A special permit was required pursuant to§240- 91H(3)as the lot contains less than 10,000 square feet. The property is lo cated in West Hyannisport,at the south end of the"Avenues"neighborhood. The 5,901 sq.ft lot contained a 1,222 g.s.f single-family dwelling constricted in 1925. The existing dwelling was located within the required 20 ft front yard setback. The lot also contained a detached accessory shed. Ocean Drive is an unpaved private road at the southern terminus of Third Ave. Land division in this area dates to the 1893"Seaside Park"subdivision,which created the subject lot; however the character of development in the neighborhood continues to change. Several nearby or adjacent parcels received Special Permits to demolish and rebuild in recent years. The Corrrdian's prospective dwelling was initially proposed in conformance with all performance i standards of§240-91H(1)and(H)(3). Procedural 8r Hearing Summary Special Permit No.2013-032 to allow demolition and rebuilding on a lot containing less than 10,000 square feet was filed at the Town Clerk's office and Growth Management Department office on May 20,2013. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on June 26,2013 at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding this appeal were Chair Laura F. Shufelt,William H. Newton,Craig G. Larson, Brian Florence,and David A. Hirsch. I Attomey Peter O'Keeffe represented the Petitioners before the Board. The project architect, I Andrejs Strikis and the Petitioners were also present. Attorney O'Keeffe discussed the existing dwelling and the determination that it would be unpractical to renovate because of its deteriorated condition. He reviewed the proposed dwelling and how it met the requirements of the ordinance, noting that the maximum height of the dwelling was almost 30 feet,but the primary roof structure was 22'6"in height Attorney O'Keeffe and Mr.Strikis provided details of the proposed dwelling, emphasizing the square footage in comparison with other nearby dwellings and the compliance with the coverage and setback requirements. They discussed the dwelling in context with the home to the rear, indicating partial water views from the neighbor's property would be preserved. Attorney O'Keeffe reviewed the transition the neighborhood has undergone,emphasizing the dwelling would be an improvement over the existing condition of the property and that it would not I ` be detrimental to the neighborhood. In response to questions from the Board,Mr-Strikis explained the cupola would provide comfortable access to the roof and the staircase was continuous from the ground level upwards. Board Chair Shufelt requested public comment. Attorney David Lawler spoke on behalf of Tom . and Linda Chisholm of 15 Oak Street. He expressed concern regarding how dose the house would be to the lot line and the potential for the cupola to block sun from their property. He stated I the house would be on four levels and the size and architecture was not in keeping with the character of the area. He said the house was not in keeping with the spirit and intent of the bylaw and did not respect the sensitive environmental condition of the area. Attorney Lawler said the proposal would encroach on the privacy of the Chisholm's and requested the petition be denied. Nina Tupper, 158 Third Avenue,believed the house had an existing water view. She spoke about the financial intent of the Petitioners. She talked about the character of the neighborhood and stated she rebuilt her own home to reflect the prevalent Cape beach house style. She stated that the proposed house was an imposing structure and would be detrimental to the neighborhood. William Stuart,First Avenue,spoke about the origins of the neighborhood and the tradition of i adding onto houses in a piecemeal style. He stated the house would be detrimental to the I neighborhood because of its design and it would block existing water views. He complained about the lack of property maintenance since the Corrdian's took ownership of the property. Tom Scott, Third and Oak,expressed concerns about neighborhood gentrification and that homes were targets for flippers. He stated they were trying to put too much house on a small lot. He expressed concerns that the house would block his water views. Thomas Chisholm, 15 Oak Drive, stated he had been in the neighborhood for 60 years.He expressed concerns about property maintenance by the Corrdian's. Mary Ann Luongo, 152 Third Ave,spoke in support of the proposal. She stated she thought the I house was thoughtfully designed to fit with the neighborhood and would be an improvement over the existing