Berry and Margaret D. Berry-Trustees of Ocean Street Realty Trust for property addressed as 111 Ocean Drive, West Hyannisport, MA, and filed with the Town Clerk on January 23, 2008. The error is in Condition Number 1 that cited the last revised date of the approved site plan as being October 3, 2007. That citation is incorrect and the last revised date for the approved site plan by the Board was, in fact, dated December 31, 2007. Condition No. 1 of Special Permit 2007-107 is corrected to read as follows: 11. Redevelopment of the property shall be as proposed in plans submitted to the Board. The proposed site plan is entitled "Title 5 Site Plan of 111 Ocean Drive West Hyannisport prepared for John & Margaret Berry" dated September 13, 2007, last revised December 31, 2007, as drawn by Down Cape Engineering, Inc. Construction shall comply with all applicable building and fire codes. 5. Development shall comply with any order of conditions issued by the Conservation Commission and with any requirements of the Board of Health and the variance issued for the on-site septic system. 6. During all stages in the demolition and reconstruction of the dwelling, all vehicles, equipment and materials associated with the demolition/reconstruction shall be required to be located off the right of way of Ocean Drive except as may be required to install utilities and landscape and then only on a temporary basis. 7. All mechanical equipment associated with the dwelling (air conditioners, electric generators, etc.) shall be located so as to conform to the minimum required setbacks for the district. All mechanical equipment shall be screened from neighboring homes and ways. 8. The development authorized by this decision shall be considered full buildout of the lot and there shall be no further construction permit including expansion of the building in terms of footprint or in terms of gross building area without further permission of the Zoning Board. 9. This decision must be recorded at the Barnstable Registry of Deeds and a copy of that recorded document must be submitted to.the Zoning Board of Appeals Office and to the Building Division before any demolition or building permit is issued. Summary: Granted with Conditions Petitioner: John P. Berry and Margaret D. Berry-Trustees of Ocean Street Realty Trust Property Address: 111 Ocean Drive,West Hyannisport, MA Assessor's Map/Parcel: Map 266, Parcel 005 Zoning: Residence B Zoning District Relief Requested and Background: The proposal seeks to demolish the existing nonconforming single-family dwelling on the undersized nonconforming lot and rebuild a new larger single-family dwelling. The location of that new dwelling is based upon the existing structure's nonconforming front yard setback of 10.7-feet. The overall.lot area, including wetlands, is 0.82-acres. The lot is developed with a 1.5-story, three bedroom, single family dwelling consisting of 1,703 sq.ft., and an attached deck consisting of 640 sq.ft. Land division in this area dates to the 1893 "Seaside Park" subdivision in West Hyannisport. However, the creation of this particular lot appears to have occurred after that date by deed. The exact date of construction of the existing dwelling is not known, however, the 1951 air photos shows that a structure existed on the property at that time.. The applicant's representatives, Attorney's Patrick M. Butler and Eliza Cox, submitted a memorandum in support of granting the relief requested. A second application for a variance (Appeal 2007-108) was also submitted as an alternative relief should that be required. The property consists of wetlands. The upland calculation was presented as 16,630 square feet. The top of the bank is roughly situated between elevation 10 and 11 and the proposed location of the dwelling is on that bank. Most of the lot is below elevation 10 and is in a designated FEMA Zone A susceptible to 100 year flooding. The remainder of the lot is within Zone B, the 500 year flood zone. According to the information submitted, the proposed new dwelling is to be a four bedroom, 1.5-story structure with a gross floor area of 2,621 sq.ft., and a footprint of 2,600 sq.ft. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 9, 2007. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December 5, 2007, and continued to January 9, 2007, at which time the Board found to grant the Special Permit A f Town of Barnstable—Zoning Board of Appeals—Decision and Notice Special Permit 2007-107-Berry—Section 240-91.H Demolition Rebuilding subject to conditions. Board Members deciding this appeal were, Ron S.Jansson,James R. Hatfield, John T. Norman, Kelly Kevin Lydon, and Chairman, Gail C. Nightingale. Attorney Eliza Cox and Patrick M. Butler represented the applicant. Ms Cox introduced the proposal noting the memorandum in support which was submitted. Ms. Cox presented the history of the lot and development of it stating that the building was constructed sometime between 1930 and 1940 as it was clearly there in 1944. She stated the level of development on the lot currently consists of 1,800 sq.ft. and that the structure is nonconforming in terms of front yard setback from Ocean Drive. Mr. Peter Brown, the architect for the proposed new dwelling to be built, presented the plans. He stated that the design was developed for consistency with the established neighborhood and that the materials for the structure reflected traditional Cape architecture. The new building would be elevated and the first floor would sit at elevation 16 to assure flood proofing. The.footprint of the'structure is to be 2,600 sq.ft. and the overall gross floor area of the dwelling would be 2,621 sq.ft.. The front yard setback is to be 10.7 feet which is slightly more of a setback than that which now exists, however, still not conforming to current district requirements. He noted the setback was based upon that which exists in order to maintain and increase the setback from the wetlands. The issue of the wetlands was discussed. The Board noted that they had requested that the Town Attorney's office review