You should be aware that the burden of proof is upon.the applicant requesting a variance to prove that compliance is either: 1. technologically infeasible or; 2. the cost of compliance. is excessive without substantial benefit to a person with a disability. This hearing will be conducted in accordance with the procedures set forth in M.G.L., c. 30A, and § 1.02 of the Standard Rules of Practice and Procedure. At the hearing, each party may be represented by counsel, may present evidence and may cross examine opposing witnesses. The variance hearing was held in regards to the following Rules and Regulations of the Architectural Access Board: Section 16 1—Access to Immersion Baptistery (Houses of Worship) 2. The hearing was held on Monday, August 6, 2007. 3. Let the record show that none of the concerned parties appeared at the hearing which was scheduled to begin at 10:30 a.m. and was called.to order by the Chairman of the Board at 10:58 a.m. The Return Receipt for the Notice of Hearing was signed for and returned to the AAB Office on June 4, 2007. 4. 'JURISDICTION: The Board took jurisdiction over the facility under Section 3.2, in that all new construction of buildings open to and used by the public must comply in full with 521 CMR. g A 5. FINDINGS AND DECISION: The.Board having considered the evidence hereby decides and finds as follows: ` Let the record show that Mr. Robert Bersani was not present for this hearing. There re, M&Serry-,"�eBlanc, Chairman, stated that there were.not,enough members,for the required quorum of fiv members. He noted that the petitioners could choose to reschedule the hearing, or could proceed with the current hearing whereupon another Board Member would review the hearing within the next two weeks to finalize any decision made by the present Board Members. Let the record show that since none.of the concerned parties were present to object, the hearing was held as scheduled. Ms. Myra Berloff stated that after reviewing the materials in the Board packet, she did not see that there was enough material submitted to make a decision regarding this matter. Therefore, Ms. Berloff made a motion to CONTINUE the hearing to have the.petitioners submit detailed plans of access throughout the building, along with a detailed plan of the Hoya lift use,with the materials to be submitted one week prior to the next scheduled hearing (which will be scheduled for the next available hearing date), with the condition that the occupancy permit (or temporary occupancy permit) not be given until the Board takes action on the matter. The motion was seconded by Ms. Diane McLeod and carried upon a vote of the present members. Due to the lack of a quorum, the vote will be finalized upon another vote from a . member of the Board. On August 8, 2007,Mr. Richard Flippin reviewed the matter and voted in favor of the motion, therefore the motion carried unanimously. On August 20, 2007, Mr. Thomas Hopkins, Director of the AAB, presented plans of the access to the baptistery in question at the Zion Union Church, located at 276 North Street in Hyannis. In a letter dated August 16,2007 and received on August 17, 2007, Thomas Paquin, attorney for the church, stated that the building was used as a sanctuary on the first floor and as a bible school and baptismal area at the lower level, noting ti`1at the uses were unrelated. Mr. Doug Semple asked if there was an interior stairway connecting both levels,.to'which Mr. Hopkins responded that there was an interior stairway connecting the two levels. Mr. Hopkins noted that the plan for access to the baptistery showed a lift which would lift that parishioner an estimated 12-15 feet up to and into the baptistery. Upon reviewing the matter, Mr. Donald Lang made a motion to SUBPOENA a full set ofplans.to be stamped by a Massachusetts Registered Architect be submitted one week prior to the HEARING to be scheduled for this matter. The motion was seconded by Ms. Diane McLeod and carried unanimously upon a vote from the Board. Please note, per the Board's previous decision, an occupancy permit (or temporary occupancy permit) shall not be given until the Board takes action on this matter, i.e. a final decision is rendered.
