It now appears that this was merely lip service. The situation still exists, the place is infested with rats and all other vermin, skunks and raccoons find a convenient haven, and the place is an absolute cesspool of health hazards as well as a most dan- gerous place for children cf the neighborhood. It is an attactive nuisance. Whether this spot has been designated a new Town Dump, East, or not, it has became such. People freely dump their trash and garbage there because it appears the most convenient spot to do so, and it has all the trappings of a dump, ext that the Town Landfill has sanitary measures in place, while this spot does not of r even this prot- ection for folks in the neighborhood. How your office, the Board of Health and the Building Department have chosen to ignore this festering eysore is difficult to imagine. I am forwarding copies of these photos to the Board of Health, the Building Department and the Town Council, which I hope will finally get some action in this matter. In the event that it should not, I intend to have the whole thing published, including a copy of this letter. If legal action becomes required, I shall take the lead in securing legal assistance - though it would be my wish and expectation that this should not become necessary. The question was "why, after over two years of no construction activity, this permit has not been considered invalid?" Is it the policy of the department to transfer building permits with the change of ownership? It also appears that the-building department issued a building permit to add on to this nonconforming use without the benefit of a "Special Permit" as required under Section 4-4.3(2) of the Town of Barnstable Zoning Ordinance. Any proposed increase in floor area of such damaged building shall not commence unless a Special Permit is granted by the Zoning Board of Appeals as per Section 4-4.2 herein. You were assured and thereby 9 assurin us that the exterior work would be completed within sixty days and that the only delay was weather related. I find this to be totally inaccurate. Either this building should be razed or you should see that construction is completed through correct channels in a timely manner. Unfortunately, we have several buildings in similar situations. What concerns our department is that, in most cases, there has been a foreclosure. We have addressed this issue with the legal department. In your case, the situation is similar.' 'Mr. Scott Terkelsen is no longer the record owner of the property. The new trustee has been contacted and has informed me that a licensed builder has been contracted to complete the project. The work should have been started mid- March but the weather has caused a delay. . I am assured that all exterior work will be completed within sixty days. The interior work will follow. The "owner," Scott Terkelsen, took out a building permit #33588 to add to this dwelling. Immediate action was taken to clean debris from the fire. However, the construction allowed by this permit has not been completed as of March 19, 1992. After making a phone call to your office asking that the building be secured, your office took immediate action. According to the State Building Code, Section. 114.3 "Work under such permit in the opinion of the building commissioner or inspector of buildings, must proceed in good faith continuously to completion so far as is reasonably practicable under the circumstances." I would like to ask why, after over two years of no construction activity, this permit has not been considered invalid? As the town taxes property on the assessed value of property, I am sure that the town is losing revenue because of inaction on this construction project. Is'it-possible for your office to remedy this situation? If it appears -that such structure would be especially unsafe in case of fire, it shall be deemed dangerous within the meaning hereof, and the building officia?, may affix in a conspicuous place upon its exterior walls a notice of its dangerous condition, which. shall not be removed or defaced without authority from him. 123.2 Removal or making structure safe: Any person so notified shall be allowed until twelve o'clock noon of the day following the service-of the notice in which to begin to remove such building or structure or,make it safe, or to make it secure, and he shall employ sufficient labor speedily to make it safe or remove it or to make it secure; but if the public safety so requires and if the mayor or selectmen so order, the building official may immediately enter upon the premises with the necessary workmen and assistants and cause such unsafe structure to be made safe or demolished without delay and a proper fence put up for the protection of passersby, or to be made secure. SECTION 124.0 EMERGENCY MEASURES 124.1 Failure to remove or make structure safe, survey board, survey report: If an owner of such unsafe structure refuses or neglects to comply with the requirements of such notice within the specified time limit, and such structure is not made safe or taken down as ordered therein, a careful survey of the premises shall be made by a board consisting; in a city, of a city engineer, the head of the fire department, as such term is defined in Section 1 of Chapter 148 of. the Massachusetts General Laws Annotated, as amended, and one disinterested person to be appointed by the building official; and, in a town, of a surveyor, the head of the fire department and one disinterested person to be appointed by the building . official. In the absence of any of the above officers or individuals, the mayor or t selectmen shall designate one or more officers or other suitable persons in place of the officers so named as members of said board. A written report of such survey shall be made, and a copy thereof served on such owner. 124.2 Removal of dangerous or abandoned structures: If such survey report as outlined in Section 124.1 declares such structure to be dangerous or to be unused, uninhabited or abandoned, and open to the weather, and if the owner continues such refusal or neglect, the building official shall cause it to be made safe or taken 780 CMR - Fifth Edition 1-25 THE MASSACHUSETTS STATE BUILDING 'CODE down or to be made secure; and, if the public safety so requires, said building official may at once enter the structure, the land on which it stands or the abutting land or buildings, with such assistance as he may require, and sec the same; and may remove and evict, under the. pertinent provisions of Chapter 239 of the Massachusetts General Laws Annotated as amended, or otherwise, any tenant or occupant thereof; and may erect such protection for the public by proper fence or- otherwise as may be necessary, and for this purpose may close a public highway. Tn the case of such demolition, the said building official shall cause such lot to be levelled to conform with adjacentt grades by a nonorganic fill. The costs and charges incurred shall constitute a lien upon the land upon which the structure is located, and shall be enforced in an action of contract; and such owner shall, for every day's continuance of such refusal or neglect after being so notified, be punished b_y'a fine in accordance with Section 121.4. 'f'he provisions of the second paragraph of Section 3A of Chapter 139 of the Massachusetts General Laws Annotated as amended, relative to liens for such debt and the collection of claims for such debt shall apply to any debt referred to in this section, except that the said building official shall act hereunder in place of the mayor or board of selectmen. During the time such order is in effect, it shall be unlawful to use or occupy such structure or any portion thereof for any purpose. 