The above referenced site plan was reviewed at the December 19, 1996 meeting of Site Plan
Review and deemed approvable with the following conditions:
• Lighting plan and details to be submitted.
• Notification to Historic Preservation.
• North Street drainage issue must be resolved.
• Patch sidewalk and use granite curbing.
Please be informed that a building permit is necessary prior to any construction. Upon completion
of all work, the letter of certification required by Section.4-7.8 (7) of the Town of Barnstable
Zoning Ordinances must be submitted. Also, all signage must be discussed with Gloria Urenas of
this Department:.

Thank you for taking the time to meet with Lauren Parrella and me regarding the
application for transfer of the Nissan dealership license to the KIA site in Hyannis.
I am writing to confirm our discussions and to provide you with copies of the
documents which we reviewed that day.
The property has been the subject of two site plan reviews.
In 1988 the Chrysler dealership applied for Site Plan Review No. 25-88 on Barnstable
Assessor's Map 308, Parcel 37. I enclose a copy of the Assessor's map for your information
and review and have highlighted that parcel in yellow. That application was for construction
of the upgraded Chrysler facility. At that time, a parking plan was created dated May 13,
1988 (copy enclosed) and a license was issued for the use noting 118 spaces.
In 1996, the owner, Ed Leslie, purchased two adjacent properties (Map 308, Parcels 35
and 36) and submitted a site plan review application to allow for demolition of the structures (2
single family homes and a paint business) and to construct a parking lot and display area
ancillary to the existing automobile dealership. I enclose a copy of that application for site
plan review dated November 25, 1996 together with the site plan review approval letter dated
December 23, 1996. With regard to that application, I enclose a plan dated December 18,

1996 depicting the parking spaces located to the west of the existing Chrysler dealership as
approved by site plan.
As we discussed, under Section 240-56, we believe that the required parking for the
existing use is as follows:
Retail/Showroom 3,330 square feet 17 spaces
Office 2,716 square feet 10 spaces
Service 12 stalls x 3 36 spaces
Parts/Storage 2,948 square feet 5 spaces
TOTAL 68 SPACES
As we further discussed, it is the intention of the new license holder to make no
changes to the building footprint or interior floor area uses which would result in a change of
parking requirements. Accordingly, no site plan review is required for the purposes of the
license application. In addition, as we discussed, the property is now located in the OM
Zoning District and as a result, is a pre-existing, non-conforming use. In light of the
anticipated continued use in the same exact fashion as the Chrysler dealership (i.e., just
changing the name of the dealership), you agreed that no zoning relief or site plan review is
triggered as a result of the license application.
I would be most appreciative if you could forward confirmation of these understandings
to the Licensing Board prior to the anticipated hearing on August 6, 2007.

Thank you, very much, for taking the time to see me and Jeb Balise this morning. This
memorandum will serve to followup and provide you with copies of the documents which I
showed you this morning. For ease of reference, I have attached each as tabbed exhibits. I
enclose the following:
1. Tab A - 1988 Site Plan (with notation "Customer and Employee = 67 spaces;
Inventory = 51 spaces)
2. Tab B - 1996 Site Plan together with parking calculations
3. Tab C -July 26, 2007 Site Plan depicting the combination of the site plan
approved in 1988 and the site plan approved in 1996
4. Tab D - License issued January 1, 2007 and currently in effect providing "51
parking spaces for inventory, 67 parking spaces for customers and employees."
5. Tab E - Copy of License issued January 1, 1996 providing "51 parking spaces
set aside for inventory and 67 parking spaces reserved for customer and
employee parking." As noted this morning, that license also states "Plan
approved by Site Plan Review shall be complied with."

As we discussed this morning, I believe that the enclosed documentation provides clear
and convincing evidence that the subject property is currently being utilized as a legally pre-
existing, non-conforming use and that such use is in conformance with the combined site plan
attached at Exhibit C (which is the 1996 site plan as modifying the 1988 site plan).
As we further discussed, I believe that the notation on parking spaces set forth in the
1996 license has been carried forward for the past ten years (as evidenced by the current
license).
Finally, I believe that the phrase "Plan Approved by Site Plan Review shall be
complied with" in the 1996 license confirms that the "use" of the site is consistent with the
compiled site plan attached as Exhibit C. Accordingly, this will confirm that so long as the
foot print of the building, floor area, use and site plan does not change, no zoning relief is
necessary to proceed with the license application hearing.
Accordingly, please advise Tom Geiler's office that we may proceed to advertise and
schedule the license transfer hearing.

Per my discussions with Tom Geiler earlier this week and my followup discussions with
you, I enclose a site plan dated July 26, 2007 for informal administrative review at next week's
internal Site Plan meeting. As noted in my prior memoranda to you, no changes are
anticipated to the use, layout or footprint of the building nor use of the site from that which is
currently ongoing as the existing automobile dealership. It is the purpose of this updated site
plan to delineate the parking for the entire site; which consists of the initial Chrysler dealership
(Parcel 37) which was approved by Site Plan Review No. 25-88 and the additional parking
constructed in 1996 pursuant to Site Plan Review approval dated December 23, 1996 on
Parcels 35 and 36.
Certainly, should you or the Site Plan members have any questions or require any
additional information, please feel free to contact me. Upon your review and approval, I have
been authorized by Mr. Geiler to refile the application for license transfer.
