1. On July 12, 2020, I was assigned to the sector of Hyannis on the midnight shift in marked cruiser E-239.
At approximately 0411 hours, Officer J. White and I were dispatched to 23 Olander Drive for a report of a
disturbance. The reporting party. Costa advised dispatch that he had been assaulted by a male later
identified as : .. Schmidt. Upon my arrival we spoke with and he advised me that
was now inside the house. He said that he was highly intoxicated.
2. I asked NIMPto explain to me what had happened and he said that he was punched in the face by

he never place his hands on IWe asked if he could go anywhere else for the day and he -
said that he has permission from "Uncle Phil"to be on the property. He did not know Phil's last name and
said that he was sleeping upstairs. said that he has been cleaning the property in return for sleeping
at the residence. I noticed that the property was still a mess and had two vehicles that appeared to not be
operational. I have listed them in this report. ` O was confrontational with us but then complied to
leave the property. I transported him to Cromwell Courts. �.,did not appear to be intoxicated. At
this time I have nothing further to report.

The subject dwelling is a 2 bedroom, 1 bath'ranch constructed in 1971 on 1.27
acres: .
History:
This property has been the subject of numerous emergency response calls recently.
HFD reported occupants living in three trailers.
Residents:
A male resident approached us from the back yard before we were able to reach the
front door. He identified himself as Lawrence, brother of the property owner. He
escorted us to his trailer(the 16' unit)but:"remained evasive concerning the occupancy of
the slide.-in camper or the names and history of the other residents.
Conditions:
Trader sizes are approximated on in order to distinguish one unit from the others
16 Travel Trailer
Lawrence`admitted that he resides.in the 16' camper. He allowed us to
look inside and a photograph was taken. I noted a bed and personal belongings inside as
well as the ability to prepare and keep food. When asked about grey water discharge;
Lawrence informed us that he does not use the restroom and wash facilities in the
camper. He advised he has access to the main house.
lode 47 Camper
Official reports resulting from emergency responses identify Lawrence's daughter;Olivia
Ryan'as'the occupant in this unit. The rear door was ajar but the unit was dark. A sitting
area.was noted on a makeshift patio behind the camper.

Lawrence.would not discuss the other residents except to indicate that an unrelated tenant
named:Hakim resides in the 22' camper and another unrelated tenant resides in the main
house'with`the owner. (Names/ages were'not provided by Lawrence):
22' Travel Trailer
This unit was somewhat shielded by fencing: Itremained visible from the side. James
(Health) found that this trailer was discharging grey water directly into the ground.
(Photos on file attached to property record). A platform consisting of a section of fencing
and.covered with carpet created a patio landing just outside the unit's entrance.
It was determined that Hakim Clay (formerly of 95 High School Rd) resides in this`uhit
Dwelling
Phillip Spencer,the property owner resides in the main house with an unrelated tenant.
During this inspection, a young man was observed exiting.the house.
Brenda Cugno (formerly of 95 High School Rd)was identified as living on site although
it,could not.be definitively determined if she lived with Hakim Clay or Phillip Spencer.
Yard:
The side and side rear yard was littered with snow blowers, lawn mowers, propane tanks,
miscellaneous metal parts, bicycles, microwaves, etc. A number of gas cans were lined
up against a section of fence. There was an old rusted oil tank in the field and a small
bobcat on a trailer. Bags of household trash were piled on top of an old truck.` There were
multiple unregistered vehicles on site (being addressed by the BPp)
Cpnclusion,:
At the'conclusion of the inspection, Lawrence was provided:f with business cards and
Advised to have Phillip contact the Health Division before the close of the business day
(8/29.). He was also instructed to contact me directly(the next day) after he received
direction from James concerning the discharge of grey water. Mr.' Spericer did reach out
to lames that afternoon but as of the afternoon of 8/30 he had not contacted me

HFD`reported to the site with.BPD for an overdose.
There,have been 4!PD responses to this address.between 7/29/17&8/30/17.
Action
A cease & desist order issued addressing the living arrangements in the trailers/campers,
the operation of a recycling business and an order to cleanup/remove all hazardous .
materials from site was sent 8/31/17 by registered mail to the property,owner.
Health'sent a 24 hour notice to vacate and a demand for a permit to eliminate the illegal
the discharge;of grey/black water into the ground or an unpermitted system. A 14 day
notice to.remove all trash and appliances and to screen the remaining items from
public.view was also included.

