A public hearing before the Zoning Board of Appeals was duly advertised and notices were sent to all abutters in accordance with MGL.Chapter 40A. The hearing opened on April 26, 2006,at which-time the Board found to grant the special permit with.conditions:,The Board Members deciding this appeal were,James R..Hatfield, Sheila Geiler, John T.Norman, Kelly Kevin Lydon, and.Chairman Gail C. Nightingale. r , e C Attorney Paul R. Tardif represented the applicant,Mr. Victor Hadawar,Trustee,,who was also present at the hearing. Mr. Tardif explained the proposal to the Board. He noted that it was the applicant's intent to. .replace the front residential structure with a new residential structure. The existing building is deteriorated And in desperate need of being completely replaced.The proposed structure would conform to all current property setbacks. Mr. Tardif stated that in August 2005,the time the applicant purchased the property,both dwellings contained residences. Initially, attempts were made to reuse the existing structure. However, upon further inspection, it was determined that dwelling needed complete removal and replacement. The Board and applicant discussed the issue of the legality of the use of the property as that of a two family in a single family zoning district. Mr. Tardif noted that according to the Assessor's record one building dated back to the 1920's and the other 1960.He cited that those records may not be completely accurate. However, both buildings were fully built as residential structures.:The structure built in 1960 was later converted into an accessory garage. As shown in the Building Division file,permits were issued for the repair and maintenance of both buildings despite the fact that they were legal nonconforming structures. Public comment was requested and no one spoke in favor or in opposition. . Findings of Fact: r At the hearing on April 26, 2006,.the Board unanimously made the following findings of fact: 1. Appeal 2006-34 seeks Special Permits pursuant to Section 240-92 Nonconforming Buildings or Structures Used as Single-and Two-family Residences and Section 240-94 (B)Expansion of a Preexisting Nonconforming.Use. The applicant is H&H Realty Trust,Victor Hadawar,Trustee. The property is addressed 10.1 Oak Neck Road,Hyannis MA, as shown on Assessor-'s Map 307 as parcel 123, in a Residence Zoning District. ` 2. The applicant has applied for the Special Permits to demolish one of two residential structures located on a lot and rebuild a new second detached dwelling unit in its place. The use does not conform to the principal permitted use in the district that being single family use only: 3. The property at issue is a 0.337acre parcel. The parcel is developed with a principal structure, cottage structure, garage 41nd shed.The principal structure is a 1,008,sq.ft.,one and a half-story; three-bedroom dwelling:"The cottage structure is 660 sq.ft., one-story, two-bedroom dwelling located behind the principal,structure. A detached garage of 480 sq.ft.,`is also located to the rear of the property. 4. The applicant is seeking to demolish the primary residence and construct.a new two story, four=, bedroom dwelling of 1,612 Oft. The proposed new structure will comply with the required setbacks. The redevelopmentrepresents an expansion in area and intensification in the nonconforming use as the structures are being expanded from 1,108 sq.ft. to 1,612 sq.ft., and the number of bedrooms will increase from.,three to four. 5. The applicant has applied for Special Permits pursuant to Section 240-92.Nonconforming Buildings or Structures Used as Single._and Two-family Residences and Section 240-94 (B)Expansion of a Preexisting Nonconforming Use. Given the issue before the Board is one-of a two-family, staff would suggest that the applicant needs only a special permit in accordance.with Section 240' 2 toy accomplish his objectives., s 6. The Assessor's record indicates that the principal dwelling dates to 1920 and the cottage structure dates to 1960. Zoning for residential use was first enacted in the Town in 1929. Zoning of the area to single-family use dates to 1953. For.the property to be a legal pre-existing non-conforming two- family, use of both structures as independent living units must predate the 1953 Zoning By-Law. 7. In granting of this Special Permit the Board find that the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit and after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. { Decision: - Based on the findings of fact, a motion was duly made and seconded to grant.the appeal with the following conditions: L. During all stages of demolition,and reconstruction, all construction materialsand equipment shall be required to be located on site and not within 5 feet of neighboring properties with the exception of utilities or landscaping and then only on a temporary bases or as maybe permitted by agreement with neighboring land owners. 9.
