Fleury (Bud the Builder) to build a screen porch on the existing bluestone terrace off the back of the house in October. He told us that it was a simple addition that would take a few weeks. He began the work but there were many delays. Catherine had hip replacement surgery and we were unable to get to the Cape for several weeks. We paid the builder for the work he had done and the money for all of the windows, screens and skylights. He then became difficult to get in touch with and didn't return Peter's calls. He cashed our check but never purchased any of the screens,windows or skylights. Meanwhile we had a new washer and dryer installed in the laundry on the second floor. A week later we came to the house and there was a significant amount of water that had been pouring through the ceiling into the kitchen. (In a house that had just been completely renovated.) We didn't know if the builder had hit a pipe with a nail or the appliance store didn't install the washer properly. Again we were unable to get hold of John Fleury so we contacted the building company(Longfellow)who had done all of the renovations on the house, and asked if they would help us. They were still finishing a few punch list items that had not been completed before.the closing so we were in touch with them. They agreed and came to the house to determine what happened. They removed a portion of the ceiling and determined that the washer wasn't installed properly. They told us they could repair it but we needed to get a service manager from the appliance store to the house for a meeting with the builder to show them the cause before any work could be done. It was November by then and everyone was busy finishing up projects for customers who needed their projects done for the holidays. We were told that the plumber might need to pull a permit to fix the pipes and that would suffice to repair the ceiling etc.. They arrived the end of November to start the work and called us to say there was a stop work order on the door. James at Longfellow(our contact there) agreed to call the building inspector's office to find out what was wrong and to let them know that we were no longer working with the original builder and had hired Longfellow to address the problem and move forward. Peter asked if we could remove the sticker if we were not doing any work on the porch and Longfellow told us we could as long as we did not do any additional work on the porch. We kept trying to reach the original builder and have not been able to reach him since. Work on the porch had not been going on for several weeks by this time and we agreed with Longfellow that we needed to come up with a solution to present to the town as soon as possible. Longfellow told us that the porch wasn't within the setbacks needed and we would need to get a variance to be able to obtain a permit. In order to get a variance,we needed a site plan done. Longfellow advised us to get a site plan from an engineering company whom they work with, design the porch from the beginning stages and get structural engineering to be able to be able to apply for a permit for a variance which would hopefully allow us to keep the porch structure. We agreed and Longfellow told us the first step was to get the site plan and that they couldn't do anything until that was completed. Longfellow was giving us a date of getting all the information to the town of Barnstable for a February meeting. We were in contact with Longfellow every week or so to get an update on when the site plan would be finished and was given one delay after another. We had asked Longfellow on multiple occasions if they were in contact with the town of Barnstable and they assured us they were. While the process wasn't going quickly, we kept getting reassured by Longfellow that they were in contact with the town of Barnstable and"everything was fine....they know our intent". After a number of delays, Longfellow's plumber came to repair the pipes and then their carpenters repaired the ceiling. The only thing that has been done on the porch since we saw the order was Peter cleaned the area and stacked the wood neatly because it looked horrible and we wanted to be good neighbors. We saw another stop work order on the doors February 2 when we came to the house and again we contacted Longfellow and they reiterated that they have been in contact with the town of Barnstable. We assumed everything that could be done was being done. We called your office the day we saw the second stop work order but you were out of the office for a few days. James told us he would call you when you returned because he had previous conversations about the porch with you. We have the site plan now and a designer from Longfellow came to the house to do all the measurements for the proposed structure which we need in order to do anything including modifying the structure to comply with setbacks or taking it down. We do not have those plans yet. We were promised a week to a week and a half from Saturday, February 3. We have been pushing as hard as we can to move the process along but we don't have much leverage. Longfellow is helping us fix a mess that they aren't responsible for and they have many other projects they are trying to get done for other customers. If we push too hard they could wash their hands of the project and we are worried about that. We have been trying to see if there is any way to salvage any of the work that has already been done because we have already paid a considerable amount of money. Our intention is to work with the.town'to resolve this as soon as possible. We had no idea that the town wasn't completely informed and understood what we were doing.
