The property is located in a Business Limited B district and the petitioner under various entities has held title to the premises for over forty years. The property has been used for a variety of marine related uses since the early 40s including boats, marina, rental of outboards and also as parking service to the various waterfront enterprises that have existed at the Harbor sice the late 40s. In 1968 the principal use of the property became a parking lot to service various needs of Hyannis Harbor Tours companies. In 1968 the property was zoned Business which allowed the parking lot use of the premises; the 1978 Town Meeting Zoning By-law changed the locus from Business to its present classification. Also existing on the site is a structure which has been used as a gift shop. Said structure is located fourteen (14') feet from the edge of the existing bulkhead or waterline. The property has the benefit of a Special Permit granted by the Board of Appeals in 1968 for various waterfront improvements including the existing bulkhead area. The property also has the benefit of a Chapter 91 Waterways License authorizing said waterfront improvements. The petitioner proposes to construct on the premises three principal buildings and one smaller building. The smaller building to be utilized for a fish market, will be a single-story building . The three principal buildings will be two-story with retail space on the first floor and two apartments on the second floor of each building. Each apartment to be a one-bedroom unit of approximately 800 square feet, per the revised Plan submitted on March 3, 1987 - said floor Plans to indicate the elimination of guest/den rooms. The total building coverage on the site is about 7,000 square feet. There are nine (9) parking spaces located on the site to service the six apartment units allocating one and a half spacer per unit. There is no parking located on-site to service either the fish market or the retail use of the structures. However, the property has the benefit of a Special Permit granted by the Barnstable Board of Selectmen approving the parking plan and waiving the required parking provisions under Section S, Par. , 2, Sub-paragraph C. At a regularly scheduled hearing of the Zoning Board of Appeals , held on December 12 , 1991 notice of which was duly published in the Barnstable Patriot and forwarded to all interested parties pursuant to MGL , Chapter 40A , the applicant, Hyannis Harbor Tours, Inc. applied to the Zoning Board of Appeals , pursuant to Section 5-3 .3 (3 ) of the Zoning Ordinance and MGL Ch. 40A, to modify or extend the validity of an existing Special Permit (# 1987-09) for one year, from its effective date of 12/26/91 in order to resolve a pending appeal . The applicant' s site is shown on Assessor's Map/Parcel Number 326/65 , is located at Ocean Street, Hyannis , MA and is zoned BL-B Business Limited B District. The petitioner' s request was heard by the following Board members : Gene Burman, Betty Nilsson, Ron Jansson, Richard Boy and Chairman Dexter Bliss . Summary of Evidence: The applicant , represented by Attorney Michael Ford, submitted a memorandum to the Board in support of extension/or modification of Special Permit #87-09. He stated that the applicant received a Special Permit for a mixed retail and residential use complex in 1987. Due to litigation and the final judgment by the Court, the Special Permit originally. granted in 1987 by the Board, did not become effective until December 26, 1990. This Special Permit will expire on December 26, 1991 . This extension is needed in order to resolve a pending appeal of a Conservation Commission' s Order of Conditions . Mr. Ford stated that Abutter Morris I . , Johnston, Trustee of Captain Quarters Condominium Trust of 125 Pleasant Street, Hyannis , and Benjamin D . Baxter Jr. of 187 Pleasant Street , Hyannis , appealed the new Order of Conditions by the Conservation Commission to the Department of Environmental Protection (DEP) pursuant to MGL Ch. 131 , Section 40 , and as a result , no construction on this project can begin until the pending appeal is resolved. Attorney Ford stated that pursuant to the Barnstable Zoning Ord' n mce ( Section 5-3 . ( 3 ) , the Special Permit-._, are valid for one year from the date of issue. The Board of appeals has the authority to make the determination that good cause e:,ists to extend the validity of Special Permit yl#' 87-09 beyond the expiration date. The delay in the commencement . of construction is beyond the control of the applicant and extending the permit for one year until December 26 , 1992 would aid in the relief needed. Mr . Ford submitted copies of letters from Attorney John W. Spillane , of Worcester , Ma. , to the DEP. Attorney Spilllane represents the above mentioned abutters and explained how this 3 year stalling technique has hindered construction. He mentioned that the Scudder Family, Nominee Trust Property Manager , Martin DiMartino, was also present and would be glad to answer any questions the Board might have. The Board asked if the State were to make any changes to the project, will that effect the Special Permit issued. M. Ford responded if State enlarges scope of project in any way, the petitioner will reappear before the Board. The Board asked, since permit was granted in 1987, have there been any material or significant changes to the project. M.