My brother, David Sydney,owns a second undeveloped lot on the same road_ Pawnee-Court runs off of Sydney Drive, which in turn runs off of Pitcher's Way. The lots are identified on the Assessor's map, as referenced above. Both lots are approximately 10,000 square feet- My brother and T are interested in selling these lots. A single family home built around 1975 is located in a third lot between my lot anal my brother's. Across the road lies property owned by the Barnstable Water Company, Pawnee Court, a dirt road,has existed for at least twenty-five years. To my, knowledge.the town does not plow this road in the winter. As I previously stated to MT.,Buddy Martin,in a letter dated April 6, 1999,these two lots were not held in common witb any abutting lot at the time of the zoning change in February of 1985. Because of the size of these lots and their proximity to a well located at the house situated between them.,I obtained variances in January 1999 from the.Town of Barnstable Board of Health to construct septic systems for lots 005 and 137, suitable for a two- bedroom home on each lot, subject to providing town water to all three lots(thereby s 04,'29/99 12:08 W617 727 0030 DIy. I have since obtained permission from the owner of the house located between the two undeveloped lots to hook his house to town water. I have also had discussions with. Mr. Norman Nault of the Barnstable Water Company regarding the installation of the water main pipe from a location on Sydney Drive up through the length of Pawnee Court,with appropriate fire plugs. I have also obtained bids for the installation of this pipe and related equipment. Pawnee Court was established pursuant to a plan of land dated February 12, 1962 and filed in Plan Book 167,page 133 at the Barnstable Cowity Registry of Deeds. A second plan, dated March 3, 1964,delineates the lots on Pawnee Court. and is recorded in Plan Book 183,page 21. The plan is stamped"Approval not required". It is my understanding,from Mr. Frank Schlegel at the Town of Barnstable Engineering Department that the responsibility falls to you in this instance to determine if the dirt road provides"suitable and adequate access" for construction of a new home on lots 005 and 137. I request your determination of this issue. In support of leaving Pawnee Court a dirt road,I offer the following: • The road is at least twenty-five years old,and has always been a dirt road A house has been on that road since approximately 1975, and the residents have expressed no difficulty with access or keeping the road clear The road proved sufficiently accessible to the Barnstable Water Company vehicles when they conducted test drilling on the adjacent land i The road is located in a wooded area. The dirt road is aesthetically more pleasing than a paved road in this location. • The combined market value of lots 005 and 137 is $45,000. When the cost of road paving (I am informed approximately $150/foot or at least$60,000)is deducted from the market price,the value of the property turns negative. This is true even before deducting the cost of the water main installation(approximately $10,500)and approximately$2,500 (for services already rendered) for engineering of the septic system variance applications and water main installation Because the road abuts a watershed,the potential for runoff from asphalt, even if into catch basins, poses a greater risk than no runoff from the existing dirt road The dirt road discourages traffic. Less traffic is likely to reduce the risk of brush fires in the woods caused by careless drivers(tossing oat lighted cigarettes etc.) � I 1 04/29/99 12:09 %P617 727 0030 DID'. There is no storage or use of toxic or hazardous materials,or flammable or explosive materials,in excess of normal household quantities. Any need for parking generated by such use shall be met on the same lot containing the Customary Home Occupation,and not within the required front yard. There is no exterior storage or display of materials or equipment. I have since obtained permission from the owner of the house located between the two undeveloped lots to hook his house to town water. I have also had discussions with Mr. Norman Nault of the Barnstable Water Company regarding the installation of the water main pipe from a location on Sydney Drive up through the length of Pawnee Court, with appropriate fire plugs. I have also obtained bids for the installation of this pipe and related equipment. Pawnee Court was established pursuant to a plan of land dated February 12, 1962 and filed in Plan Book 167,page 133 at the Barnstable County Registry of Deeds. A second plan, dated March 3, 1964, delineates the lots on Pawnee Court, and is recorded in Plan Book 183, page 21. The plan is stamped "Approval not required". It is my understanding from Mr. Frank Schlegel at the Town of Barnstable Engineering Department that the responsibility falls to you in this instance to determine if the dirt road provides "suitable and adequate access" for construction of a new home on lots 005 and 137. I request your determination of this issue. In support of leaving Pawnee Court a dirt road, I offer the following: • The road is at least twenty-five years old, and has.always been a dirt road • A house has been on that road since approximately 1975, and the residents have expressed no difficulty with access or keeping the road.clear • The road proved sufficiently accessible to the Barnstable Water Company vehicles when they conducted test drilling on the adjacent land • The road is located in a wooded area. The dirt road is aesthetically more pleasing than a paved road in this location • The combined market value.of- lots 005 and 137 is $45,000. When the cost of road paving (I am informed approximately,$150/foot or at least $60,000) is deducted from the market price, the value of the property turns negative. This is true even before deducting the cost of the water main installation(approximately $10,500) and approximately $2,500 (for services already rendered) for engineering of the septic system variance applications and water main installation • Because the road abuts a watershed, the potential for runoff from asphalt, even if into catch basins, poses a greater risk than no runoff from the existing dirt road • The dirt road discourages traffic. Less traffic is likely to reduce the risk of brush fires in the woods caused by careless drivers (tossing out lighted cigarettes etc.) Robert F. Dear Commissioner Crossen:, , I am the owner of an undeveloped,lot of land on Pawnee Courtin Hyannis. My brother, David Sydney, owns a second undeveloped lot on the same road. Pawnee Court runs off of Sydney Drive, which in turn runs off of Pitcher's Way. The lots are identified ; on the Assessor's map, as referenced above. Both lots are approximately 10,000 square feet. My brother and I are interested in selling these lots. A single family home built around 1975 is located in a third lot between my lot", and my brother's. Across the road lies property owned by the Barnstable Water j Company. Pawnee Court, a dirt road, has existed for at least twenty-five years. To my knowledge, the town does not plow this road in the winter. As I previously stated to Mr. Buddy Martin, in a letter dated April 6, 1999, these two lots were not held in common with any abutting lot at the time of the zoning change in February of 1985.
