Attorney Michael O'Neil represented the petitioner, Carlos Mariscal , who is
seeking a Special Permit to remove the existing buildings located on Ocean St. ,
and known as the Landing, to create a parking lot to accommodate 136 parking
spaces. One small corner building will remain for the use of the petitioner.
Photographs were submitted for viewing. The site was recently before the Board
for a Special Permit to construct 12 condo units, but was subsequently denied.
Mr. Mariscal intends to continue ownership of the property. If allowed, the
parking lot would be supervised by Hy-Line personnel who have had many years of
experience with this type of business. The property is located in an RB zoning
district - with a non-conforming use prior to zoning in the Town. The present
lounge can accommodate 240 patrons, while the cottages can accommodate 20 people.
The petitioner intends to surrender the permanent full alcohol license, as well
as the ent a

ert inment license. There is to be/egress or ingress on Old Harbor Rd. ,
to exit on Ocean Street - the vehicles will come in from Channel Point Rd. , -
through the easement, which is owned by the Scudder family. Mr. John Atsalis was
not present at the hearing - he has given his approval , however. There is a need
for parking in this area - with the 'buildin of new motels we have lost about

100 parking spaces. Ft is felt that this will be a better use for the premises -
should be no noise, lighting or changes- - the petitioner will be creating traffic

10:00 p.m. Mr. Scudder tells the Board that his lots are supervised - he has
a security force that patrols the lots for vandalism. There is a ten foot buffer
strip located by Mr. Atsalis's property. Several residents spoke about the aesthetics
of the property - concerned that perhaps shrubs and a fence might not be adequate
to keep the lot separate from the residential area. Also mentioned -was a traffic
study. The Board voted to grant the ,Special Permit to allow the parking lot as
per the plan submitted - to have no exit on Old Harbor Rd. , - to have a five foot
wide strip of vegetation as a buffer around the complete perimeter to have a
post and rail fence - the existing fencet6o be removed - the petitioner will also
surrender the liquor license, ,.and there/be no dumpsters on the site.