and issue an opinion as to the definition of wetlands under the zoning ordinance and desired to have that review completed before rendering its decision. The Board also noted that the septic plan submitted with the application had been updated and a copy of that updated plan was requested. The hearing was continued to January 9, 2008. At that continuation, revised plans for the home were submitted along with the updated on-site septic plans for the redevelopment. A letter from Town Attorney- Ruth J. Weil was entered into the file. Ms. Linn Hamlyn of Hamlyn Consultants, the wetland consultant for the redevelopment, testified on the delineation of the wetlands and environmental constraints of the lot. She noted that the edge of the. wetlands and the coastal bank are not contiguous and are separated by upland. Flooding is not annual, only periodical and only at the 100 year storm event would water reach that coastal bank area. Attorney Cox stated that the dwelling would be built in accordance with all current flood proofing requirements and building codes. She noted that the revised plans had added slightly to the overall gross area of the structure that is now 2,772 sq.ft. She indicates that this still conformed with.the floor area ratio requirements and that the dwelling is now to be positioned 11 feet off Ocean Drive which is more.conforming than the existing structure and more conforming than that structure originally proposed in this petition which was submitted with the application. She noted the revised on-site septic plan as approved by the Board of Health had also been submitted. Public comment was requested and no one spoke in favor or in opposition to the request. Appeal 2007-107 is that'petition of John P. Berry and Margaret D. Berry, Trustees of Ocean Street Realty Trust seeking a special permit pursuant to Section 240-91.H(2) — Developed Lot Protection, Demolition and Rebuilding. The petitioners are proposing to demolish the existing nonconforming single-family dwelling located on the lot and rebuild a new single-family dwelling maintaining an existing nonconforming front yard setback of 10.7 feet. The property is addressed as 111 Ocean Drive, West Hyannisport, MA, as shown bn Assessor's Map 266 as parcel 005. It is in a Residence B Zoning District. 2. According to the Assessor's information, the overall lot area, including wetlands, is 0.82-acres. It is developed with a 1.5-story, three bedroom, single family dwelling that has a gross area of 1,703 sq.ft., and an attached deck consisting of 640 sq.ft. The applicant has had an interest in the property since 1996. The Assessor's record cites that the current building was built in 1965, however, documentation has been submitted that the dwelling existed on the lot in 1944. 3. According to the information submitted, the proposed new dwelling being sought is to be a four bedroom, 1.5-story structure with a gross floor area of 2,772 sq.ft. and a footprint of 2,600 sq.ft. The dwelling is to be located 11 feet off Ocean Drive. That setback is based upon the location of the existing structure and the special permit is sought to continue that nonconformance in setback. 4. The applicant has met the requirements of Section 240-91(H) in that the proposed new dwelling conforms to the limitations imposed by the section for floor area ratio, lot coverage by structure and building height. In addition, the applicant has indicated that the design of the proposed new dwelling has taken into consideration the existing neighborhood, level of development on those lots, and design style of the homes. Therefore, the new dwelling will not represent a substantial detrimental to the neighborhood than the existing dwelling. 5. This petition falls within that Section 240-91(H) for the grant of the special permit. That being'to continue the nonconformity in front yard setback established by the existing building. 6. That after an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected as nine letters in support have been entered into the file and there has been no opposition presented by the.public to the Board's grant of the permit. By way of background, on January 23, 2008, the Zoning Board of Appeals granted the special permit Decision permitting Ocean Street Realty Trust(the "Trust') to demolish and reconstruct the residence located on the subject property. The Decision provides that it is valid for a period of one year (consistent with §240-125(C)(3) of the Zoning Ordinance). . On December 19, 2008, we filed a written request with the Zoning Board of Appeals on behalf of the Trust asking for a one-year extension of the Decision. Berry-Trustees of Ocean Street Realty Trust Property Address: 1.11 Ocean Drive, West Hyannisport, MA ' Assessor's Map/Parcel: Map 266, Parcel 005 Zoning: Residence B Zoning District Relief Requested and Background: The proposal seeks to demolish the existing nonconforming single-family dwelling on the undersized nonconforming lot and rebuild a new larger single-family dwelling. The location of that new dwelling is based upon the existing structure's nonconforming front yard setback of 10:74eet. The overall lot area, including wetlands, is 0.82-acres. The lot is developed with a 1.5-story, three bedroom, single family dwelling consisting of 1,703 sq.ft.,and an attached deck consisting of 640 sq.ft. Land division in this area dates to the 1893 "Seaside Park" subdivision in West Hyannisport However, the creation of this particular lot appears to have occurred after that date by deed. The exact date of construction of the existing dwelling is not known, however, the 1951 air photos shows that a structure existed on the property at that time. The applicant's representatives, Attorney's Patrick M. Butler and Eliza Cox, submitted a memorandum in support of granting the relief requested. A second application for a variance (Appeal 2007-108) was also submitted as an alternative relief should that be required. The property consists of wetlands. The upland calculation was presented as 16,630 square feet. The top of the bank is roughly situated between elevation 10 and 11 and the proposed location of the dwelling is on that bank. Most of the lot is below elevation 10 and is in a designated FEMA Zone A susceptible to 100 year flooding. The remainder of the lot is within Zone B, the 500 year flood zone. According to the information submitted, the proposed new dwelling is to be a four,bedroom, 1.5-story structure with a gross floor area of 2,621 sq.ft., and a footprint of 2,600 sq.ft. