Dear Mr. DaLuz:
Confirming our telephone conference of March 13, 1989, you have told me that you have
reviewed the subdivision of the Rocheteau property, more specifically, as it relates
to Lots 12A and Lot A on the new plan.
You have indicated that based on your review, Lot A is a buildable lot under the cur-
rent rules and regulations of the Town of Barnstable. You maintain this opinion even
though Lot A and Lot 12A are contiguous and have been in common ownership. Your posi-
tion is that hese lots are shown on a subdivision plan (as I understand it, approved
by the Planning Board, but not recorded) and each lot had sufficient square footage
at the time of the endorsement of the plan. It is my understanding that, in your op-
inion, these lots are still remain grandfathered at least until 1990. You have further
indicated that, in your opinion, if one of the lots is conveyed to a third party, this
is sufficient to take the lots out of common ownership and therefore Lot A will remain
buildable.
I believe that this letter correctly sets forth what you told me and I would invite
your further response if I have misstated anything.