23 Olander Drive, Hyannis
Conditions Partly cloudy/clear, dry, very mild-70 degrees
Performed a follow up inspection with Bob McK, Therese, Bill Rex and James.
Spoke to Phillip Spencer. Advised no one can live in trailers/campers. Confirmed that
Joaquim is living in one unit and his brother is living in the other. The resident in the 3rd
unit is no longer here according the Phillip Spencer(property owner).
One unreg truck being relocated today (tow truck called during team's presence).
They will continue to work on removing others. Snow blowers will be gone shortly as
well.
I advised that the time has come to end the living arrangements in the trailers. Required
him to let me know if trailers are moving to another town (as he indicated was a
possibility) or identify whatever other option they have decided to take.
Therese informed Mr. Spencer that she will stop by next week to check on progress.

Responded in C-3 to 23 Olander to investigate a complaint of. burning trash outside from. a
neighbor. Ori arrival at location there is a very strong stench of burning plastic and
garbage. There is a concrete block fire pit with a cover on it, smoldering. There is no
one outside near the fire pit and also no hose present. .Upon knocking on the door an elderly
male answers, he states he� does not live there but is only visiting. when asked about the
property owner he states he left. As I am explaining about the burning of trash to him, I
notice two other males seated in a van in the driveway, one is -eating and the other is
drinking a pint of alcohol. Neither of these individuals make any attempt to engage me or
the oldet male. when asked who they are, the male I'm speaking with identifies the driver as
the home occupants brother. I motion for him to roll down the window of the vehicle so I can
speak to him, he does so reluctantly and tells me he also lives there he identifies himself
as Lawrence Sterling. I ask about the burning trash and he denies any knowledge of any of
it. He is advised of the laws and regulations of outside fires and open burning, and the
fact that I personally have been there before about burning trash. I tell him that nothing
more is to be burned and if he or anyone at the premises wants to burn they need to contact
the FD first. He responds that he understands.'

Residents:
A male resident approached''us from the back yard before we were'able to reach the.,
front door:He identified himself as Lawrence,brother of the property.owner.. He
escorted us,to his trailer,(the 1.6'.unit)buf remained evasive concerning the occupancy of
the slide-in camper or the names and history of the other residents
Conditions
Trailer sizes are approximated on in order todistinguish one unit from the'others

Lawrence'admitted that he resides in the 16' camper:: He allowed us to
look inside and a photograph was;taken.'I noted a bed and:personal belongings inside as
well as the ability to prepare and keep food. When asked about grey water discharge;
Lawrence` informed us that he.does not use the restroom and wash facilities in the
camper., He advised he has access to the main house....
Slide In Camper
Off cial reports resulting from emergency responses identify Lawrence's daughter,.Olivia
Ryan as`the occupant in this unit The rear door was`ajar but the unit was dazk. A sitting
area was noted on a makeshift patio behind the camper.

Lawrence would not.discuss the other residents except to indicate that an unrelated tenant
namedHakim'resides in the 22' camper and another unrelated tenant resides in the,mam `
house with`the owner. (Names/ages,were not provided by Lawrence) �.e