structure. The Board Chair read letters of support from the Giatrelis'and Luongo's into the record. Attorney O'Keeffe addressed the Board,showing an exhibit that showed how the proposed house I fit the scale of the neighborhood and discussed the pervasiveness of rebuilding. The Board discussed the option of moving the house forward to increase the separation with the house to the rear. Options to move it east were discussed but it was identified that the septic system would be in the way. The Board stated the reduced front yard setback would be in keeping with the I character of the neighborhood and may help alleviate concerns of the neighbor. It was determined the house could be moved five feet forward without the need for a redesign. j Findings of Fact At the hearing of June 26,2013,the Board unanimously made the following findings of fact for Appeal 2013-032,a request for a special permit filed by Stephen and Ann Corridan to demolish and rebuild a dwelling on a lot less than 10,000 square feet at 112 Ocean Street,Hyannis: 1. The application falls within a category specifically excepted in the ordinance for a grant of a ' special permit. Section 240-91(H)(3)allows for the complete demolition and rebuilding of a residence on a legal pre-existing nonconforming lot with less than 10,000 square feet of contiguous upland. 2. Site Plan Review is not required for single-family residential dwellings. 2 i t Town of Bamstable Zoning Board of Appeals-Decision and Notice special Permit No.2013-032-Corridan-112 Ocean Sbwt,Hyannis 3. After an evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The square footage of the house is relatively modest and less than several of the adjacent homes. The character of the house is in keeping with the changing character of the neighborhood and development occurring on Cape Cod. I 4. The proposed new dwelling would not he substantially more detrimental to the neighborhood than the existing dwelling. The house will be an improvement over the existing dilapidated I dwelling. 5. Section 240-91(H)states the proposed lot coverage shall not exceed 20%. The proposed lot coverage is,at maximum,17.9%. i 6. Section 240-91(H)states he floor area ratio shall not exceed 0.30. The proposed FAR is.294. 7. Section 240-91(H)states the building height shall not exceed 30 feet to the highest plate and shall contain no more than 2'/2 stories. The building height at the highest plate is 29'6°and the main roof form is 22'6°in height. The house has two above-grade stories,with the second f story contained within the roof and a 10'6°square cupola. i 8. The setbacks of the proposed dwelling are equal to or greater than the setbacks of the existing dwelling. A reduced front yard setback for the proposed dwelling is in keeping with the character of the neighborhood and will increase separation between the proposed dwelling and the existing house to the rear. Special Permit 2013-032 is granted to Stephen G.&Ann C.Corridan for the demolition of an existing dwelling and rebuilding of a new dwelling not to exceed 1,736 gross square feet at 112 Ocean Drive,Hyannis. The dwelling shall be reconstructed in substantial conformance with the site plan entitled"Site (I Plan of 112 Ocean Drive West Hyannisport°dated(rev)April 30,2013,drawn and stamped by Down Cape Engineering,inc.(and as modified by Condition No_3,herein)and the elevations and floor plans entitled°112 Ocean Drive°dated(rev)May 16,2013,drawn by Andrejs R. Strikis,Architect. 3. The rear yard setback shall be increased by 5 feet. The house shall be moved closer to Ocean Drive. A final plan depicting this change shall be submitted to the Growth Management Department staff prior to issuance of building permits. 4. The dwelling shall be for single-family use only. j 5. All mechanical equipment associated with the dwelling(air conditioners,electric generators, . etc.)shall be located so as to conform to the required setbacks for the district and screened I from neighboring homes and the public right-of-way. i I 6. The proposed redevelopment shall represent full build-out of the lot. Further expansion of the dwelling or construction of additional accessory structures is prohibited without prior approval from the Board. T. The dwelling shall be limited to a maximum of three bedrooms. 8. VVIlliam Stuart, First Avenue, spoke about the origins of the neighborhood and the traction of adding onto houses in a piecemeal style. He stated the house waid be detrimental to the neighborhood because of its design and it would block edslg water vkms, He complained about the lack of property maim mance since the Condian's took ownership of the property.
