She sought to amend the conditions to allow the main portion of the existing dwellijig to be demolished and reconstructed with a 219 sq.ft second-story loft addition. The rear wing,which contains the-kitchen and bathroom,and rear deck would remain intact. The proposed dwelling would consist of first floor living:area and one bedroom on the second- floor. The subject property is a 2,659 square foot Jot with 36 feet of frontage on Norris Street,improved with a 520 sq.ft, one-story,single-family dwelling with an 8x16'accessory deck. The dwelling sits 3.7'from the side lot line and 3.5' from the rear lot line and conforms to front and west-side setbacks.The lot is served by public water and sewer. 'The 2,659 sq.ft lot was created by a 1975 Approval Not Required plan that divided a parcel developed with multiple " dwellings into individual lots. No variance relief was granted for the undersized lots at the time they were created. The Board granted Appeal No.2007-072 to Elaine Cwynar,authorizing relief from the minimum lot area and side-and rear-yard setback requirements of the RB District. The Board imposed seven(7)conditions on the issuance of the variance which include the following: 1. This variance is granted to the existing structure and lot. The lot shall not be further reduced in area and the dwelling shall not be increased in area. The use of the property is limited to that of a two-bedroom,one-, , story,single-family dwelling. 2. The existing structure can be improved and maintained,including being rebuilt. However,the footprint of the structure and gross area of the building shall not be expanded nor"„shall the number of bedrooms be increased. Procedural&Hearing Summary Appeal No.2015-035 for a modification of Variance No.2007-072 was filed at the Town Clerk's Office and office of the Zoning Board of Appeals on June 8, 2015. A public hearing.before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The-hearing was opened July 8, 2015 and continued to August 12, 2015,August 26, 2015 and September 30, 2015 at which time the Board found to grant the variance modification subject to conditions. An agreement to extend the statutory time limits for rendering a decision was signed by the Applicant and the Board. Board Members deciding this appeal were Brian Florence,George Zevitas, Herbert K.Bodensiek,David A.Hirsch and Matthew Levesque. Attorney Michael Schulz represented the Applicant before the Board. Attorney Schulz reviewed the prior variance issued for the property and presented the proposal for reconstruction of portions of the dwelling. He noted the floor- area ratio was consistent with the maximum imposed for demolition and rebuilding on nonconforming lots.He noted Town of Barnstable Zoning Board of Appeals—Decision and Notice Valiance No.2015-035—Cwynaaz that the Board failed to make the statutory findings with their 2007 decision,and requested that the Board consider those findings with this appeal. At the Board's request,Attorney Schulz walked through a detailed history of the development and division of the property on Norris Street. He noted that the 1975 Approval Not Required Plan.divided a lot on which multiple structures existed,and that those structures all predated zoning. Attorney Schulz noted that when the application was presented to the Board in 2007,the owners were focused on restoring the kitchen within the dwelling,which had been damaged,and did not contemplate the changes that were being proposed at this time. Public comment was requested and no one spoke. Attorney Schulz noted_that 23 letters of support had been submitted for the record. Findings of Fact At the hearing on September 30,2015,the Board unanimously made the following findings of fact for Appeal No. 2015-035,a request for a modification'to.the conditions of Variance No.2007-072 to allow for a 219 sq.ft addition to the dwelling: 1. In Appeal No.Wf5-035, Elaine Cwynar seeks to modify and amend condition Nos.1 and 2 of Variance No.2007- 072 to allow a 219 square foot second floor loft addition to the existing dwelling. The Applicant proposes to demolish and rebuild the main portion of the dwelling,leaving the rear wing,which contains the kitchen and bathroom,and rear deck intact.The proposed dwelling would consist of first floor living area and one bedroom on the second floor. 2. The subject property is located at 29 Norris Street,Hyannis,MA as shown'Qn Assessor's Map 306 as Parcel 033. It is in the Residence B Zoning District. 3. The subject lot was created by a 1975 Approval Not Required Plan that divided a lot improved with multiple dwellings that predated zoning and no variances were issued at the time of the lot division. 4. In issuing Variance No.2007-072,the Board found that"conditions have not been established that satisfy the requirement of MGL Chapter 40A,Section 10. However,neighborhood support has been substantiated. The proposed improvements to the property are needed and would represent an enhancement to the property and neighborhood:' 5. There are circumstances relative to topography of such land or structures that especially affect such land or structures but do not affecting generally the zoning district in which it is located. The existence of multiple residential dwellings in close proximity to each other,on a single lot was a unique topographic feature that predated zoning is a unique feature affecting this property,but not generally the zoning district in which it its located. 6. A literal enforcement of the provisions of the zoning ordinance would invo[ve substantial hardship,financial or otherwise. The Applicant purchased the property in 1977 with no knowledge of the zoning violations and for it not to be a legal zoning lot would be a significant financial hardship. 7. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. The neighborhood has submitted support for the project. The proposed dwelling is in keeping with the character of the neighborhood and does not Increase the building footprint. Condition Nos.1 and 2 shall only be modified to the extent allowed to permit the addition referenced in Condition No_2. 