Good afternoon all,
1 just got off the phone with Lolita Spencer, sister to Philip Spencer who resides at 23 Olander. Ms.Spencer advised that
her brother went into Cape Cod Hospital on November 11, 2018. He will be moved from there in the not too distant
future to a rehab facility in order to assist him with getting back on his feet. Ms.Spencer stated that her brother should
be out of rehab by the end of December. I advised her that we (PD) had some recent responses to the property to
include an arrest (warrant), she was unaware of this activity.
She added that the trailer that her brother Lawrence had died in (located in the backyard)was dismantled and that the
owners of the other campers had been told to remove them'but were dragging their feet. I asked her to provide me
with the names of these people and that we-would assist with getting them out of there as the colder weather was
coming and codes/zoning do not allow for people to live in campers on that property, never mind the unregistered"
status of these vehicles.
Ms. Spencer added that the property cannot be sold now as there'are "problems"with the house and that she needed
to have a conversation with Philip once he got out to decide how to proceed forward. I'm not sure how much longer we
can/should let this go on and I'm open to any suggestions. I will do what I can to find out who's living where (and in
what) on the property in the meantime.

Hi Robin,
PD/HFD/and I had a teleconference with Mr. Spencer's sister(her name escapes me). Apparently she has recently
received guardianship of Mr. Spencer and is in the process of relocating him to her home in North Carolina. Meanwhile
the house is being sold. She anticipates that Mr. Spencer will go with her by 11/1/18 and the closing on the house on
11/15/18.
I went by the house today and noted that some work has been done to clean out the yard and a pile of debris has been
loaded in and behind a pickup in the driveway. There is still a very long way to go for clean-up but it looks like progress
is being made. Officer Gallant is away this week but HFD and I will monitor any progress.

and covered with carpet created a patio landing just outside the unit's entrance.
It was determined that Hakim Clay (formerly of 95 High School Rd) resides in this unit.
Dwelling
Phillip Spencer,the property owner resides in the main house with an unrelated tenant.
During this inspection, a young man was observed exiting the house.
Brenda Cugno (formerly of 95 High School Rd) was identified as living on site although
it could not be definitively determined if she lived with Hakim Clay or Phillip Spencer.
Yard:
The side and side rear yard was littered with snow blowers, lawn mowers, propane tanks,
miscellaneous metal parts, bicycles, microwaves, etc. A number of gas cans were lined
up against a section of fence. There was an old rusted oil tank in the field and a small
bobcat on a trailer. Bags of household trash were piled on top of an old truck. There were
multiple unregistered vehicles on site(being addressed by the BPD). '
Conclusion:
At the conclusion of the inspection, Lawrence was provided with business cards and
advised to have Phillip contact the Health Division before the close of the business day
(8/29). He was also instructed to contact me directly(the next day) after he received
direction from James concerning the discharge of grey water. Mr. Spencer did reach out,
to James that afternoon but as of the afternoon of 8/30 he had not contacted me.
Evening August 29 -30
HFD reported to the site with BPD for an overdose.
There have been 4 PD responses to this address between 7/29/17 & 8/30/17.
Action:
A cease & desist order issued addressing the living arrangements in the trailers/campers,
the operation of a recycling business and an order to cleanup/remove all hazardous
materials from site was sent 8/31/17 by registered mail to the property owner.
Health sent a 24 hour notice to vacate and a demand for a permit to eliminate the illegal
the discharge of grey/black water into the ground or an'unpermitted system. A 14 day
notice to remove all trash and appliances and to screen the remaining items from
public view was also included.

Conditions Partly cloudy/clear, dry, very mild-70 degrees
Performed a follow up inspection with Bob McK, Therese, Bill Rex and James.
Spoke to Phillip Spencer. Advised no one can live in trailers/campers. Confirmed that
Joaquim is living in one unit and his brother is living in the other. The resident in the 3rd
unit is no longer here according the Phillip Spencer(property owner).
One unreg truck being relocated today (tow truck called during team's presence).
They will continue to work on removing others. Snow blowers will be gone shortly as
well.
I advised that the time has come to end the living arrangements in the trailers. Required
him to let me know if trailers are moving to another town (as he indicated was a
possibility) or identify whatever other option they have decided to take.
Therese informed Mr. Spencer that she will stop by next week to check on progress.

