The locus contains a dwelling and detached garage on a lot consisting of 8,622 square feet - the zoning district cuts through the residential structure for which the petitioner proposes use of retail on the first and second floors, with an existing studio apartment on the third floor. The garage is located solely in the residential zone, for which the petitioner seeks relief to use for office/retail...:..-.:The existing dwelling contains 1292 square feet and the garage contains 400 square feet. Gail Nightingale made a motion to approve the petitioner's request for office/ retail use in the existing footprint of the one-story garage - to be one office and one use. As this building bisects the zoning districts, it is felt that this use will not be detrimental to the neighborhood, which is comprised of many businesses. Dexter Bliss seconded the motion. Caffe Gelato Bertini is an ice cream take-out business located in a 792 sq.ft.,structure at the rear of 20 Pearl Street. As designed,the sign is to measure 4-feet high and 2-feet in diameter and located to the right of the driveway entrance to the property just off Pearl Street. The property is owned by the William Sturgis Friends Educational Foundation and is leased to Cindy and Tom Duby. The Sturgis Charter Public School,as representative of the owner of the property, has assented to the application as acknowledged in an April 11, 2011 letter submitted to the file. The Hyannis Main Street Waterfront Historic District Commission has reviewed the proposed sign and issued a Certificate of Appropriateness on April 11, 2011. The Building Commissioner has approved the location of the sign as shown on a site plan submitted with the condition that the applicant"make sure the sign is on same lot as the business." At the hearing of May 9, 2011 Cindy and Tom Duby were present to present the proposal to the Board. Cindy Duby cited that the setback of the building creates the need for the hardship sign. The building is a small building sited to the rear of the lot at 20 Pearl Street. It is not visible from Main Street. Findings of Fact: At the regularly scheduled meeting of the Board on May 9,'2011, a motion was duly made, seconded and unanimously agreed to make the following findings of fact: 1. The location of the business in a building located to the rear of the lot on which it is located and off Main Street presents a substantial hardship in terms of it being seen from Main Street. 2. The Hyannis Main Street Waterfront Historic District Commission has reviewed the proposed sign and issued a Certificate of Appropriateness for the sign on April 11, 2011. _ 3. The Building Commissioner,has reviewed the site plan for the proposed location of the sign and has approved the site location for the sign with the condition that the applicants "make sure the sign is on same lot as the business." 4. The property is owned by the William Sturgis Friends Educational Foundation and is leased to Cindy and Tom Duby. The Sturgis Charter Public School, as representative of the owner has assented to this application of the sign as documented in the April 11, 2011 letter submitted to the file. 5. Given the information submitted,the proposed sign will conform and be maintained in full conformance with all of the required performance standards for a location hardship sign. 6. -The Board is authorized in Section 240-71.E(4)to hear and grant a special permit for a location hardship sign. 7. After evaluation of the evidence presented,the proposal fulfills the spirit and intent of the Ordinance and does not represent a substantial detriment to the public good or neighborhood affected. 8. In issuing a special permit for location hardship signs,the Board has imposed a date on which the permit will expire if not renewed by the applicant. This has been imposed to provide an opportunity to evaluate impacts to the neighborhood, abutting and adjacent business owners, and safe passage for pedestrians. Decision: Based on the findings of fact, a motion was duly made and seconded to grant a special permit subject to the following conditions: 2 Town of Barnstable, Planning Board Decision on Special Permit Application No.2011-006, Cynthia Duby dba Caffe Gelato Bertini,.Location Hardship Sign 1. This permit is issued to Cynthia Duby dba Caffe Gelato Bertini to allow for display of a Location Hardship Sign at 20 Pearl Street, Hyannis, MA. The sign shall be that three-dimensional representation of an Ice Cream Cone as presented to the Board and photos of which entered into the file, with the exception the height of the cone shall not exceed 4 feet. 2. The sign shall be maintained in conformance with the performance standards outlined in Section 240-74.E.4.b. 3. The sign shall be located on private property as shown on the plan approved by the Building Commissioner, signed and dated 4-8-11 and entered into the file. 4. This Special Permit shall lapse on January 31, 2012, unless prior to January 31, 2012, the applicant applies for and is granted a renewal. Failure of the Planning Board to take action within sixty days of a timely request for renewal shall result in a renewal of said special permit for an additional two years until January 31, 2014.Any permit so extended may be renewed by the Planning Board upon application received prior to the lapse of the special permit. S. This special permit must be recorded at the Barnstable County Registry of Deeds. A copy of the recorded decision shall be submitted to the Building Division and the Planning Board prior to submission of a sign permit application. 6.