- Ford responded that Conservation Commission issued the Order of Conditions with one change; the storage area that was proposed for Building A, was asked to be removed to provide access to public walkway easement (Special Conditions ## 15 of the Conservation Commission , page 5-3A) . Under Facts & Decision(page 3 of 3 ) the right-of-way (easement running from Ocean St. , to the locus) walkways were to be "paved" and curved around and over into the park of the Town . This is the only change that has occurred. No one spoke in favor of petition. Attorney John W. Spillane , representing abutters mentioned above , stated that the abutters are aggrieved by the Barnstable Conservation Commission' s Order of Conditions dated May 20 , 1991 , and requested that the Department of Environmental Protection determine whether the area on which the proposed work is to be done is significant to public or privat` water supply, to the groundwater supply, to the flood control , to storm damage prevention , to the prevention of pollution , to the protection of land containing shellfish, to the protection of wildlife habitat, or to the protection of fisheries . ,Mr . Spillane submitted copies of letters to the Board that j he h- written to; Mark Robinson, Chairman Barnstable Conservation Commission dated May 11 , 1991 , John A. Spillane stated that the project is located on filled tidelands and is not a water dependant project. He stated that the project does not serve a proper public purpose. He asked the Board to deny the extension or modification of the Special Permit. The Beard discussed the concerns raised by Mr. Spillane and determined that none were related to the request being sought by the applicant and should be addressed to the appropriate state agencies . Finding of Facts : At the meeting of December 12 , 1991 , the Zoning Board of Appeals made the following finding of facts as related to Appeal # 1991-62 : The project has been pending for four years and has been reviewed by all agencies involved. No representatives from the Town of Barnstable, the Commonwealth of Massachusetts , or from the Cape Cod Commission are present to comment on this project. There are no public comments on this project. All of the concerns raised by Mr. Spillane will be addressed by- the appropriate state agencies. The Special Permit granted in February 19, 1987, was upheld on December 26 , 1990. The applicant has not been able to begin construction on the project for four years . These events constitute good cause for the petitioner to implement the Special Permit. The applicant has shown a good cause to exercise his rights under Special Permit # 1987-09. Background: This decision concerns the petition submitted by Hyannis Harbor Tours, Inc. requesting and extension in time to implement an original Special Permit #1987-09 granted by the Board on February 19, 1987. The applicant received a one year extension of that permit on December 26, 1991 by a special Permit Extension of Time #1991-62. The applicant is seeking another one year extension of the original 1987 special Permit. No changes are being requested in the terms or conditions of that original special Permit. Procedural Summary: The application for an extension of time was filed in the office of the Town Clerk and at the zoning Board of Appeals office on October 07, 1992. A public hearing, duly noticed under M.G.L. Chapter 40-A, was opened on November 12, at which time the hearing was closed and a decision rendered. The petition was heard by Board Members; Gail Nightingale, Ron Jansson, Wayne Brown, Elizabeth Nilsson and Chairman Richard Boy. Attorney Michael D. Ford represented the applicant before the Board and explained the need for an extension in time to initiate the implementing to Special Permit #1987-09 for a mixed-use development on Ocean Street. He submitted a Memorandum in support of the appeal which documented the occurrences to date that has impaired implementing of the original special Permit. At present, Mass. Department of Environmental Protection superseding Order of Conditions (issued January 10, 1992) is being appealed by an abutter, Extension of Special Permit #1987-09 Appeal No. 1992-66 Trustees of Captain Quarters Condominium Trust. Until this is resolved, implementing of the original Special Permit would be difficult. No one spoke in opposition or support of the request. conclusion: Accordingly based upon the information supplied, a motion was duly made and seconded that, Appeal No 1992-66 for a one (1) year extension of time for Special Permit #1987-09 be granted.