Ok folks, here's the latest update. Both trailers are off the property. Steven Newcomb has been trespassed. Hakiim
Clay and Brenda Cugno's trespass order was rescinded by Phillip Spencer(his sister was made aware and she was
comfortable with that). I've advised her that if the PD or any other Town entity has problems with the property in the
future, her brother could be on the receiving end of a citation if progress comes to a halt. I'm encouraged by the site of
the dUmpster but I fear the clean-up will continue to be slow moving and require frequent checks.

I stopped at 23 Olander during the week of April 2, 2018.The owner was not home, but I did observe a generator
running while I was on site. It was located in side yard next to what I believe is a new camper. It was far enough onto
the property that I didn't feel comfortable approaching it to further investigate. I was unable to tell where the
generator was running. A group site visit may be needed to check up on things again. Numerous items remain on the
property that should be screened from public view.

As all of you are aware,there has been an inordinate amount of responses to this property for various reasons including
living in RVs, drug activity, and medical calls. The property owner, Phillip Spence has not returned any calls or
communicated with us in any fashion. In the past two days, we have received a couple of complaints concerning a
generator that is alleged to be serving three occupied RV units. It's said to running 24/7. (Not sure if Health confirmed
this at this point with a drive-by).
Rather than addressing the violations and concerns of each discipline individually and on separate occasions, it might.be
an appropriate case to look at from a team management perspective similar to our recent discussion on Blueberry. .
have reserved the conference room for Thursday 8/16 at 2PM in anticipation of everybody's participation. (Brian I put
this on your calendar already and Debi will send out invitations to all through Outlook). At this point, I am asking the
following agencies to identify the number of emergency responses for both Police& HFD from August 1, 2018—August
of this year.

I received a phone call concerning the cease & desist notice issued to Phillip Spencer for 23 Olander. Specifically,the
inquiry was regarding the removal of the RV/travel trailers within 1 week.These units have long been consistently
occupied thus resulting in the subject order.The caller identified himself as Hakeem. He stated he had just received a
copy of the C&D order and wanted to know.what it meant. It should be noted that the orginal C&D is issued to the
property owner and copies were provided and hand-delivered to all occupants. Hakeem's girlfriend received her own as
well as a copy for Hakeem).
I advised.that the order means the travel trailers go away-off of the property. He wanted to know why the trailers had
to leave the site if they were no longer being occupied I told him there is a lengthy history on this property and those
trailers are not registered to the property owner. They have to go. OFF SITE. PERIOD. He replied that it's not fair
because they just got notice. I corrected him and told him that he had previously received a C&D order but ignored it. I
also explained that the town is done with them and this situation all together and whether or not they voluntarily move
the trailers—the property will be cleaned up including those units with or without their assistance. I advised him to
make sure both trailers were relocated. He said he does not control the other party.Then he questioned if it meant he
had to leave the site. He claimed he has permission to now live in the house. I replied that he can't live in the house as
that would create an over-crowding situation. I know there are only three bedrooms and they are all occupied. I told
him you cannot camp out in the house.
Hakeem subsequently made the following argument:
Sonny Mac was transported to CCH on 1219. He was hallucinating and not well. He will not be back and when released
will be put in a nursing home.
Harvey& his girlfriend took off with the household cable money collection. They were gone for a couple of days. Philip
kicked them out for stealing. They won't be back.
That leaves at least one bedroom available for Hakeem.
I told him I knew Phillip was still in CCH on the last day I was there and had not been released. Hakeem stated that
Phillip was released from CCH about 2 weeks ago but had been staying with his wife on Pitcher's Way. He is now
returning to his home and Phillip was responsible for evicting Harvey and his girlfriend. I let him know that Sonny Mac's
room was still Sonny Mac's room until he is permanently and officially out and settled in nursing home.
When asked, Hakeem said he had a place for the trailer but refused to say when it would be moved (he reminded me
still has 3 days) or where it end up. He wanted to know why I wanted to know. Ultimately, Hakeem added that he was
.getting his own apartment.
At this point I was just done with all of his nonsense and reminded him that I would be checking out everything he said. I
concluded the conversation.
