O.Box 271 Hyannis,MA 02601 (508)778-0853 April 10,2004 Tom Perry Zoning Agent 200 Main St Hyannis,MA 02601 Re:Building Permit for 27&51 Nantucket St.,Hyannis not in compliance with The original proposal requested to the Conservation Commission O`( I am herewith requesting that someone either from your office or the appropriate office due a site j l� inspection of the property listed above as I believe that the are not in compliance with the proposal they '1 s c y 1� p l�rty put forward to the Conservation Commission in their original request for a permit to build. In their original proposal they stated that they wouldn't be bringing in any fill and use just fill from the site. They also stated in their original proposal they plan to build a house with a cellar thus no need to bring in fill. This was a major contention with us abutters as the rear of our properties that abut Mr.Hudson's is in a flood zone and any rising of the contour lines would put us at harm. They not only brought in fill they-have,in my-opinion,they have raised the contour lines on the property higher than what they proposed. I and Mr.Nick Anestis(another abutter)had a 6-foot stockade fence put in on the properly lines that abut Mr.Hudson.We also had the fence contractor use longer posts and in fact raise the height to 7 feet at the top of the fence.Yesterday I walked the fence line between my yard and Mr. Hudson and from his side I can look right over the top of the fence,I stand 5' 8"tall and can rest my chin on the top of the fence. He has risen his property at least 2 feet above his abutters again not what he proposed in°his proposal(I have video copies of all Conservation Commission Meetings). They are proceeding at a frantic pace putting the structure up and I feel before any more hardship Mr. Hudson can bestow upon himself(although he does create his own hardship)an inspection is due to put him in compliance to what he originally proposed. I would also request any site inspection also include a inspection of the neighboring abutters as to what effect Mr,Hudson project has on their properties. His original proposal didn't include the contour lines of us abutters. I think Mr.Hudson changed his plans to have a cellar when he discovered if you dig down a few feet you'll hit water that never goes away(great place to build a house). He now has a frame up that stand 3 stories tall(is there a height regulation in this town?). His house is just about as high as Mr. Anestis',which is directly behind but on an elevation of at least 10 feet higher. We would hope that the town would protect the abutter's rights as well as Mr.Hudson's.