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 9, 2007. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December 5, 2007, and continued to January 9, 2007, at which time the Board found to grant the Special Permit 'Town of Barnstable—Zoning Board of Appeals—Decision and Notice Special Permit 2007-107-Berry—Section 240-91.1-1 Demolition Rebuilding subject to conditions. Board Members deciding this appeal were, Ron S.Jansson,James R. Hatfield, John T. Norman, Kelly Kevin Lydon, and Chairman, Gail C. Nightingale. Attorney Eliza Cox and Patrick M. Butler represented the applicant. Ms Cox introduced the proposal noting the memorandum in support which was submitted. Ms. Cox presented the history of the lot and development of it stating that the building was constructed sometime between 1930 and 1940 as it was clearly there in 1944. She stated the Level of development on the lot currently consists of 1,800 sq.ft. and that the structure is nonconforming in terms of front yard setback from Ocean Drive. Mr. Peter Brown, the architect for the proposed new dwelling to be built, presented the plans. He stated that the design was developed for consistency with the established neighborhood and that the materials for the structure reflected traditional Cape architecture. The new building would be elevated and the first floor would sit at elevation 16 to assure flood proofing. The footprint of the structure is to be 2,600 sq.ft. and the overall gross floor area of.the dwelling would be 2,621 sq.ft.. The front yard setback is to be 10.7.feet which is slightly more of a setback than that which now exists, however, still not conforming to current district requirements. He noted the setback was based upon that which exists in order'to maintain and increase the setback from the wetlands. The issue of the wetlands was discussed. The Board noted that they had requested that the Town Attorney's office review and issue an opinion as to the definition of wetlands under the zoning ordinance and desired to have that review completed before rendering its decision. The Board also noted that the septic plan submitted with the application had been updated and a copy of that updated plan was requested. The hearing was continued to January 9, 2008. At that continuation, revised plans for the home were submitted along with the updated on-site septic plans for the redevelopment. A letter from Town Attorney- Ruth J. Weil was entered into the file. Ms. Linn Hamlyn of Hamlyn Consultants, the wetland consultant for the redevelopment, testified on the delineation of the wetlands and environmental constraints of the lot. She noted that the edge of the wetlands and the coastal bank are not contiguous and are separated by upland. Flooding is not annual, only periodical and only at the 100 year storm event would water reach that coastal bank area. Attorney Cox stated that the dwelling would be built in accordance with all current flood proofing requirements and building codes. Appeal 2007-107 is that petition of John P..Berry and Margaret D. Berry, Trustees of Ocean Street Realty Trust seeking a special permit pursuant to Section 240-91.H(2) — Developed Lot Protection, Demolition and Rebuilding. The petitioners are proposing to demolish the existing nonconforming single-family dwelling located on the lot and rebuild a new single-family dwelling maintaining an existing nonconforming front yard setback of 10.7 feet. The property is addressed as 111 Ocean Drive, West Hyannisport, MA, as shown on Assessor's Map 266 as parcel 005. It is in a Residence B Zoning District. 2. According to the Assessor's information, the overall lot area, including wetlands, is 0.82-acres. It is developed with a 1.5-story, three bedroom, single family dwelling that has a gross area of 1,703 sq.ft., and an attached deck consisting of 640 sq.ft. The applicant has had an interest in the property since 1996. The Assessor's record cites that the current building was built in 1965, however, documentation has been submitted that the dwelling existed on the lot in 1944. I According to the information submitted, the proposed new dwelling being sought is to be a four bedroom, 1.5-story structure with a gross floor area of 2,772 sq.ft. and a footprint of 2,600 sq.ft. The dwelling is to be located 11 feet off Ocean Drive. That setback is based upon the location of the existing structure and the special permit is sought to continue that nonconformance in setback. 4. The applicant has met the requirements of Section 240-91(H) in that the proposed new dwelling conforms to the limitations imposed by the section for floor area ratio, lot coverage by structure and building height. In addition, the applicant has indicated that the design of the proposed new; dwelling has taken into consideration the existing neighborhood, level of development on those lots, and design style of the homes. Therefore, the new dwelling will not represent a substantial. detrimental to the neighborhood;.than the existing dwelling. 5. This petition falls within that Section 240-91(H) for the grant of the special permit. That being to continue the nonconformity in front yard setback established by the existing building. 6. That after an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected as nine letters in support have been entered into the file and there has been no opposition presented by the public to the Board's grant of the permit. Decision: Based on the findings of fact, a motion was duly made and seconded to grant Appeal 2007-107 t ' subject to the following: 1. Redevelopment of the property shall be as proposed in plans submitted to the Board'.