5. This variance shall be recorded at the Barnstable County Registry of Deeds within one year from the date of issuance or this variance shall expire,unless extended by the Board. Copies-of the recorded decision shall be provided to the Zoning Board of Appeals and Building Division files prior to.issuance of building permits. Cwynar Property Address: 29 Norris Street, Hyannis,MA Assessor's Map/Parcel: Map 306 as parcel 033 Zoning: Residence B Zoning District Background & Review: According to the Assessor's record, the subject property is developed with a two-bedroom, 480 sq.ft., one-story structure that dates back to 1950. The subject lot is a 2,659 sq.ft. lot (0.06-acre) created by a 1975 Approval Not Required (ANR). The subject property is shown on the 1975 plan as Lot#13. The lot was configured approximately 36 feet by 74 feet deep, measuring 2,659 sq.ft. in area. The easterly lot line and rear lot line were struck approximately 3.8 feet off the existing dwelling. In 1975, this area was zoned Residence B and required a minimum lot area of 10,000 sq.ft., and a minimum side and rear yard setback of 10 feet. Lot#13 did not meet those minimum zoning requirements. The division of this lot did not conform to zoning in 1975 and the applicant is now seeking those variances necessary to legalize the lot under zoning. The applicant has proposed to demolish a 16 by 10 foot section of the existing building and to rebuild that area of the structure. The location of the improvement is situated in that area of the structure that infringes into the setbacks. The Building Commissioner has not seen it clear to issue the building permit as it would appear the lot and structure would not be considered legal under zoning as they did not conform to the zoning requirements of 1975. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 8, 2007. A Extension of Time for opening and for file of the decision was executed. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 12, 2007, at which time the Town of Barnstable-Zoning Board of Appeals Decision and Notice-Variance 2007-072-Cwynar Board found to grant modifications allowing for Special Permit 1997-35A and Variance 1997-36 to be transferred to the applicants subject to those prior conditions of the permit and variance. Board Members deciding this appeal were,James R. Hatfield, Sheila Geiler,John T. Norman, Kelly Kevin Lydon, and Chairman, Gail C. Nightingale. Attorney Michael F. Schulz represented the applicant. He presented the history of the area, citing that Norris Street dated to a 1937 creation with a recording of a Subdivision Plan. That subdivision created 13 lots including the roadway lot. The roadway was later altered and taken by the Town in 1940. The undersized lot consisting of 2,659 sq.ft. was created by a 1975 Approval Not Required (ANR) plan endorsed by the Planning Board on August 12, 1975, and recorded at the Barnstable Registry of Deeds. Apparently between 1940 and 1975 several buildings were built on the property and in 1975 the ANR plan segmented those dwelling on individual lots. Unfortunately, the lots created on the 1975 plan did not conform to zoning at the time and no zoning relief was ever issued for those lots. Mr. Schulz stated that the applicant purchased the property in 1977 from Sally Ann Norris for just compensation and had no knowledge that a zoning issue existed. It had been used continuously as a residence until recently when it became necessary to demolish a 16 by 10 foot section of the existing structure and rebuild it as it was dilapidated. He submitted photos of the dilapidated section, and characterized the proposal as an improvement to the neighborhood. He submitted several letters in support of the grant of the variance. It was noted that there would be no increase in that area of the structure, no increase in bedrooms and no increase in the height. The intent is only to replace and maintain what exists. Public comment was requested and no-one spoke in favor or in opposition. Chairman Nightingale cited that letters in support of the grant of the variance were entered into the file from; Dennis McAuliffe and Moira Winroth residents and abutters at 19 Norris Street, Wilfred T. Hood and Elena K. Hood owners of Unit B-28 Crocker Drive, Michael R. Kratochwell owner of Unit D-28 Crocker Drive, Jeffrey and Gail Coombs residents of 22 Norris Street, Phil and Susan Cwynar owners of 73 Norris Street, Heather Keirstead owner of Unit E-28 Crocker Drive, Richard and Dale Setterlund residents of 56 Norris Street, Evelyn D. Findings of Fact: At the hearing of September 12, 2007, the Board unanimously made the following findings of fact: 1. Appeal number 2007-072 is that of Elaine R. Cwynar seeking variances to Section 240-11.E Bulk Regulations, Minimum Lot Area, and Minimum Side and Rear Yard Setbacks. The applicant seeks the variance for the existing developed lot consisting of 2,659 sq.ft. that was created by a 1975 Approval Not Required Plan. That plan, when recorded, did not conform to zoning at that time and divided the land such that the existing dwelling did not conform to required setbacks. The 2 f Town of Barnstable-Zoning Board of Appeals Decision and Notice-Variance 2007-072-Cwynar property is addressed as 29 Norris Street, Hyannis, MA and as shown on Assessor's Map 306 as parcel 033. It is in a Residence B Zoning District. 2. MGL Chapter 41, Section 81 L—Subdivision Control Law provides for the division of a lot upon which residential structures exist that predate the adoption of subdivision control in the Town. However, existing case law stands that lots created under that section must conform to all aspects of the zoning district's regulations to be considered legal zoning lots. 3. According to the Assessor's record, the subject property is developed with a two-bedroom, 480 sq.ft., one-story structure that dates back to 1950. The applicant, Elaine Cwynar, purchased the property in 1977 from Sally Ann Norris as evidenced by a deed recorded at the Barnstable Registry of Deeds. 4. Norris Street appears to date to a 1937 creation with a recording of a Subdivision Plan in Plan Book 56, page 95. That subdivision created 13 lots including the roadway lot. The roadway was later altered and taken by the Town in 1940 as shown in the plan for the taking of the way recorded in Plan Book 62, page 49. Conditions have not been established that satisfy the requirement of MGL Chapter 40A, Section 10. However, neighborhood support has been substantiated. The proposed improvements to the property are needed and would represent an enhancement of the property and neighborhood. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the variances requested. subject to the following conditions: 1. This variance is granted to the existing structure and lot. The lot shall not be further reduced in area and the dwelling shall not be increased in area. The use of the property is limited to that of a two-bedroom, one-story, single-family dwelling. 3 Town of Barnstable-Zoning Board of Appeals Decision and Notice-Variance 2007-072-Cwynar 2. The existing structure can be improved and maintained, including being rebuilt. However, the footprint of the structure and gross area of the building shall not be expanded nor shall the number of bedrooms be increased. 3. All new construction shall comply with all applicable Building Division and Fire requirements as applicable. 6.