124.3 Remedy of person ordered to remove a dangerous structure or make it safe: An owner, aggrieved by such order may have the remedy prescribed by Section 2 of Chapter 139 of the Massachusetts General Laws Annotated as amended; provided that any provision of said Section 2 shall not be construed so as to hinder, delay or prevent the building official from acting and proceeding under Section 124.2; and provided, further, that this section shall not prevent the city or town from recovering the forfeiture provided in said Section 124.2 from the date of the service of the original notice, unless the order is annulled by the jury. 125.0 RESERVED SECTION 126.0 BOARD OF APPEALS 126.1 State Building Code Appeals Board: Whoever is aggrieved by an interpretation, order, requirement, direction or failure to act under this code by any agency or official of the city, town or region, or agency or official of the State charged with the administration or enforcement of this code or any of its rules or regulations, excepting any specialized codes, may appeal directly to the State Building Code Appeals Board as provided in Section 126.0. The "owner," Scott Terkelsen, took out a building permit #33588 to add to this dwelling. Immediate action was taken to clean debris from the fire. However, the construction allowed by this permit has not been completed as of March 19, 1992. After making a phone call to your office asking that the building be secured, your office took immediate action. According to the State Building Code, Section 114.3 "Work under such permit in the opinion of the building commissioner or inspector of buildings, must proceed in good faith continuously to completion so far as is reasonably practicable under the circumstances." I would like to ask why, after over two years of no construction activity, this permit has not been considered invalid? As the town taxes property on the assessed value of property, I am sure that the town is losing revenue because of inaction on this construction project. Recently I contacted officials in Provincetown for assistance in locating Mr. Lunin to no avail. We have inspected the site several times and have secured the door to prohibit unauthorized entry. The Massachusetts General Laws provides that a building must be secured to prohibit entry by unauthorized persons. I would like to enlist the cooperation of the owner re the demolition of the damaged building. If that fails we will have to institute formal proceedings, as required by the General Laws, and the Town will be forced to bear the expense of the demolition and place a lien on the property in an effort to recover costs. The land currently has an assessed value of $19,400. The lack of action by town agencies has raised safety concerns for the many small children that live in the area. I believe that this abandoned dwelling poses a significant safety threat to them. Neighbors In the area of 54 Oak Neck Road, Hyannis, have been made to endure this hazardous eyesore for nearly three years. The reason, as you can see from the pictures, Is because of a blighted condition allowed by the Building Department and/or the Board of Health. The owner received a building permit to add to this fire damaged dwelling on March 21, 1990. However, the construction never proceeded In good faith and continuously to completion. The permit was then allowed to be transferred to a new owner. When a question posed to the Building Commissioner concerning non-existent construction activity being permitted for a period of more than two years went unanswered, the Issue raised concerns. There was also a question whether or not this dwelling required Board of Appeals approval under the non-conforming use section, prior to the issuance of a building permit. Both of these Issues have not been addressed, to my satisfaction. Not hearing a pertinent response from the Building Commissioner, I requested the Board of Health make an Inspection under the State Sanitary Code to determine whether this dwelling was fit for human habitation. I also stated, "If this dwelling is found not to be fit for human habitation, take appropriate action." Jerome Dunning determined the dwelling to be abandoned. This dwelling has - no roof, utilities, windows, and a considerable amount of debris in and around it. I would ask why the Health Department did not use Its authority under Section 410.831 of the State Sanitary Code to condemn the property? Mr. Dunning also stated on June -16,1992, "Joe Daluz Is presently working to contact the Hyannis Fire Chief to condemn the property." This Issue should have been addressed by the Building Department six (6) months after the permit was Issued. It should have been noted, on Inspection, that the work was not completed according to the State Building Code. I believe, at that time, the permit should have been voided, or possibly extended, but not transferred. Currently this property, In my opinion, continues to pose a safety threat to the children of the area as It is, again, not secured. The condition of this property has also led to a depreciation of property values in the area since January 14, 1990. It Is the opinion of some members of the Association that the Town should issue tax abatements to property owners In the area because of this blighted condition. Leon Churchill responded to my request that he look into the problem. He sent a letter, dated August 7,1992, stating that the Building Commissioner was in the process of condemning the property at 54 Oak Neck Road, Hyannis as provided by MGL. Chapter 143, Section 8. To date, nobody from the Building Department has contacted Russ Davenport, the Town Engineer, concerning this Issue, as one of the members of a committee formed under the mentioned statute. On March 21,1990, the Building Department issued a building permit #33588. Two years and eight months have elapsed since the permit was issued. On November 4, 1991, the Building Department told the owner to secure the dwelling. Eleven months have elapsed since that notice. When will this dwelling be reconstructed or condemned and razed? Is it possible for you to remedy this situation? In each case a survey board has been assembled by me and has reported findings as required by law. All agree that,in each case,the simple boarding up of all openings would be the recommended action to protect the public. Neither owner has responded to repeated contact attempts by our office and so I am requesting that the Town supply the manpower and supplies to do the job and lean the titles appropriately. In each case, sheets of plywood and screws are needed and the Department of Public Works would probably be the department that should provide the labor. It appears that this house is owned by one person who is in bankruptcy now. The first mortgage holder is willing to rip the building down, but only if we can waive the dump fees for her. Apparently homeless people have been staying in the structure, and prior efforts to have the owner make the structure safe have not worked out. The alternative is for us to handle it but I think that course of action will take several months, and result in my writing to Warren seeking the Town's services in taking down the building and leaning the title.
